After nearly three hours of listening to residents express their opposition, Upper Arlington City Council members voted 4-3 tonight to approve the controversial rezoning of 1.34 acres of wooded green space north of the Municipal Building that would allow construction of an office building.
For those council members in favor, it came down to a need for economic development to address the citys financial woes, and serving all residents, not just those neighbors who turned out in force tonight.
Those opposed to the measure believe the land around any city hall is sacred.
The rezoning actually takes in more than 5 acres, which includes the Municipal Building only because that is the minimum required by office and research district zoning.
But only the small point to the north where Kenny and Tremont roads converge would be positioned for development, City Manager Ted Staton said.
Councilman Kip Greenhill, who voted against the plan, said he thought that in 25 years, someone might ask him, Why did you build your city hall behind a commercial development?
That seemed to be the opinion of most of the 150 people in the audience, a majority of whom are residents of the Trouville condominiums to the south of the Municipal Building, and neighborhoods across Kenny Road to the east.
An attempt by one resident to obtain a temporary restraining order earlier in the day to stop the meeting was turned down by Franklin County Common Pleas Judge Pat Sheeran.

On May 26, Kyiv Mayor Vitaliy Klitschko called on protesters to clear their encampment on the citys Independence Square. Six days later, facing heavy criticism from those who toppled former President Viktor Yanukovych in last winters EuroMaidan Revolution, Klitschko changed his mind.
Kyivs top official is not the only one confused about what to do with the Maidan. In the wake of billionaire businessman Petro Poroshenkos election and inauguration as president, many are skeptical that Ukraines government will embody the democratic spirit of the EuroMaidan Revolution.So, whats next for the Maidan?
Lviv-based architects Erik Herrmann and Ashley Bigham have an idea.
In a recent competition sponsored by CANactions, the largest architecture festival in Ukraine, Herrmann and Bigham presented a proposal to build The Kyiv Forum, a semi-permanent structure on the Maidan designed to facilitate political and cultural dialogue.
The Kyiv Forum is a 10-story egg-shaped steel structure with a wooden lattice that includes an amphitheater, art museum, and library, and hopes to recreate the political spaces of antiquity in modern Ukraine.
Bigham says their goal was to create a framework of political space that people would come and change...on a daily, monthly, or seasonal basis. This transience, they say, would allow for the kind of spontaneous association that characterized the EuroMaidan Revolution.
Our idea for the forum was to create a venue for those who want to continue occupying the Maidan, but want to change from a culture of reaction to a culture of pro-action, says Herrmann.
Bigham, a U.S. Fulbright Fellow, and Herrmann, a German Chancellor Fellow, say Ukrainians resourcefulness and organization during the EuroMaidan Revolution inspired them to design a piece of non-programmed architecture on the Maidan.
Bigham hopes their project will create a more formalized system for meeting, discussing, and creating with just enough formality...allowing people to manipulate the space as they need...These amazing events are happening [but Ukrainians] are really lacking the proper public space for them.
Herrmann believes Ukrainians can benefit from a piece of architecture that has enough structure to create a cohesive environment, and enough cues to demonstrate how a space might be potentially used, but that would be open to a variety of political and cultural events.

Architects propose a new vision for the Maidan
WASHINGTON Shuffling his second-term Cabinet, President Obama plans to nominate Housing Secretary Shaun Donovan his point man in overseeing the governments response to Superstorm Sandy to be budget director, according to people familiar with the selection process.
Obama is considering San Antonio Mayor Julian Castro to succeed Donovan, the sources said. The moves would raise the profile of two men with close ties to the president.
Donovan is an original member of Obamas Cabinet and is well-liked within the White House, where officials have lauded his work in overseeing the Sandy response. As budget director, he would have significant influence over the administrations policy and spending priorities.
The White House said Saturday that it had no personnel announcements to make, but on Thursday, Obama had words of praise for Donovan.
In the aftermath of Sandy, when we thought about who was somebody who we had confidence could drive a process to make sure that the federal, state and local coordination delivered for the people who had been affected, and that we could rebuild both on the New York side and the Jersey side as effectively as possible and as quickly as possible, Shaun came to mind, Obama said during a fundraiser in New York that Donovan also attended.
Donovan would be leaving his job at Housing and Urban Development at a time when New Jersey residents affected by Sandy have been complaining of delays in getting federal aid. This month, members of the states congressional delegation raised those concerns in a meeting with Donovan. They said Donovan made a bedrock commitment that New Jersey will get the money it deserves, saying the third wave of funds from Washington could begin moving in the next several weeks.
Donovan also said this month that he would not rule out the possibility that other disaster-stricken states could get as much as $1 billion of the $52 billion approved primarily for Sandy recovery last year. New Jersey House members, who battled to get the aid package through a House Republican majority that initially blocked it, said they also expressed strong opposition to that possibility.
The director of the Office of Management and Budget is a Cabinet-level post under Obama. Those who have held the job earlier in the administration, including current Treasury Secretary Jacob Lew, have played crucial roles in setting budget priorities and negotiating fiscal agreements with Congress.
If confirmed by the Senate, Donovan would take over from Sylvia Mathews Burwell, who was nominated to lead the Department of Health and Human Services after Kathleen Sebelius resigned this year.
Castro, Donovans possible replacement, has seen his star rise since Obama picked him to deliver the keynote address at the 2012 Democratic National Convention. Castro, 39, is considered a possible vice presidential pick in 2016.
