Several owners of condominium units at the Brazilian Court will have to find a new way to rent their properties.
The Code Enforcement Board voted 4-3 Thursday to shut down agent Leslie Diver, who managed rental inquiries for eight owners via an online vacation rental site. She also arranged cleaning and laundry services.
Town staff said Diver violated a town ordinance that prohibits using a building or land in a residential district for commercial or quasi-commercial purposes.
We believe that Ms. Diver is conducting a hotel operation within the Brazilian Court Hotel, said Code Enforcement Manager Raychel Houston. Ms. Diver is renting out individual units at the hotel on a nightly, weekly or monthly basis. In effect, she has a competing hotel rental program in addition to the rooms that the hotel is renting themselves.
Timothy Hanlon, Divers attorney, said owners have the right to rent their units and Diver is simply acting as an agent.
She receives no commission from the sales, he said. She doesnt employ any cleaning services, she merely arranges for the work to be done. All the payment is done by the owners. There is no operation of a hotel. I think that is a gross exaggeration.
Diver said she doesnt receive money directly from the website or renters but does charge owners a $200 flat fee plus $25 an hour for additional services.
You are getting paid and its in conjunction with certain services that youre providing, said Code Board Chairman Harris Fried. Youre using that building, the physical edifice, to run a commercial or quasi-commercial business.
Competing rental systems
Owners hired Diver to oversee renting their properties because they couldnt get the hotel to do it, Hanlon said.

Councils across the country are imposing water restrictions as dry weather begins to bite, but Auckland is unlikely to have to follow suit, despite a continuing spell of sweltering summer days.
Watercares Acting Chief Operations Officer, Shayne Cunis, says that while levels in the citys supply lakes are below the average for this time of year, Watercares system has sufficient flexibility to ensure ongoing security of supply to all areas serviced by the metropolitan network, which stretches from Orewa to Pukekohe.
Mr Cunis says Aucklanders deserve a large share of the credit for the lack of water restrictions, with the citys inhabitants using less water per head than anyone else in the country.
"However, with little if any relief expected from the current dry weather conditions, its important people continue to think about how they are using water, and whether they could do so more efficiently."
Thirty years ago, Aucklanders used more than 400 litres of water per person per day. By 2004, this had reduced to 298 Litres per person per day. In 2011, Watercare set itself the challenge of further reducing consumption to 253 litres per person per day by 2025.
"Currently, we are five litres per day ahead of the target line, and Aucklands per capita water use is the lowest in New Zealand, says Mr Cunis.
"And Watercare is keen to do whatever we can to maintain that rate of improvement.
"To that end, we run a proactive maintenance campaign that minimises the amount of water lost in our networks, we work closely with large commercial users to ensure they are operating as efficiently as possible, and we encourage householders to Be Waterwise."
Mr Cunis says Watercares metropolitan network draws water from dams in the Waitakere and Hunua ranges, an underground aquifer, and the Waikato River.
"We constantly alter the amount we take from each source to ensure we strike the right balance between minimising operating costs and ensuring security of supply," says Mr Cunis.

Donald Saunders, President of Saunders Landscape Supply, would like homeowners and landscapers to know that Mulch season officially begins in 60 days.
"We sell mulch year round, but peak sales are March 10 to June 20th," Saunders explained. He went on to mention that 92% of the company's mulch sales occur from Jan. 1 to Aug. 31, but the company focuses on the March to June range because that's when most weeds germinate and significant plant growth begins.
"Weeds are unsightly, they don't serve any valid purpose or function," said Saunders. "When you mulch, it provides a crisp clean curbside appeal and allows for weed suppression as well as water retention. Not to mention it looks good."
Saunders Landscape Supply sells mulch year round. In addition to weed suppression, mulch can also provide water retention and aesthetic appeal. The company's most popular and least expensive mulch is its shredded hardwood mulch, but they also carry leaf mulch and three varieties of color enhancing mulch in red, brown and black.
Leaf mulch is growing in popularity because it retains its color for a significantly longer period of time. The color enhanced mulches are generally the same quality as the other mulches, and they're dyed using a chemical that's safe for the environment.
All mulch types that Saunders Landscape Supply offers are currently in stock, so even though mulch season is still 60 days away, it's not a bad time to buy for customers looking for something specific that may go out of stock later.
Customers who are having trouble determining how much mulch they need can go by a simple formula: a single cubic yard of mulch will typically cover a 100-square-foot area in a three-inch-thick layer. They can also ask the helpful employees at Saunders Landscape Supply for recommendations.
About Saunders Landscape Supply
Saunders Landscape Supply has been operating in the Northern Virginia and Maryland areas since 1994. Offering quality gravel, firewood, mulch and more, the company can deliver to multiple area locations. To learn more, visit http://www.saundersls.com.

For Radovan Peric and his family, real life is in the mountain, with their forty goats.
'This is the way my ancestors lived, it's my fate,' he tells me, liberally sloshing more home-distilled grappa into shot glasses.
In the thirty years he has lived with his wife, and later his daughters and granddaughter, in this simple home perched on the hillside above the Kotor old town and the bow-tie shaped southern part of the bay, he has seen cataclysmic change, the landscape pushed and pulled by tradition versus progression.
Once, communist-owned factories chugged below; now, ecology is thriving, Peric grows all his own food and only descends for beer, coffee and sugar.
A view over Kotor Bay from the home of Radovan Peric and his family, who live the simple life away from the modernisation of Montenegro
Apart from the odd horror during the Eurovision Song Contest I knew little about Montenegro, except that it sounded green, but somehow moody and grey, in the shadow of huge mountains and of course, that lots of millionaires live there.
Now, daring to dip a toe into the world of multi-generational holiday, I'm here with my mother, and I see that I was right. But of course, that's just the tip of the post-soviet iceberg.

Emily Zaengle took the reins as the new executive director of Stone Quarry Hill Art Park on Jan. 5 Photo by Jason Emerson.
Cazenovia After more than one year of being run by an interim director, the Stone Quarry Hill Art Park Board of Directors last week announced the hiring of a permanent executive director for the park Emily Gates Zaengle.
Zaengle, 27, a native if Unadilla Forks, holds advanced degrees in both landscape architecture and museum studies and during the past three years has served as both an intern and a volunteer at the art park.
Im really excited. I dont know if its a post made for me or me for it, but it fits, Zaengle said. It will be a challenge, but I love challenges and creative problem solving. Im up for the challenge because I believe in it. And I have a great board of directors that support me and believe in this place.
I cant tell you how thrilled we are, said SQHAP Board of Directors President John Hunt. We felt we needed that long-term look at the future, and one of our five-year goals was to get someone in that executive director position and allow them to take the park through our 24th and 25th years and onward finish out our first quarter century.
Stone Quarry Hill Art Park will host a day of winter fun from noon to 3 p.m. on Saturday, Jan. 24, at the Winner Gallery. Visitors will have the opportunity to meet the new executive director, Emily Zaengle, as well as to sit back with a cup of free hot chocolate and participate in arts and crafts and whatever outdoor activities the weather will allow. The event is free and open to the public, and does not require any reservations. For more information call the park at 655-3196.
Stone Quarry Hill Art Park is one of the first outdoor sculpture parks in the country. The park , which consists of 104 acres of land and more than four miles of hiking trails, showcases the works of emerging and established artists in natural and gallery settings, and offers public programs and educational outreach including exhibitions, lecture-demonstrations, workshops and classes.
