Urdaneta Apartments board faces raps -

MANILA, PhilippinesFor reversing the agenda items to prioritize waterproofing and painting over the installation of a required fire sprinkler system, officials and members of the board of directors of the Urdaneta Apartments Condominium Association now face civil and criminal charges.
Some unit owners filed a case against their association officials early this month after they found out almost a year later that four of the five board members had waterproofing problems which they, not the association, should have repaired themselves.
The association would pay for such repairs only if they involved structural issues and common areas.
The complainants, led by Dr. Daniel Vazquez, wanted the sprinkler system prioritized since Makati fire officials had warned the association of penalties for noncompliance and for the safety of the residents.
But in a meeting in November 2013, the association instead decided to waterproof and paint the building first despite several objections. The decision was not put to a vote, and the officials ignored subsequent written requests for information, the complaint said.
It was only three months later, or in February 2014, that the association conducted a survey to really find out if there was a waterproofing need.
The survey found that of the 56 units in the building, only 33 had this problem, of which 23 were window-related, meaning it was the unit owners who should pay for the repair, the complaint said.
Regarding the sprinkler system, the association was given by Makati fire officials until October 2015 to comply. The warning was issued in March 2012.
The complaint also asked the court to stop the association officials from making Vazquez and all unit owners pay for their legal defense.
The defendants are Carolyn Butler, Jose Santiago Picornell, Jr., Ma. Lourdes Senn, Violeta Gallego, Fausto Preysler and Mark Nocon, building administrator.

Disgraced former Rep. Trey Radel has managed to keep his nose clean. So authorities have gone ahead and made that whole nasty cocaine business disappear.

Per various Sunshine State news outlets, the Florida Republican has had his record expunged following the completion of a nearly yearlong probationary period stemming from his fall 2013 arrest for possession of a controlled substance.
Radel briefly flirted with the idea of serving out the remainder of his first term, but wound up up throwing in the towel after it became painfully obvious he was persona non grata on Capitol Hill.

A road could be built to take farm traffic away from a Shropshire village if plans to build sheds for up to 180,000 chickens are approved.
The controversial plans for farm land in Lilleshall were thrown out by Telford planners last month.
But now they have been amended and resubmitted and will go back before councillors next week and this time they have been recommended for the go-ahead.
An amended application has been lodged by H Timmis Farms to build four poultry houses and a biomass fuel storage and heating building at Littlehales Manor Farm.
The changes to the original application will see one of the proposed sheds nearly halved in size, while a new access road is proposed to take farm traffic from the centre of the village.
The poultry buildings would house about 45,000 birds each.
Last month, planning officers recommended members of Telford & Wrekin Councils planning committee refuse the application saying scale, mass and design of the proposed building failed to respect and respond positively to the visual amenities of the area.
But now officer Emma Green said the new application had overcome the issues and would have additional benefits for the local community by removing existing farm traffic of Pitchcroft Lane and Littlehales Road.
Church Aston Parish Council had previously voted to object to the plans on the grounds of highway safety but said the alternative route now being proposed was welcomed.
The proposed road was also welcomed by members of Chetwynd Aston and Woodcote Parish Council.

The Village Club Card Room, located in Chula Vista, was one of two establishments raided by the FBI on October 29. In addition to the card rooms, 10News reported that a federal search warrant was executed for a La Jolla residence. According to the report, investigators took away files and computers.
The Village Club Card Room, on 429 Broadway, is the only licensed gambling establishment in Chula Vista; it offers games such as poker and blackjack as well as food and alcohol.
In 2012, the card room acquired two properties on Bay Boulevard in ChulaVista. According to a San Diego Transcript article, the interior contract will go to Chula Vista general contractor Kevin O 'Neill.
Fox 5News reported in August that the Village Club will move from its 5000-square-foot location on Broadway to an 18,000-square-foot space that will have a card room, bar, and full restaurant. The estimated $3.7 million makeover and construction is supposed to begin in 2015.
Village Club owner Harvey Souza is known locally for his generous campaign donations. Chula Vista mayor Cheryl Cox previously worked as a consultant for Souza and the card room. In 1998, she appeared before the city council as Souzas consultant to support his request to expand his facility.
There was considerable opposition to the expansion at the council meeting, including an appearance by Paul Pfingst, who was the San Diego district attorney at the time.
Pfingst argued, One of the capabilities is because there is a large volume of dollars running through the same person, the opportunity for money laundering and other types of things are more present.
He also pointed to undue influences that large scale gambling can have on elected officials.
Cox, on the other hand, argued, Mr. Souza is in this for his business and to perpetuate 53 years of solid ownership of a business that has been good for Chula Vista, and has not levied the kind of pressure upon its political figures that we might fear, should we be looking at institutions with 180-200 tables.
When Cox first ran for mayor in 2006, the Union-Tribune carried a story about donations related to her campaign. The article states that the San Diego Lincoln Club, a pro-business political action group spent $50,872 to help Republican Cheryl Cox in her campaign to unseat Mayor Steve Padilla, a Democrat. The Club received major donations from people with Chula Vista ties....

