Oakland renter Angelica Rivas says that when she turns on the kitchen faucet, cockroaches spill out. And the water pressure is so low in her shower, she says, she often has to bring buckets of water from the kitchen just to bathe.

Rivas has lived in her apartment with her four children for nearly 15 years. She and her neighbors went on a rent strike last March to demand that the landlord make repairs.

Then the pandemic forced a Bay Area-wide shutdown, and Rivas, who worked as a housekeeper, and many of her neighbors at 1821 28th Ave. lost their jobs. The rent strike turned into an inability to pay.

In theory, Rivas and her neighbors shouldnt worry about losing their homes. In one of the strongest eviction moratoriums in the state, Oakland prohibits evictions for nonpayment of rent at most residential units.

Nevertheless, Rivas landlord has issued multiple eviction notices to tenants since March.

Housing experts and tenant advocates say Rivas situation isnt uncommon in the Bay Area because of confusion around a separate eviction moratorium issued by the state.

The statewide moratorium lets landlords send 15-day eviction notices as long as they include a form for tenants to fill out if they are unable to pay rent due to the pandemic.

Tenant advocates say Oaklands policy and other local moratoriums supersede the statewide law.

While we think its clear that Oaklands eviction moratorium and Alameda Countys eviction moratorium takes precedence. ... It appears that there are some landlords that have a different opinion, said Jackie Zaneri, a staff attorney at the Alliance of Californians for Community Empowerment who represents Rivas and other tenants in her building.

Housing experts say it can be confusing for landlords and tenants to know which moratorium to follow. Rivas landlord, Michael You, has included the form with his eviction notices.

Admittedly, it is a tricky time to be involved in managing property, You said. I do need the cooperation of the tenants to ensure access as well, and to help reduce the risk of infestation by good housekeeping standards. It is also troubling that I have not received rent from all the tenants for 10 months.

You said his tenants didnt complain about the condition of the apartments before the pandemic. The tenants and their lawyer said they did.

The situation underscores the complexities of enforcing local eviction moratoriums against a statewide policy with different rules. The result is confusion between landlords and tenants about what policies prevail. Meanwhile, both sides struggle with economic instability in an unrelenting pandemic that threatens to exacerbate the states homeless crisis. Many tenants, often terrified of an eviction on their record, give up and leave once they receive a notice, advocates say.

Most tenants are not able to consult with an attorney, and most tenants dont know their rights, said Alex Werth, a policy associate at East Bay Housing Organizations. These laws are extremely complicated. The eviction process is extremely complicated. For a lot of tenants, especially the most vulnerable ones, they will receive an eviction notice and either assume they must leave right away or will leave out of fear.

In late January, Gov. Gavin Newsom extended the statewide eviction moratorium to allow tenants facing financial hardship because of the pandemic to stay in their homes until June 30, when property owners will again be able to evict tenants who dont pay their rent.

Under the state law, tenants who receive a 15-day eviction notice for nonpayment of rent can file a declaration that they are unable to pay due to income losses as a result of the pandemic.

Meghan Gordon, the director of the housing unit at the East Bay Community Law Center, said when the pandemic started, landlords didnt know what was going on and an initial surge of eviction notices went out. But that surge died down as landlords learned of Oaklands protective order.

In March, the Oakland City Council passed a moratorium that bans eviction of most tenants in residential units built before 1996 for nonpayment of rent due to financial difficulties during the pandemic. It also prevents landlords from charging late fees for back rent, and limits certain rent increases.

Eviction notices are precursors to any eviction lawsuit. Under the citys policy, the moratorium provides an absolute defense against eviction if the notice was served during the local emergency, according to the city attorneys office.

The moratorium will be lifted only once the City Council votes to end the state of emergency.

Rivas neighbor, Felix Martinez, said the stove in his unit hasnt worked for nearly two years. He said his wife is constantly scraping mold off the walls.

Evelyn Rivas, another tenant, said she was shocked when she received the first eviction notice in April.

What if I lose my house? she asked in Spanish. What if Im out on the street?

Rent for several apartments in the building is nearly $1,500 a month.

In response to every eviction notice, Zaneri said she responded with a declaration from the tenants that they were unable to pay rent due to loss of income during the pandemic.

On Dec. 31, Zaneri sent a letter to the landlord demanding an end to the notices and that he immediately address repairs (including eliminate rodents and pests), replace missing or expired fire extinguishers and smoke detectors, fix broken door locks and stop up sewage leaks.

