    Newly unsealed legal file indicates Samsung paid Microsoft $1B in 2013 alone to license patents Android allegedly infringed.

    So we knew Microsoft's Android-patent-licensing business was big. But it's even bigger than many had estimated.

    Thanks to a filing unsealed on October 3 in the Microsoft v. Samsung U.S. District Court patent-royalty case filed in early August 2014, we now know that Samsung paid Microsoft $1 billion in 2013 for a single year's worth of patent-licensing royalties.

    Samsung agreed in 2011 to pay Microsoft a then-undisclosed amount for licensing patents upon which Android allegedly infringed. That agreement was structured as a cross-licensing and business-collaboration agreement.

    According to the unsealed filing, Microsoft is contending that "under the License Agreement, Samsung agreed to make patent royalty payment to Microsoft for a period of seven fiscal years, in exchange for the right to use patented Microsoft technology in Samsung smartphones and tablets that use the Android operating system."

    The filing says Samsung failed to make its year-two royalty payment on time and to pay interest for not doing so. Samsung, for its part, claimed it shouldn't have to make good on the contract because Microsoft bought Nokia's devices and services business.

    Microsoft said Samsung owed interest in excess of $6.9 million for its late Android-patent fee, which it still hadn't paid as of the date of the filing. That amount is calculated on the $1 billion Samsung owed Microsoft in Android patent-licensing royalties as of August 29, 2013, according to the unsealed documents.

    On September 3, 2013, Microsoft publicly announced its plans to acquire Nokia's devices and services business. A Microsoft spokesperson said Samsung is claiming the Nokia acquisition would breach the business collaboration part of the patent license agreement. But according to the unsealed court documents, Samsung did pay Microsoft its agreed-on $1 billion second-year patent royalty amount on November 29, 2013, but still hasn't paid the third-year amount that was invoiced in June 2014 but still isn't yet due.

    Samsung is claiming it shouldn't have to pay Microsoft the agreed-on patent-licensing fees for anything beyond the post-Nokia acquisition period -- even though it did pay the second-year amount late. Samsung claims the deal it signed with Microsoft should be redone so the amount it owes is reduced or eliminated because the patents covered were granted almost entirely by countries other than Korea and used in products sold to consumers in countries other than Korea.

    Penticton girl sheds locks to help kids - October 5, 2014 by Mr HomeBuilder

    Hannah Bloomfield looks over some of her hair she is donating to the Wigs for Kids program at B.C. Children's Hospital.

    While some kids were catching up on sleep or heading out on vacation for spring break, Hannah Bloomfield did something a little different.

    The Grade 6 student at KVR Middle School got her hair cut. While it may not seem that unusual, what she did after was.

    I thought it would be a really good idea to donate it to kids that have cancer, said Bloomfield.

    After lopping off about 12 inches of hair, she did exactly that. In fact, it isnt the first time she chose to donate her hair to be made into wigs for kids with cancer. In 2009, she cut off about 15 inches of her hair and donated it to Angel Hair for Kids.

    This time around she researched with her mom and found the Wigs for Kids program affiliated with the B.C. Childrens Hospital oncology department.

    Wigs for Kids B.C. was created to raise funds for children requiring hairpieces to replace their own hair lost during treatment for cancer and other serious childhood illnesses. The program accepts both monetary donations and those of hair.

    For her earlier donation Bloomfield was recognized with a laminated certificate, and she expects something similar for her most recent offering of hair.

    The girls parents, Liisa and Jason Bloomfield, said they are very proud of their daughter who approached them first with the idea.

    The Texas hospital that admits it mistakenly sent home a man with Ebola has a spotty emergency room record, with waits well above the national and state averages, according to federal data. In addition, Texas Health Presbyterian Hospital has been penalized by the federal government three years in a row for having too many patients who had to be readmitted within 30 days of discharge, although its record in that area is improving.

    The 658-bed hospital is under intensifying scrutiny because it sent home Thomas Eric Duncan, a Liberian man who showed up in the emergency room with a fever only to be misdiagnosed and released. Two days later, Duncan returned to the hospital, where he tested positive for Ebola. In the interim, he was contagious and dozens of people may have had contact with him.

    The hospital blamed a software error since corrected for failing to transmit a nurse's notation that Duncan was from a virus zone to the doctors who made the decision to discharge him. But data from the Centers for Medicare and Medicaid Services show the hospital did not have a sterling record before the Ebola mistake.

