LA MESA A La Mesa real estate company faces fines of more than $90,000 in connection with a fatal tree-trimming incident last year, a state agency said Monday.
Joshua Alan Pudsey, 42, was struck and killed by part of a 60-foot eucalyptus tree that he was helping remove from a La Mesa home Nov. 12. Pudsey had worked at Three Frogs, Inc. for about three months when the incident happened.
The states Division of Occupational Safety and Health department determined neither Pudsey, nor any of the other laborers employed by the company, had the experience or training needed to cut down the large tree.
The incident is a vivid reminder of what can go wrong when employers dont have proper safety procedures in place, Christine Baker, Director of the Department of Industrial Relationship said in a statement.
Three Frogs, Inc. could not be reached by phone for an interview and a message couldnt be left on their phone.
Investigators said the company, which buys and resells homes, failed to hire a qualified tree worker to supervise work related to tree trimming, tree repair or removal of trees taller than 15 feet, as is required by law. The employees also werent trained to use the 80-foot aerial lift used to cut the tree, nor were they provided with eye protection or fall harnesses while working the lift.
When safety takes a back seat to the bottom line, tragedies such as this one will result, acting Cal/OSHA Chief Juliann Sum said in the statement.
The company was cited for a total of 13 violations. Eight were considered serious in nature, which means there was a possibility that death or serious injuries could have resulted. The company has 15 working days to appeal the violations.
The California Labor Commissioners office is also investigating the company for possible labor violations.

Sudden rain, hail and lightning struck Michigan Saturday evening, leaving thousands without power. Winds reached up to 60 miles per hour, uprooting trees, ripping shingles off roofs and downing power lines. By Monday night, temperatures plunged and snow fell. The Flint area received about an inch of snow and the Detroit area received about 3 inches, according to the National Weather Service.
By today, power has been restored to most residents who experienced a power outage over the weekend. Consumers Energy reports 2,900 Genesee County customers experienced a power outage, with more than 110,000 customers being affected throughout the state. Parts of I-75 and I-475 were closed due to downed power lines. In Oakland County, 48,000 DTE Energy customers were affected by the storm.
Locally, certain parts of Linden and Fenton Township were hit hardest and experienced power outages. Gaines, Mundy and Argentine townships were also hit hard by the sudden storms.
Some residents believe this past weekends storms were close to being tornadoes.
Earth was coming up and we saw lightning hit trees, said Fenton Township resident Gregory Pelc. We went into the basement and we heard a boom! I thought all the windows were being broken out.
That boom was a fallen tree that smashed into Pelcs back porch. Pelcs neighbors also experienced some damage, with shingles ripped from roofs and outside furniture ravaged from the strong winds. A trampoline was impaled into the side of one house.
Pat Matney, who lives near Lake Fenton Middle School, said two trees fell onto her house Saturday evening. She and her dog didnt hear it however, not realizing that her roof had been damaged until the next morning. A tree cutting crew removed the debris on Sunday.
Where the weather seems to have stabilized in Genesee County, the western part of Michigan is experiencing detrimental weather. The National Weather Service issued a flood warning for Clare, Lake, Mason and Muskegon counties. Emmet and Wexford counties have also reported signs of flooding.
While spring weather can be unpredictable in Michigan, this weekends past storms didnt match up to last years weather, when tornadoes ripped through Genesee County. Looking ahead, the National Weather Service expects sunnier weather for the rest of the week, aside from showers on Friday. Temperatures are expected to range from the low 50s to the mid 60s, possibly reaching the 70s next week.

My tree, my right to chop it down -

Noticed, late on Friday afternoon: 1) several tree removal trucks near a New Westminster apartment building, the intent clearly that of the annihilation of a copse of mature trees; and 2) a chainsaw-wielding man at a Washington state beach cottage delimbing a stately birch that was overstepping its boundaries.
And, I thought, this is the way things should be. Trees need to be taught a thing or two, like they can't just grow any which way they want without repercussions.
Not a popular sentiment, by most accounts, especially here in the land of the greens, where dogs and cedars and pop-up protesters trump all when it comes to societal sentiment.
Because, let's face it, who doesn't love a tree? Trees are pretty, and provide nooks for birds' nests and strong ledges for tree forts. Their 50 shades of green are like no other, hues that only nature could create and in whose shadow man must forever feel the lesser artist.
Trees are the lungs of the earth, prevent erosion and inspire us with their majesty, their stoic survival in the face of war and pestilence and logging companies.
Perhaps we so revere our trees, chaining ourselves to them and defending their honour, hollow and otherwise, because they remind us of life, their roots planted deep in history, their branches reaching out to the world.
Perhaps it is why we preserve sainthood for all that is bark and branch, leaf and needle, whether it's a thousand-year-old primordial cedar lording over a foggy Vancouver Island cove or a garden-centre sapling planted in an urban backyard and coddled into bearing fruit.
Trees. We stand in awe of their beauty and utility, their utter magnificence.
But trees aren't the boss of us. Sometimes, we need to fell them, for firewood or to build a house or because we're in the resource business, or because they're dangerous or diseased or just plain ugly. Sometimes, they stand in the way of progress.
Sometimes, people, we forget that trees are just trees. They grow, they fall down, get chopped up or die of old age, millions of them all around us, and have for thousands of years, a cycle that begins anew with each seed floating on the wind.