Zaneri said the landlord has not responded to the demand letter. She said she has spoken to the landlords attorney, who provided no timeline on repairs.

You, the landlord, told The Chronicle that he has commenced work to remediate the concerns raised by the tenants. The complexity of complying with COVID-19 pandemic restrictions while effectuating repairs to a property has elongated the process.

You said he expects the renovations and remediation of the property to be completed shortly. He did not respond to questions about why he was sending eviction notices despite the citys moratorium.

It is outrageous that a landlord who has totally neglected their duty to provide a safe and habitable apartment for tenants by failing to make major repairs for years would then give their tenants an eviction notice for failure to pay rent during the pandemic, Zaneri said.

STERLING HEIGHTS (WXYZ) "In the 25 years I've lived here, I have never been late on my rent. I've always paid my rent. I have never given them a problem," Sharon Williams said about why she can't understand how management at Cambridge House Apartments in Sterling Heights hasn't resolved a problem that, at first, appeared to be growing on the walls and ceiling of her unit.

"I thought it was mold," Williams told 7 Action News about when she first noticed the mysterious black marks developing on her ceiling and walls over a year ago.

According to Williams, management at the property, located on 16 1/2 Mile Road near Van Dyke, became so dismissive of her concerns, that she consulted attorneys and county health officials.

Property management did send a mold and remediation specialist to inspect the black marks and he determined it was actually soot.

Williams said the mold specialist indicated that there were elevated mold spores in her carpeting, but he could not determine the source of the soot.

The specialist recommended that management have the insulation in the attic checked because "the soot issues could be related to inadequate or improper insulation," he wrote in a letter.

Williams said management has yet to identify the source of the mysterious soot.

She's never smoked and the building was a non-smoking building when she moved in 25 years ago. Smokers are now allowed to occupy units in the same building.

Williams said management has tried to blame the problem on everything from candles, which she says she doesn't burn because they're for decoration only, to her being unwilling to let them come in and do work, something she adamantly denies.

"I don't understand why they would treat someone like this and how dare they try to blame it on me," Williams told 7 Action News. "When I turn on my heat, my nose and eyes burn."

And with COVID and a tight budget, Williams said moving is easier said than done.

"I don't think this is fair," she said. "I've been fighting this battle for over a year."

Action News has been in contact with Aaron Rosenhaus who said he's an owner of the property and that he's committed to working with Ms. Williams to get contractors in so they can figure out what the problem is and remedy the situation.

PHILADELPHIA Bill Cobb uses medical marijuana to treat PTSD and chronic back pain.

Im a 50-year-old Black man whos been a civil rights worker, said Cobb, now a criminal-justice activist in Philadelphia. I smoke to have my brain slow down. But to be honest, I also smoke because I enjoy it.

Alleviating his physical and mental pain is difficult when he feels another sting: His doctor-recommended medicine is not covered by insurance. He pays out of pocket as much as $120 a week.

Its way too expensive, Cobb said. Its ridiculous.

Other marijuana users in Pennsylvania agree.

Surveys show that the Keystone State has some of the highest prices for medical marijuana in the nation.

Cannabis is most often sold in eighths of an ounce, which can be rolled into about seven joints. An eighth of Gorilla Glue 4 marijuana sells for $35 in California. Its $40 in Maine. It costs $58 in Pennsylvania.

In Colorado, a full ounce of average weed often sells to consumers for $190. In Pennsylvania, the price is closer to $500. Some especially rapacious growers charge $600.

The patient community is always outraged about the prices, said Luke Shultz, a member of the states medical marijuana advisory board. Im not sure where the price should be. But wed sure like to see it lower.

Why is this legal weed so expensive? Blame it on many unexpected factors that have plagued the 21/2-year-old medical-marijuana program. They range from old-fashioned profiteering to a state law that has kept supply to a minimum, from a host of expensive regulations to an embryonic agency timid about using its legal authority to drive down prices.

That said, key state officials arent even willing to talk about the issue. A spokesperson for the Office of Medical Marijuana said its director, John Collins, paid $133,000 a year, would not grant an interview.

In written replies to questions, the agency said only, We continue to work to assist patients to ensure we have access to medical marijuana. It provided no details.

The states new medical-marijuana law permits the agency to cap prices and set up a fund to help defray costs for the poor. But such steps may not be taken for years, if at all.

