AT LEAST 56 families along the North Reclamation Area in Cebu City may soon lose their houses.

Regional Trial Court Branch 7 Judge Simeon Dumdum denied their omnibus motion that seeks to recall the writ of demolition.

The motion came too late, said Dumdum said in his one-page order.

On Feb. 10, 2012, Dumdum issued the writ to demolish the houses at Lot 18, Block 15 on J. de Veyra St.

The 810-square-meter property is owned by Domingo Garcia, who filed a complaint in 2008.

Background

Garcia said the residents occupied his property without his consent. At first, Garcia said, he tolerated their stay. But over the year, their numbers grew.

Garcia said he demanded that they vacate his property, but they asked for an exorbitant amount for their relocation.

Replying to the complaint, the residents said they only occupy 380 square meters and roughly 140 square meters of it is owned by the Cebu City government, being a sidewalk.

They said Garcia owns only 240 square meters and not the entire 820 square meters. They said Garcia should not include those who do not occupy his property.
