THE CHATHAMS Apparently school officials did not need the boroughs permission for the July 8 removal of trees at the Washington Avenue School, emergency or not.
About nine trees were removed after police notified the district that one had split and was in danger of falling.
The removal created an outcry, not only because the trees were cut down. The district next month intends to add 23 parking spaces at the school to alleviate parking congestion, and speculation was ground clearing had begun without notifying the public.
That speculation, however, ended Tuesday when Borough Engineer Vincent DeNave issued a statement saying the School District of the Chathams is not subject to our tree removal permit process.
The Board of Education is defined as a Public Agency , their property is considered public lands and therefore exempt from the provisions, DeNave wrote.
However, DeNave noted that if the board chooses to move forward with a parking lot expansion project, they are subject to appear before the Planning Board for a capital review that will allow for public comment and input.
The expanded lot is part of the districts capital improvement plan for the 2013-14 school year. Officials want the spaces to be available when school starts this September.
DeNaves announcement was welcomed by Superintendent of Schools Michael LaSusa.
"Regardless of technical requirements or exemptions to such, we want to be as communicative as possible with our municipal officials and also be a good neighbor to those who live near our schools, he said in a Tuesday email.
That the district was exempt from local laws was determined by Borough Attorney James Lott.

GALLIPOLIS Gallia County Sheriff Joe Browning issued a warning to area residents on Tuesday of a possible tree removal scam.
According to Browning, his office recently received information in regard to a Gallia County resident who was approached at her home by a local man offering to remove a tree from her property.
The woman told deputies that she was charged two times for the tree and stump removal, and that the alleged company had failed to complete the job, leaving the elderly home owner without the complete service.
In addition, the tree trimmer reportedly offered his service at one price and then increased the price prior to completing the job.
Browning reported that the sheriffs office is investigating to locate the man the was involved.
The sheriff recommended using only local, established companies that are licensed and with a good reputation. These companies should be able to provide proof of insurance and should have current certificates of liability and workers compensation insurance.
Residents are also recommended to get references from people in your community, and to check on the quality of their work and level of service.
The public should not be rushed by a sales pitch, and dont ever pay in advance, Browning stated. Dont be afraid to ask if they follow industry standards on tree removal and disposal, including safety standards. Remember to insist on a signed contract as to cost, and dates when work is to be performed, and exactly what is to be done.

NSW Minister for Mental Health Kevin Humphries says community groups can benefit people prone to mental health issues.
Mr Humphries was in Albury yesterday and met Mens Shed representatives from Albury, Culcairn, Henty, Howlong and Thurgoona at the Manual Activity Centre in Lavington.
He said it was important for older men to become aware of what their needs were.
People over the age of 70 are more susceptible to disease like dementia, the National Party MP said.
It is important for them to stay connected to their mates and family because they will stay a lot healthier.
He said social and emotional well-being impacted older men who were at risk of chronic disease.
The long-established MAC was one of the best sheds Mr Humphries had seen.
Its great to see what people are doing in the community to help themselves, he said.
MAC member Frank Lange said the city council provided them with the resources needed to cater to the members and he appreciated Mr Humphries support

OWNERS of a newly-built chicken farm at Hemingford Grey have been forced to go back to planners after giant poultry sheds were constructed 60 feet too long.
The blunder will cost around 50,000 as Amber Real Estate Investments has to start the planning process from scratch at Galley Hill Farm, which only went into operation at the beginning of the year.
Enforcement officers at Huntingdonshire District Council were alerted by a worried member of the public who spotted that the sheds were bigger than they should have been after the farm was completed.
The chicken farm, which replaced a run-down unit on the St Ives turn from the A14, had caused concern for people living near the site who were worried about its impact, especially over plans to build a wind turbine and instal gas tanks.
They have also complained about smells from the site which can hold hundreds of thousands of birds.
Now Amber Real Estate investments has had to seek planning permission for the eight bigger broiler houses, feed bins, a service building and a house for the site supervisor.
A spokesman for the district council said: An enforcement officer measured the length of the poultry units as built and found each one to be approximately 103 metres (338ft) in length. The approved length is 85.4 metres (280ft).