Agency staff said the law blocks it from tackling prices until it has first adopted final regulations and paid back the state $3 million in seed money. And officials say it wont meet those conditions until late 2022, at the earliest.

The agency also disclosed to The Philadelphia Inquirer that $20 million in early marijuana revenue had been transferred to the states general fund in recent months, to help make up for pandemic-related shortfalls. That siphoned off millions that could have assisted lower-income customers.

Drawing upon analyst reports, national data and interviews with experts and industry executives, here is an examination of prices in a new marketplace that the state has turned into what economists term an oligopoly a sector dominated by a small group of powerful players watched by a handful of impotent regulators.

Demand vastly outstrips supply

Cannabis growers and dispensary owners charge what they want. Patient counts have exploded during two years of the medical marijuana program, paced by the addition of pain and anxiety as qualifying conditions. There are constant shortages even as COVID has increased demand far more.

Pennsylvania requires medical marijuana to be grown indoors

Growers in Western states and Maine may cultivate cannabis outside. Thats why customers can buy marijuana there at rock-bottom rates. The benefit of indoor growing is consistent quality and purity. Growers have greater control over the crop indoors. In a warehouse, growers can turn over more than five harvests a year. But it all comes at a cost.

Replicating the sun is a very expensive proposition, said David Tuttleman, the operator of an indoor-grow facility near Las Vegas

In fact, growing under lights and carefully calibrated conditions doubles the cost of producing marijuana, Tuttleman said. In Colorado, for instance, retailers in November paid $970 wholesale for a pound of outdoor weed, according to Cannabis Benchmarks, a trade publication. In Pennsylvania, an indoor pound sold for at least $3,500 and as much as $4,160.

And dispensaries, like retailers of many products, mark up the wholesale product 100%.

Regulations unique to Pennsylvania drive up the price

Owners of weed businesses grumble about having to comply with Pennsylvania requirements nonexistent in other states.

Pennsylvania demands that producers test their cannabis for molds and other impurities not once, but twice at harvest and again when the crop is packaged. Few other states impose a second test.

Moreover, Pennsylvania is the only state to require producers to destroy crops if they fail the second test, executives say.

Unlike in other states, Pennsylvania producers cant legally remediate crops found to have trace amounts of mold. Industry practice elsewhere calls for growers to reprocess a slightly tainted batch into oils or concentrates. Pressure and heat from the process kill any foreign substance.

Remediation is a big issue in Pennsylvania, said a grower who likes others fears retribution from state regulators. . I fail half of my tests I lost over one million dollars of product just last month.

We cant extract the oils from a failed batch under the current regulations, said another grower . Thats 80% of the reason why flower is so expensive and why theres constant shortages of it.

Additional regulations, many well-meaning, further drive up costs.

Pennsylvania requires marijuana businesses to retain enormous amounts of high-definition surveillance footage. That can cost $100,000 a year a store.

In Illinois, you have to keep a record of all your cameras for three months. In Pennsylvania, its two years, according to the president of one multi-state cannabis company. Thats a $30,000 upgrade just to get that. The amount of storage I need is through the roof.

Guards must protect all Pennsylvania weed businesses. In other states, security is left to the choice of owners.

It costs me $250,000 a year just in manpower to guard one store, said Chris Visco, owner of TerraVida Holistic Centers, a dispensary chain in suburban Philadelphia. Since we started curbside pickup with COVID, we need security both inside and out. And that has doubled the expense.

Said one cultivator: Its easier to get into a nuclear facility than it is into my grow.

Another costly requirement: Every dispensary must hire a full-time pharmacist. Most of the time theyre sitting at a computer, bored out of their heads, said one dispensary owner.

According to the former Pennsylvania legislator considered to be the father of medical marijuana here, pharmacists were added to the law to win over resistant lawmakers.

We needed to convince the conservative Republicans that this was really medicine, said Daylin Leach, a former Democratic state senator from Montgomery and Delaware Counties. They needed assurance marijuana dispensaries wouldnt be run by a bunch of hippie guys with goatees. There had to be someone professional on site.

The state has created an oligopoly. The number of growers has been kept artificially small.

Some states put no limits on the number of growers Colorado, Oregon, and Oklahoma among them.

According to Leach, Pennsylvania lawmakers wanted to be sure there wasnt an oversupply. We didnt want it to be ubiquitous like in the Wild West where pot was growing and sold everywhere, he said.