A tornado safe room was discussed at a special Belmond-Klemme School Board meeting held October 14.
Craig Schwerdtfeger of Struxture Architects spoke first. He explained that the Federal Emergency Management Agency helps fund tornado safe rooms based on school size. He suggested that one safe room could serve both buildings. FEMAwill help pay for a basic building, but not furnishings, brick veneer, ceilings, windows, flooring or landscaping. Those items are up to the local taxpayers to fund. If windows are included in the building, special shutters are added which are closed by the teacher when a storm comes. FEMAwill pay for emergency power in the building, and he suggested a battery system rather than a generator.
Struxture has completed safe rooms in Waverly and Grundy Center, and has started applications for Iowa Falls, Clarion and Dike-New Hartford.
Superintendent Kirk Nelson said his main concern is how much the local share of construction would be, and how the district would pay for its share.
Schwerdtfeger left the room, and Ed Wineinger of Waggoner and Wineinger Architects came in to give his ideas. W&W has completed school safe rooms in Lake Mills, Mason City, and St. Ansgar and community safe rooms in Northwood, Ventura, Clear Lake and Lakeside (near Storm Lake).
Wineinger gave a more complete report to the board, outlining the rules, financing, timeline and process for building a tornado safe room. He also stated that FEMAwill only pay for the bones of a safe room. That includes basic bathrooms, a heating and cooling system, and limited electrical power. Because under new rules, FEMAwill now pay for HVAC systems, he said a battery back-up power system would be inadequate and a generator would be needed.
Wineinger said the board should file a Notice of Interest with Iowa Homeland Security right away. This is a simple form and starts the process.
Then, he said, the board will have to decide what type of structure to build -- a classroom wing, multi-purpose room, athletic facility, etc. If classrooms, how many and what size? Once that is decided, the architect can start on a design. He handed out a drawing of a project currently being planned for the school in Alta.
Wineinger was asked about building one large safe room for both schools. You cant really do that, he said. FEMAdoesnt want kids running across the parking lot in the middle of a storm. You will have to decide if you want your safe room at the high school or the elementary school, and then size it for that.
He was then asked about building two smaller rooms. That might be a possibility. I will talk to Homeland Security in Des Moines about it, he replied.

Earls Kitchen and Bar restaurant on the 16th Street Mall reopened last week after being closed since June for renovation, and lunch hours are bustling with power-lunchers in business suits. The new space is light and airy, with soaring ceilings, because Earls a Canadian chain with 65 locations wanted to update its image.
It was like a good ol boys club but now its just for everyone who wants a great meal, with salads and burgers, said Dana Pluss Parks, who represents the restaurant. They wanted it to be more like the Cherry Creek Grill or Hillstone, as opposed to a sports bar.
They also want it to fit the image nationally, with architecture as modern as at the new Earls that recently opened in Boston and Miami.
In Denver, the new downstairs is open, the second floor a place for private parties, and the meeting place for celebrities during the Democratic National Convention in 2008 will open on Nov. 21. Partitions have been removed to showcase the shape of the room. The glass-enclosed conservatory and back bars that blocked the natural daylight and divided up the space are gone, and windows have been exposed. The color palate replaced with lighter, more natural materials.
Architecture isnt the only aspect thats been renovated. To keep up with Denvers thriving cocktail scene, Earls brought in its top mixologist from Vancouver who focused on craft cocktails. The Cabin Fever with Crown Royal whiskey, port, ginger, fresh lemon and spiced bitters looks like its straight from the mountain of Colorado, served in a blue-tin camping mug with a pine cone on top.
Another craft cocktail, the Bees Knees, is served in a glass jar shaped like a honey bear along with a honey stick.
Art also plays a role, with pieces by local Colorado artists Robin Ault, Ian McLaughlin and Jon Rietfors featured, as well as a copper, brass and steel installation called Layers by Vancouver, B.C.-based artist Ricky Alverez.
Metro Denver had three Earls restaurants on the 16th Street Mall, in the Park Meadows shopping mall, and in Cherry Creek but the company closed the Cherry Creek location to fully focus on updating the 16th Street Mall location.

Two Toledo-area shopping centers that are expanding have announced new tenants.
The new Shoppes at Westgate Village said a fast-casual restaurant, Macs n Melts, is leasing 1,400 square feet in a retail strip under construction on the north side of Central Avenue west of Secor Road.
Westgate Village said in July that Piada Italian Street Food and Wingstop will occupy 2,400 and 1,500 square feet, respectively, in the 8,000-square foot retail strip.
Meanwhile, at the Shops at Franklin Place on Monroe Street in Sylvania Township, fast-casual restaurant Tropical Smoothie Cafe expects to open next week. The Shops at Franklin Place last week saw the opening of two retailers, HomeGoods and Marshalls.
The new restaurant will be on the opposite side of the center from HomeGoods and Marshalls.
Tom Walsh, director of leasing for Abbell Associates in Chicago, which owns Westgate, said Macs n Melts will specialize in gourmet grilled cheese sandwiches and macaroni.
Gourmet grilled cheese sandwiches are a hot concept in the restaurant business with restaurants adding them to their menus and at least six grilled cheese restaurant chains expanding across the country. Earlier this year a grilled cheese and tomato soup chain, Tom and Chee, opened in Maumee. Paddy Jacks, which has locations in Sylvania Township and Toledo, is also known for its grilled cheese sandwiches.
Mr. Walsh said Macs n Melts will use artisan breads and specialty cheeses for its menu items. Its adult fare as well as kids fare. Its a nice contemporary design and it should do well, he said.
