"Extreme wartime powers" that allow the demolition of Christ Church Cathedral and other heritage buildings without public consultation need to be revoked, Labour says.
Section 38 of the Canterbury Earthquake Recovery Act allows building owners to ask the Government for a demolition order without public consultation.
The provision was meant to protect the public from earthquake-damaged buildings but was no longer needed and could be open to abuse, Labour's arts, culture and heritage spokeswoman Jacinda Ardern said.
"The fact that this power remains now is an abuse of power. It's fair and right that these powers be removed."
Removing Section 38 would make demolition of Christ Church Cathedral subject to public debate under the Resource Management Act and could have saved buildings like the Majestic Theatre, Ardern said.
"Basically we're saying that extraordinary power should not be arbitrarily used on something as iconic as the cathedral. It's time for that power to go."
There was originally a need for swift action on unsafe buildings under Section 38 powers, "but we are three years on now" and it was doubtful that buildings like the Majestic had to be removed under the law.
"Some would argue that it was removed for a transport plan, not for public safety, necessarily. We want to put an end to that kind of action."
Earthquake Recovery Minister Gerry Brownlee said the Government was not anti-heritage.
"But in managing the recovery we're very mindful of ensuring people aren't injured or killed in dangerous buildings. Cera [Canterbury Earthquake Recovery Authority] has done everything practical to see buildings retained but this was a big event and sadly many buildings could not be saved."

FLINT (WJRT) - (07/02/14) - Demolition crews began to tear down the former Clark School, in Flint, Wednesday morning.
It will be two days before it's all complete.
The building couldn't come down soon enough for those working to clean up this city, but for some, the old Flint school is a piece of their past and a place that still holds memories.
"It was a great school...good times...a lot of friends," said Lloyd Thomas, of Flint.
Recalling memories, decades old, pulled from the back of his mind. Thomas still knows the school like the back of his hand. He attended kindergarten here in 1954.
"Hard to see it go," he said.
But even he knows it was time. State funding to clean up blight in Genesee County made the demolition of this building and around 20 other commercial properties possible.
"It needs to come down, it will be safer for the neighborhood," said Deb Cherry, Genesee County Treasurer.
The old Flint school has sat vacant for five years, harboring crime, while the walls literally cave in.
The school will cost more than $400,000 to tear down over two days, making way for green space and future development. It's just a small chunk of the Michigan Blight Elimination Grant funds that the land bank is putting to good use this year.

Demolition will begin soon at the Starlite Plaza shopping center in Sylvania, making room for a new ProMedica Health and Wellness Center.
The Lathrop Co. has been chosen as the construction manager for the project at 5700 Monroe Street.
A groundbreaking ceremony is scheduled for July 16.
The ProMedica facility will be on the site of the former Churchills supermarket, which was built in 1971. It later became a Farmer Jack, and then a Bassetts Market. It has been vacant since 2007.
Two buildings on the east side of Starlite, a restaurant occupied by Ralphies Sports and Drink Eatery, and a retail building occupied by Daves Performance Footgear and the Buckeye Store and More, will remain. An older retail building that abuts Daves will be demolished.
Also scheduled to be demolished are a 60,000-square-foot strip center on the west side of Starlite Plaza and a 37,000-square-foot strip center behind the former grocery store.
One of the few tenants left in the parts of the complex that is scheduled to be demolished is Sewing and Vacuum Express. The company previously said it had a two-year lease and had no plans to leave.
On Wednesday, Linda Schweer, one of the owners, said they were studying their options. She said they were putting some numbers together to present to ProMedica.

The collapse of the upper storey on the demolition site of the former Vanguard school caused quite the commotion last week.
Demolition of the former Vanguard High School resumed Wednesday after the Canada Day holiday under the supervision of a workplace safety board (CSST) engineer following last weeks premature collapse of the upper storey of the Metcalfe Avenue building.
Both Metcalfe and Hillside avenues will be closed to traffic as on-site crew now demolishes the south side of the building.
According to Westmounts departing director general Duncan Campbell, the site is secure after a beam on the building's top floor gave in on June 25.
After closing the street off to circulation to prevent any further damage, it was deemed safe to resume the demolition. According to Campbell, the CSST and the fire department said there was no risk in letting the workers come back on site after analyzing the scene.
The CSST inspector was on-site just before the upper floor caved in. The inspector, said Marie-France Vermette of the CSST, had stopped demolition crews just before the collapse from working without the proper engineer-issued certificate. According to Vermette, the demolition of the top floor wasnt being executed in accordance to the regular "roof to ground" method and therefore a certificate was needed.
Real estate developer Btimo, in partnership with the Fond de Solidarit (FTQ), began transforming the former high school into a six-storey building, which will house 53 condos, lofts and townhouses to match the underground park spaces, two weeks ago.
Dust a concern?
Though a cloud of dust hovered over the work site following the collapse, Campbell assured the air was void of chemicals.

Dunedin's Princes St could be in line for a facelift after a Christchurch developer won a six-year battle to demolish a group of buildings inside a protected townscape.
Luke Dirkzwager, of Prista Apartments, has been granted Environment Court approval to demolish the buildings at 372-392 Princes St and 11 Stafford St, making way for a mixed-use retail and apartment development.
However, three of the buildings' four facades have been spared the wrecking ball, and would instead form a section of the new development, as part of a compromise with heritage advocates.
That would mean the retention of the facades at 380, 386 and 392 Princes St, while the buildings behind them - dating back to between the 1860s and 1913 - would be demolished.
The largest building, at 372-378 Princes St, would be removed with its facade, despite dating back to 1879.
Details of the deal were contained in an Environment Court consent order agreed to by all parties, made public yesterday. It ends a long-running battle over the development dating back to 2008.
Mr Dirkzwager is overseas and could not be reached yesterday for comment about a start date, but the revised consent approved by the court gave him until 2021 to advance the project.
Heritage advocate Peter Entwisle, who was involved in negotiations over the project, said he had been told the development was unlikely to proceed for at least five years.
Mr Dirkzwager was now said to be busy with other projects in Christchurch, and had sought an extended consent deadline, Mr Entwisle said.
While welcoming the decision to spare three of the facades, Mr Entwisle was disappointed some of the city's original Gold Rush-era buildings would be lost.

LAKEWOOD, Ohio Excavators Wednesday morning began knocking down the walls of the former McKinley Elementary School on West Clifton Boulevard at Detroit Avenue.
However, the demolition came to a sudden halt after several minutes when a hydraulic line ruptured on the larger of two excavators used for the work. A replacement part was ordered, and demolition will resume tomorrow morning, said Dave Marko, owner of Marko Demolition and Crushing LLC, of Genoa.
A handful of nearby residents watched as the excavators started punching holes in the brick walls and clouds of dust arose.
"My sister went to school here when she was growing up," said Michelle Bird, a Lakewood resident who watching from outside a fence keeping the public away from the demolition area. "It's a part of history."
A young mother, Sasha Douglas, stopped by with her son, Pierce, and daughter, Boston, in a tandem stroller.
The family lives in an apartment where the children caught a glimpse of the demolition work and wanted to come for a closer look, she said.
"They're at an age where they love watching this kind of equipment," she said.
For the past three weeks, crews have been removing asbestos and cleaning out the interior of the building. Windows, boilers, metal, and other recyclable materials were removed prior to the exterior demolition. The brick also will be recycled.
McKinley Elementary was decommissioned as a school building in 2008. The city bought the former school in 2013 for $100 with plans to demolish the building and sell the land to a developer for a residential development.
The city and school district will split the demolition costs and the schools will receive any profit from the sale of the property to a developer after the city recoups its expenses.