Further limiting supply is that the conflict between anti-marijuana federal law and Pennsylvanias statute means that weed cannot be shipped across state lines. Whats consumed in Pennsylvania must be grown in Pennsylvania.

Moreover, legislators put a specific ceiling on in-state cultivators, limiting permits to a total of 33.

Yet only 20 of those permittees are actually producing marijuana medicines. While more production would drive down prices, health officials have done little to force laggards to get into gear.

We have to have more competition, said Jason Mitchell, a cofounder of Soulful Cannabis, a marijuana-advocacy organization in Media. Theres nothing we can do because its all funneled through a handful of license holders. Whats the incentive for them to compete?

In an economy of scarcity, its hardly surprising profiteering is rampant

Many wholesalers simply charge retailers more in Pennsylvania.

A pound of wholesale marijuana grown indoors in Oregon sells to retailers for about $1,600. In Pennsylvania, wholesalers charge $3,700, according to an Inquirer survey.

To be sure, some growers reject this criticism, instead pointing especially to extra charges imposed by the government. In Pennsylvania, the state elected to charge $200,000 for a permit, plus an annual $10,000 fee. Colorado charges $4,000, Florida $6,100. Arizona $10,000.

Still, a former grower who sold his business last year to a multi-state cannabis corporation said the permit fee actually had a negligible impact.

In his view, profiteering was driving costs.

The profitability on the wholesale side is disgusting, he said. The cost to build a marijuana facility in Arizona is similar to what it costs to build one in the middle of Pennsylvania. What theyre charging is simply what the market can withstand.

Ultimately, of course, the patient pays.

And there is no reason for the price to be that high, said Peter Marcus, spokesman for Terrapin, a grower with operations in Colorado, Michigan, and central Pennsylvania.

Terrapin was founded by Phish fans and Deadheads. It sells to retailers for at least 20% less than competitors. If a consumer can find the product, Terrapins smokable flower can cost as little as $280 an ounce.

We decided whats fair for our companys revenue growth and whats fair for the consumer, Marcus said. We dont need to gouge.

The state marijuana program has yet to take action under key provisions of state law that could cut prices

Under the 2016 law, a sizable share of marijuana taxes 15% after expenses may be tapped to subsidize the cost for poorer patients. Asked when that might take place, agency spokesperson Nate Wardle wrote, We do not have a time frame at this point.

Instead, $20 million of the programs surplus revenue was grabbed by Pennsylvania Gov. Tom Wolf this year to plug the yawning budget hole created by the pandemic, Wardle confirmed last week. That was two-thirds of the programs money in the bank.

Predictably, many users have turned or returned to the illegal market.

There, street dealers typically price an ounce at $350, undercutting legal prices by a little.

Still, theres no reason cannabis, legal or from the traditional market, should cost more than $65 an ounce, said Chris Goldstein, a regional spokesman for NORML, the organization that has long lobbied for more lenient marijuana laws.

Nonetheless, one Philadelphia underground dealer was recently selling premium marijuana to consumers for $400 an ounce.

Everyday products like hair spray, air fresheners, and colognes and perfumes pollute the air too. According to Anacleto, common invisible indoor polluters include emissions from daily-use chemicals, and allergens such as skin flakes, dander from pets, mold spores, bacteria, mite proteins, and cockroach proteins harbouring in dust.

Many household cleaners include chemicals that release VOCs (volatile organic compounds) into your indoor air, which are linked to a broad range of health problems including headaches, nausea and respiratory irritation. Long-term exposure to some VOCs have been linked to cancer.

Anacleto suggests making your indoor air healthier by switching to clean, green cleaning products. Consider investing in a home air purifier from Molekule or a whole house air exchange systems like an HRV (Heat Recovery Ventilation) or ERV (Energy Recovery Ventilation) by Venmar, which is a Canadian product.

Railton says that an air purifier with HEPA filtration can minimize the impact of indoor air pollution. Look for a machine with fully sealed filters to capture gases and 99.95% of particle pollution, such as the Dyson Pure Hot+Cool fan heater.

If dry air is a concern, consider using a combined purifier humidifier. With a double auto mode, the Dysons purifying humidifying fan will automatically improve air quality and humidity levels.

No purifiers? Refresh the air in your house just like you would in your car, open the windows when you can and is safe to do so, adds Anacleto.
