    Damning report sheds light on Canning council - November 16, 2012 by Mr HomeBuilder

    Update, 5.30pm: An eight-month probe into the City of Canning has recommended the council be suspended ahead of a full-scale inquiry after finding "serious and continuous" failings by the council and individual elected members.

    The report, tabled in Parliament this morning, also recommended a further probe into breaches of the Local Government Act by Canning mayor Joe Delle Donne and Cr Bruce Mason relating to a failure to disclose their relationship with a contractor hired by the council.

    Painting a damning picture of dysfunction, the report by the Department of Local Government concluded the council had seriously eroded its professional relationship with its administration and it would be inappropriate for it to continue to act as the governing body for the city.

    The inquiry submits that it is demonstrated by the number of examples of poor decision making and the adverse influence of the mayors group in council decision making that there has been a clear failure by council to ensure the City of Canning performs its functions properly, the report said.

    The situation that exists now is that council has seriously eroded its professional relationship with its administration to the extent that the inquiry considers that if the council were to remain in office the potential exists for further major problems to develop.

    Singling out Mr Delle Donne, the report said the single most concerning event was his unilateral decision to suspend chief executive Mark Dacombe without the authority of or informing the council.

    The mayors actions in unilaterally suspending the CEO establish the extent of the power he, as an individual, inappropriately wielded over the administration, it said.

    The found Mr Delle Donne and Cr Mason had failed to disclose a free lunch from law firm Civic Legal prior to being involved in a decision to appoint them to the citys legal services panel.

    It said emails highlighted in particular Mr Delle Donnes close business relationship with Civic Legal.

    The report said the breakdown of the relationship between administration and council had been caused by the council continually rejecting or failing to seek sound officer advice, repeatedly interfering in administrative matters and unreasonably accusing staff of maladministration and Mr Dacombe of misconduct.

    (Reuters) - Warren Buffett's conglomerate Berkshire Hathaway sold retailers and consumer heavyweight stocks in the third quarter but took new positions in industrial manufacturers like Deere & Co and Precision Castparts, according to a regulatory filing on Wednesday.

    Many of the investment decision were made not by Buffett himself but by his two investment managers, Ted Weschler and Todd Combs. Buffett has said only the changes in Berkshire's biggest positions, like adding to holdings of Wells Fargo, were made by him.

    The portfolio was again volatile this quarter, with a number of large moves in a wide variety of stocks. While Buffett is the exemplar of buy-and-hold investing, he has indicated that at least one of the team of Weschler and Combs is inclined to trade more actively from quarter to quarter.

    Berkshire took new stakes in Deere, the world's largest agricultural equipment maker, as well as Precision Castparts, whose castings are used in every jet aircraft engine program in production or under development.

    It also took a position in Wabco Holdings, which makes braking and transmission products for the commercial truck market, and raised its stake by 50 percent in the automaker General Motors.

    At the same time, Berkshire sold two stocks that were relatively new to the portfolio, CVS Caremark and Dollar General. It cut its long-time holding in Johnson & Johnson by 95 percent and also trimmed its Procter & Gamble position by another 11 percent.

    J&J was one of Berkshire's biggest investments by valuation over the last five years, but Buffett has been selling it aggressively this year, telling CNBC in February the company "has messed up in a lot of ways" in the recent past.

    Berkshire was also active in media stocks during the quarter. In addition to a new stake in Media General, tied to Berkshire's acquisition of that company's newspapers, the conglomerate increased its position in Viacom and sold some of its relatively new holdings in newspaper operator Lee Enterprises.

    Buffett's company made a number of investments in financial stocks as well, adding to positions in his favorite bank Wells Fargo and also BNY Mellon even as it sold some holdings in Visa Inc and U.S. Bancorp.

    In the second quarter, Berkshire made big bets on the refiner Phillips 66 and the oilfield equipment maker National Oilwell Varco.

    Though the company's One X and One S will get the Jelly Bean update, the One V and Desire C lack the required amount of user memory.

    HTC's Android 4.1 plans may already anger a few users.

    HTC has launched an FAQ page that details its Android 4.1 Jelly Bean plans. Though it stops short of listing specific device upgrade dates, it page spells out some of the factors that determine which models will make the cut.

    It should come as no surprise that HTC will give priority to recent models such as theOne XandOne S. As far as other devices, though, the company is "actively reviewing" its portfolio of handsets.

    To that end, HTC already has shut the door on two models, the One V and the Desire C. The reason? Android 4.1 needs more than 512MB of RAM to deliver the best experience.

    That's disappointing, but HTC should be applauded for its transparency. Yes, that will leave plenty of angry users with handsets that have yet to celebrate its first birthday, but HTC promises to support the One V, Desire C, and other models like them with bug fixes and software improvements.
