What a difference 40 years makes.

As a child in the 70s, Ken Nelson of the Breckenridge Restaurant Association remembers when smokers could light up just about anywhere: nightclubs, high-end restaurants, aprs patios, the dive bar down the street. Swirling smoke was considered yet another piece of the dining experience.

These days, decades of research on second-hand smoke have changed the restaurant industry. Smoking isnt allowed anywhere at Nelsons three Main Street establishments, including the outdoor patios he considers extensions of the dining rooms. For him, its a courtesy to all patrons, and smokers are often more than willing to oblige.

I think smokers have always been good about accommodating others, Nelson said. Theyre tuned into watching where these (smoking) areas are, and I think people understand where they can go and where they cant. Even smokers arent accustomed to having smoke in their face when they eat.

But habits are shifting once again. On Wednesday, the Breckenridge Town Council heard a series of revisions to the towns current smoking ordinance. The proposed changes arent 40 years in the making indoor smoking has been banned across the town and state since 2006 but they highlight a relatively new slice of tobacco (and marijuana) culture: electronic smoking devices.

As defined by the revised ordinance, electronic smoking devices run the gamut from electronic cigarettes to oil-based vaporizer pens. The revisions also ban smoking electronic and otherwise at all indoor and outdoor public areas owned by the town, including Blue River Plaza, the riverside bike path and golf club facilities, excluding the course of play itself. The ban is paired with a 10-foot buffer zone restriction for business entryways, restaurant patios and public transit stations.

The town council unanimously approved the revised ordinance on its first reading Wednesday night, and no business owners or town residents opposed the changes. The ordinance will take effect if passed during the second reading at the next regular meeting on Jan. 27.

Silverthorne and Dillon have considered similar restrictions the Dillon council will discuss smoking at the Jan. 20 work session but neither town has written drafts ordinances.

Before approving the Breckenridge revisions, Mayor John Warner wondered aloud about the impact they will have on casual, everyday smokers.

This is something new and perhaps will be important for some people, Warner said at the meeting. When he asked how long other Colorado towns have banned electronic devices and smoking in entryways, Breckenridge chief of police Shannon Haynes noted that Denver and Boulder passed similar smoking laws several years ago, and Brecks proposed changes are in line with most of the state.

Restaurant patios are no longer a refuge for smokers in New Westminster after a new bylaw took effect New Years Day.

The bylaw is the result of Fraser Health asking municipalities to beef up their regulations. It prohibits smoking within 7.5 metres of doors, windows and air intakes of public and workplace buildings; restaurant and pub patios; and within 15 metres of outdoor sports facilities, playgrounds, off-leash parks and picnic areas within city parks. Building owners and businesses are required to put up signs to make smokers aware of the new regulations.

But dont look for the heavy hand of big brother to come down hard. At least not initially.

The new regulations bring New Westminster in line with many municipalities in Metro Vancouver although the bylaws between cities arent always identical.

Fraser Health spokesman Ken Donohue said the first step in enforcing the new regulations will be education.

Weve found thats the best approach, said Donohue.

He added the regional health authoritys environmental health officers will work in collaboration with city bylaw enforcement officials. If a ticket needs to be issued it will be done by the city, he said.

Donohue admitted enforcing the regulations will be a challenge, even for the health authority since many hospital workers and patients are frequently seen smoking just outside of hospital entrances.

Thats the challenge with a lot of these smoking bylaws, said Donohue. Even where our offices are located in Central City (in Surrey) youre not supposed to smoke, there are signs all over the place. Youve always got people who will light up by the door Its a huge issue and its not an easy one to stamp out and its definitely there.

Although the Paddlewheeler Pub at the River Market had a popular patio for smokers, an employee said the new regulations wont likely affect their business. Brooke Mitchell said the smokers will likely still patronize the restaurant and just adjust where they go to smoke. She pointed out since no one else is allowed to have a smoking patio they wont have any other place to go.

The Wine Pub on Shelter Island/Point Loma is one of many San Diego restaurants that not only allows dogs but encourages owners to bring their pooches. The Wine Pub is so dog-friendly, in fact, it offers a "homemade K-9 menu." A new state law that went into effect Jan. 1 makes it legal for all restaurants to allow dogs on the patio.

Make no bones about it, San Diego is one of the pooch-friendliest places in the country.

And those lucky dogs are getting a treat in 2015 with a new state law in effect as of Jan. 1 that officially allows Fido on restaurant patios throughout California.

Not that San Diego canines have been stuck at home waiting for a doggie bag theyve been joining their best friends in outdoor seating areas around the region for years. And because the new law doesnt require eateries to accommodate dogs, dont expect a wave of doggy cafes to be unleashed.

It just validates a long-standing practice here, said Wendy Patrick, an attorney and business ethics lecturer at San Diego State University.

Its a recognition of the fact that dogs are part of our family. If businesses want customers, they have to consider that. But for all the naysayers, dont worry, it doesnt permit a candlelit dinner for three inside.

In fact, the law, which was signed by Gov. Jerry Brown last summer, sets conditions for how and where dogs can be and still makes allowances for local ordinances that ban the practice.

Among the laws conditions are that pet owners must keeps their dogs on a leash or in a carrier and cant let them sit on chairs or tables. Restaurants will be required to have separate outdoor entrances to the patio so the critters wont be marched through indoor dining rooms.

Sponsors of the original bill, AB 1965, argued that while outdated state laws made it illegal to do so, many restaurants already chose to allow dogs on their patios. A number of county health departments around California had also approved rules allowing individual restaurants to decide whether or not to allow dogs on patios.

David Cohn, president of the Cohn Restaurant Group, said many of the chains eateries with patios already provide water bowls for dogs and he doesnt expect the new law to have much impact.
