    Almost a year after the death of a Costa Mesa handyman, the trial of the man accused of killing him is still on hold because of questions about the defendant's mental health.

    Christopher Leovy, 34, has been behind bars since Sept. 11, when Costa Mesa police arrested him in connection with the fatal bludgeoning of 54-year-old John Kubat after the two got in an argument at a vacant building where Kubat was working.

    Prosecutors charged Leovy with murder and a felony count of battery on a police officer stemming from his arrest.

    Defense attorney Joel Tamraz says Leovy's erratic behavior and paranoia have kept him from telling his side of the story.

    Since December, court-appointed psychologists have tried repeatedly to talk with Leovy to assess whether he's competent enough to aid in his defense. But Leovy has refused to meet with them, according to Tamraz.

    Orange County Superior Court Commissioner Vickie Hix told Leovy on Tuesday that the psychologists just want to evaluate him. But Leovy interrupted.

    "They're trying to prescribe me medication," he said.

    Tamraz said Leovy is convinced that someone is trying to kill him.

    "He's got a lot of worries," Tamraz said.

    A devotion to customer service and the melding of old-fashioned features with cutting-edge technology recently earned Nutter Hardware a very hip designation.

    Of the 4,850 locally owned and operated Ace Hardware stores throughout the world, Nutter Hardware in the Kingsdale Center in Upper Arlington is among the "coolest."

    So says the Ace Hardware Corp., which doesn't rank the top six but recently included the local store in its loftiest of lists.

    "The store's ambience takes customers back to a simpler time, with its old-school style reminiscent of a classic general store, with its functioning potbelly stove and old-fashioned ceiling fans," a recent Ace Hardware press release stated. "Part of that traditional piece of Americana is created through the simple things the shop offers, such as vintage soft drinks, free popcorn and, of course, amazing customer service.

    "If you come into Nutter Hardware with a project a little too big to handle, you may end up leaving with a lot more help than you expected, thanks to the experience Chuck Nutter brings to his Ace store from his other business, Nutter Handyman Services."

    Owner Chuck Nutter and Nutter Hardware, 3078 Kingsdale Center, celebrated four years in the business Aug. 24.

    In addition to the "coolest" distinction, which Nutter said "just blew me away," the venture has fulfilled a nearly lifelong quest.

    After 23 years in corporate America as a chemical engineer, Nutter started Nutter Handyman Services and quickly decided there was a hardware store void in Upper Arlington, where he has lived since 2003.

    He also never lost track of boyhood memories of local hardware store employees who at times gave his father the know-how to perform do-it-yourself projects of all kinds when his dad was a farmer in northeast Ohio.

    3rd defendant convicted of murdering Harvey handyman - August 23, 2014 by Mr HomeBuilder

    A Port Allen man was convicted Friday for his role in the death of a Harveyhandyman who was beaten and shot by intrudersseeking $12,000 in his house. Terrol "Nasty" Cole, 33, faces spending the rest of his life in prison for second-degree murder.

    A Jefferson Parish jury of seven women and five men deliberated about three hours to find Cole participated in the home invasion and armed robbery that led to the death of Donald Bates. Judge Michael Mentz of the 24th Judicial District Court will sentence Cole on Sept. 4.

    Bates, 53, was killed on the morning of Jan. 29, 2010, inside his Eastmere Drive home in the Woodmere subdivision. He was beaten with a baseball bat and shot five times. His wife returned home from her job hours later and found the front door was ajar and blood on the floor and walls. Deputies found Bates' body on the floor of a bathroom.

    Sheriff's Office detectives solved the case by tracking mobile phone records and using information derived from phone towers to pinpoint the suspects' locations. Bates' phone records showed Rhonda Skinnerwas the last person to whom he spoke, detective Solomon Burke testified.

    Arrested in a West Bank motel with her boyfriend, Skinner eventually admitted she knew about Bates' cash and that she enlisted Cole and Darnell Turnerto get it, Burke testified. Two other witnesses, Katrice Baptist and Tanisha Stamps, testified that they dropped Cole and Turner off on Post Drive, down Eastmere from Bates' home.

    Later that morning, Baptist testified, Cole and Turner called her to pick them up from a house on Marine Street in Marrero. That was just blocks from where deputies found Bates' partially burned work van the day after the homicide. The van had been stolen during the home invasion, authorities said.

    Cole, Turner, Stamps and Baptist were arrested a week later at a hotel in Little Rock, Ark., prosecutors Clif Milner and Michael Morales said. Stamps testified that Cole admitted to her, as they showered together, that Bates resisted the robbery and so was killed.

    Skinner pleaded guilty in 2012 and agreed to testify against Turner and Cole in exchange for averting a murder charge. She lived up to that agreement Wednesday, when she testified that Cole admitted to her that they killed Bates.

    When he was arrested in Arkansas, Cole told detectives he was in Baton Rouge at the time that Bates was killed. His phone records showed otherwise, Morales said. "The cell phone records prove conclusively he was not in Baton Rouge the day of the murder," the prosecutor argued Friday.

    Cole's attorneys, Bobby Hjortsberg and Jason Williams, argued that Skinner was a liar who blamed the crime on their client and Turner to protect her boyfriend, Kenneth Devore. Williams described Devore as "the real culprit."

    When Carolyn Bates returned to her home in Harvey's Woodmere subdivision, on a rainy Friday afternoonmore than four years ago, she found her front door ajar. Fearful, she remained outside and called a friend.

    "We looked through the glass door, and we saw specks of blood on the tile floor," Bates told a Jefferson Parish jury Tuesday. Her friend called 911.

    In a rear room of the three-bedroom house at 2217 Eastmere Drive, sheriff's deputies found the body of her husband, Donald Bates. The 53-year-old handyman had been beaten in the head with a baseball bat and shot four times. His work van, missing, was found burned the next day in Marrero.

    The third of three suspects charged in Bates' death on Jan. 29, 2010, death, Terrol Cole, 33, of Port Allen, is standing trial this week on a charge of second-degree murder. If convicted as charged, he would spend the rest of his life in prison.

    Cole is accused of forcing his way into the home with Darnell Turner, planning to get $12,000 in cash.The trial, unfolding in 24th Judicial District Judge Michael Mentz's court, is expected to last several days.

    Although he was arrested with Turner in Arkansas a week after the homicide, Cole denies involvement in the crime. "That was a bad choice," his attorney, Robert Hjoresberg, told the jury. "It doesn't mean he's guilty of murder."

    Turner, 31, of Harvey, was convicted last year of second-degree murder and sentenced to life in prison.The third person arrested in the Bates murder, Rhonda Skinner, 42, who lived in the Westwego area, cut a deal with prosecutors in 2012, pleaded guilty to conspiracy to commit armed robbery and obstruction of justice agreed to testify against Cole and Turner.

    Skinner, who was acquainted with Donald Bates, admitted during Turner's trial that she alerted Cole and Turner to the $12,000 inside the home and said she was supposed to get a $2,000 cut. Authorities say she set up the robbery.

    Shepleaded guilty more than two years ago, but her sentencing has been delayed until after Cole's trial. She's expected to testify this week. She faces as long as 30 years in prison.

    Assistant District Attorney Clif Milner, prosecuting with Michael Morales, told the jury Tuesday that two women drove Turner and Cole to the Bates home. Later that day, Cole told one of those women that they killed Bates.
