Amendments to the Smoke-Free Ontario Act will supercede existing municipal bylaws - November 11, 2014 by Mr HomeBuilder

Health officials are applauding a plan to eliminate smoking from patios and playgrounds next year, but a local nightclub owner worries the move could cause have a big economic impact.

Andr Legault, who operates Encore in Orillia along with Barrie's Sound Empire, said banning smoking on outdoor patios will likely cut revenues at bars and nightclubs across the province.

"On a nightclub basis, it's going to affect us tremendously," he said, adding he fully supports tougher smoking measures for playgrounds and the like.

The province announced it will ban smoking on bar and restaurant patios, playgrounds and public sport fields effective January 1.

The sale of tobacco on college and university campuses will also be outlawed, Associated Heath Minister Dipika Damerla told the Toronto Sun, pointing out the provincial Liberals are committed to having the lowest smoking rates in the country.

Under current legislation, smoking is permitted on uncovered bar and restaurant patios. Encore features a large outdoor patio while Sound Empire has an alleyway where patrons go to light up.

Legault said it will be difficult for busy clubs like Encore to monitor and control who is leaving to go outside to have a cigarette, especially when there is a lineup to get in.

"Let's say a fight breaks out in the street, monitoring that puts us in an awkward position," he said, noting such an incident would be taking place on city property and likely wouldn't fall under the auspices of a business's security personnel.

    "It's a complicated situation."

The amendments to the Smoke-Free Ontario Act will supercede existing municipal bylaws while also covering all publicly-owned sports surfaces and extending to spectators as well.

Ontario to ban smoking on patios, playgrounds 0 - November 10, 2014 by Mr HomeBuilder

    TORONTO-

Ontario will ban smoking on bar and restaurant patios, playgrounds and public sports fields as of Jan. 1, Associate Health Minister Dipika Damerla announced Friday.

The sale of tobacco on college and university campuses will also be outlawed, she said.

The Ontario government is committed to having the lowest smoking rates in the country, Damerla said.

Today is another step in that direction, she said, adding she didnt expect that banning smoking on bars and patios would have a negative impact on the businesses.

The changes will be in effect when the Toronto region plays host to tourists from around the world for the 2015 Pan Am Games.

The amendments to the Smokefree Ontario Act will supersede existing municipal bylaws if more permissive and will cover all publicly owned sports surfaces and will extend to spectators as well.

For example, this includes areas for basketball or soccer, ice rinks, tennis courts, splash pads and swimming pools that are owned by a municipality, the province or a post-secondary institution, Damerla said. The prohibition extends to spectator areas around sports fields and a 20-metre radius around sports fields and their spectator areas. It also includes childrens playgrounds at motels, hotels and inns.

Michael Perley, director of the Ontario Campaign for Action on Tobacco, said the provincial rules create a level playing field for all businesses.

Under the current provincial legislation, smoking is permitted on uncovered bar and restaurant patios.

All bar and restaurant patios, as well as playgrounds and sports fields, will be off limits in the new year - November 9, 2014 by Mr HomeBuilder

The world keeps shrinking for smokers.

As of New Years Day, it will be illegal to smoke on any bar or restaurant patio in Ontario, the province announced Friday.

Smoking is not only banned on public playgrounds and sports fields, it will be illegal to smoke within 20metres of them.

Sales of tobacco also will be prohibited anywhere on a college or university campus.

The new rules come as no surprise. London North Centre MPP Deb Matthews announced the new restrictions were coming a year ago when she was health minister.

The new provincial rules are tougher than the ban on smoking imposed by city council last year, which specified a nine-metre no-smoking zone around parks and recreational facilities. But council took no action on a recommendation from the Middlesex-London Health Unit to ban smoking on open patios, with some councillors arguing it would drive some bars and restaurants out of business.

Health unit manager Linda Stobo said the number of bars and restaurants affected will be limited because many have covered patios already subject to the smoking ban and about 20 establishments have voluntarily moved to end smoking on their patios.

One of them is Rich Hunter, owner of the King Edward Pub in Ilderton.

He banned smoking on his rear patio two years ago.

It was a business decision. It is what the majority of our customers wanted, he said.
