INDIANAPOLIS Indiana Attorney General Greg Zoeller has filed a lawsuit against Jerome Edmond and USA Promotions for making illegal pre-recorded calls and for impersonating an ADT home security systems representative.
This marketing followed several high-profile home invasions that raised public safety concerns.
The Attorney Generals Office received nearly 160 complaints alleging that someone made automated telemarketing calls, sometimes called robo-calls advertising ADT security systems.
The complaints were received from 13 counties from Central and Northern Indiana, with the most from Marion, Hamilton and Hendricks.
Reportedly, the pre-recorded message stated, in part:
This is a public safety call. Due to the rise in residential burglaries in your community ADT will be giving you a free ADT Home Security Alarm System with free installation and activation which means you pay absolutely nothing out of pocket for this security system. This promotion expires in your community this week so its important you return our phone call right away. You can reach us toll-free at ----.
ADT confirmed that no one affiliated with ADT placed the calls.
This is scamming at its worst, Attorney General Greg Zoeller said. Taking advantage of public fear with unsolicited and illegal robo-calls requires aggressive enforcement actions. It is encouraging that people who received these calls recognized they shouldnt be receiving them and asked the Consumer Protection Division to help protect them from further calls or additional victimization.
The lawsuit seeks fines and penalties and a permanent injunction against Edmond, an Illinois resident, and his unregistered company U.S.A. Promotions, for calls violating Indianas Telephone Privacy law and the states Auto-Dialer law, and for falsely representing that he was an affiliate of ADT. The lawsuit also seeks recovery of the Attorney Generals costs of investigation and prosecution.
In June, the Attorney Generals Office also filed suit against Power Home Technologies, Inc., a North Carolina home security seller. That case is still pending.

Idaho Attorney General Lawrence Wasden has reached a settlement with a Utah home security company accused of violating Idaho's Consumer Protection Act.
The settlement requires the company, Vision Security, LLC, to implement changes to the way its sales representatives interact with Idaho consumers.
Consumers who paid early termination or "buy-out" fees to their prior alarm monitoring companies may be eligible to receive restitution.
Todd Dvorak, spokesman for the Office of Idaho Attorney General, said Kootenai County was a "hotspot" for the company doing business in Idaho.
"From the records we have, it appears the company sold contracts to more than 50 consumers in Coeur d'Alene, Post Falls, Hayden and Rathdrum," Dvorak wrote in an email to The Press.
Dvorak wrote that the AG's Office received multiple complaints from Kootenai County residents about Vision Security of Orem, Utah.
An elderly Coeur d'Alene woman, who wished to remain anonymous out of fear of retaliation, said that she and her husband were targeted by Vision Security.
A company rep came to their home and stated that they need to "update" their current system. The couple later learned the upgrade was through Vision, not their previous provider.
"The security we had was fine, but we were told that we needed to update it," she said, adding that the couple gave their bank account number to the rep. "Our antennas have sure gone up over this. It scared the bejeebers out of us."
Vision Security, in response to the settlement, issued a written statement to The Press. The statement was sent via email from Sean Brown, the company's general legal counsel.

IDG News Service - Researchers are gearing up to hack an array of different home routers during a contest next month at the Defcon 22 security conference in Las Vegas.
The contest is called SOHOpelessly Broken -- a nod to the small office/home office space targeted by the products -- and follows a growing number of large scale attacks this year against routers and other home embedded systems.
The competition is organized by security consultancy firm Independent Security Evaluators and advocacy group the Electronic Frontier Foundation (EFF), and will have two separate challenges.
The first challenge, known as Track 0, will require researchers to demonstrate exploits for previously unknown, or zero-day, vulnerabilities in a number of popular off-the-shelf consumer wireless routers.
The preselected target devices are: Linksys EA6500, ASUS RT-AC66U, TRENDnet TEW-812DRU, Netgear Centria WNDR4700, Netgear WNR3500U/WNR3500L, TP-Link TL-WR1043ND, D-Link DIR-865L and Belkin N900 DB. The EFF's upcoming Open Wireless Router firmware will also be up for hacking.
Different types of attacks will earn the researchers a different number of points. For example, exploits that result in full router control will be awarded 5,000 points, while those that only cause a denial-of-service condition or low-value information leakage will get 1,000 points. There are also penalties for attacks that require human interaction, authenticated sessions or administrative credentials.
Researchers will prepare their exploits ahead of time and are required to report the vulnerabilities they find to the affected manufacturers ahead of the actual contest. This won't influence their chance of success during the competition because the attacked routers will run specific versions of firmware that have already been announced and won't be updated.