    In seven categories of emergency room care, Texas Health in Dallas did significantly worse than other hospitals. For instance, the average time patients spent in the ER before being admitted was 352 minutes, compared to 274 minutes around the nation and the state. Similarly, patients who are told they will be admitted spend an average of 170 minutes in the ER waiting for a room, compared to 99 minutes elsewhere. Patients also wait an average of 52 minutes to see a health care professional, double the state and national average.

    Texas Health Resources, the parent company of Texas Health Presbyterian Hospital, said the findings had nothing to do with Duncan's situation and did not represent a staffing problem in the ER. "It's a very busy place," spokesman Wendell Watson told the Dallas Morning News, which first reported the data.

    Like many other hospitals, Texas Health has also had to forfeit some funding for the last three years because of patients who were discharged and then had to return. Federal data shows that the penalty rate decreased from .48 percent to .10 percent over the last three years, however, and the hospital was in the middle of the pack for Texas hospitals for the most recent fiscal year.

    YAKIMA, Wash. An unattended pan of cooking oil started a fire that Yakima fire officials say caused $30,000 damage to a home on East Chestnut Avenue on Friday evening.

    Firefighters were called at 6:40 p.m. to 902 E. Chestnut Ave. The homes occupant told firefighters that she had put a pan of oil on the stove and left it while tending to her children, said Joe Riel, acting shift commander. When she returned, the oil had caught fire and the flames started to spread.

    When firefighters arrived, smoke was coming out the front door, and there was fire in the kitchen. The firefighters put out the flames in the kitchen and pulled down the ceiling to put out hot spots in the attic insulation, Riel said.

    Nobody was injured in the fire. Three fire trucks and an ambulance responded.

    Yakima County tax records show the one-story house was built in 1920. The house has an assessed value of $57,300.

    Connecticut's First Chick-fil-A To Open In Brookfield - October 5, 2014 by Mr HomeBuilder

    Chick-fil-A will open in Brookfield next week, marking the first location of the Atlanta-based chicken restaurant chain in the Nutmeg State.

    The restaurant at 156 Federal Road opens to the public Oct. 9 at 6:30 a.m., but welcomes fans to get in early for the chance to earn a one-year's supply of free Chick-fil-A food (adigital offer card loaded with 52 free meals.)The first 100 adults (18 and over) in line will be eligible for this offer; the line will officially open at 6 a.m. on Wednesday, Oct. 8 and guests will be registered. Guests are then required to stay in line on site until the Thursday morning opening.

    The "First 100" promotion is only open to guests who live within roughly a 25-mile radius of the Brookfield restaurant. Eligible residency zip codes, and other rules and regulations, are posted on Chick-fil-A's website.Chick-fil-A will provide security, entertainment, games, food and bathrooms during the 24-hour period, according to a news release, and guests are encouraged to bring tents, chairs, TVs, computers and other gear.

    Three other Chick-fil-A franchises are planned for the state. A location at 1098 N. Colony Road in Wallingford is scheduled to open Nov. 6, according to its official website. Chick-fil-A will also join the food court at the Danbury Fair Mall, and that's also projected for a Nov. 6 opening, said Melissa Eigen, the mall's marketing manager.

    In Enfield, the town's planning and zoning commission confirmed that a planned Chick-fil-A restaurant is currently under construction at 25 Hazard Avenue, in the Enfield Commons shopping plaza. No official opening date is projected as of this time, said department secretary Barbra Galovich, but a Chick-fil-A representative said the Enfield restaurant is expected to open within the first quarter of 2015.

    Founded by Southern Baptist Truett Cathy, the privately-held company closes all of its locations on Sundays. "This policy allows employees a day for family, worship, fellowship or rest, and also underscores Cathy's desire to put principles and people ahead of profit," according to the restaurant's official website.

    Chick-fil-A's religious beliefs have been the focus of controversy in recent years; in 2012, president and CEO Dan Cathy said publicly that the company "was supportive of the family - the biblical definition of the family unit." The restaurant chain was also criticized for its foundation's donations to anti-gay marriage groups. In response to the outcry, the company stated, "Going forward, our intent is to leave the policy debate over same-sex marriage to the government and political arena."

    Officials in Brookfield say they haven't encountered any opposition to Chick-fil-A's presence in town. "I think most people are excited about it," said assistant zoning enforcement officer Francis Lollie.

    First Selectman William N. Tinsley said he's happy to welcome home Chick-fil-A franchisee Devon Scanlon, who is a native of Brookfield. He said Federal Road's "highly commercialized" nature, as a regional shopping destination, bodes well for the restaurant's success. "They have done a very beautiful job with the property here," he said.
