    Colorado duct cleaners busted for bait-and-switch banned from business

    Two men have been banned from advertising or performing air-duct cleaning services in Colorado after they advertised dirt-cheap prices Attorney General John Suthers says they had no intention of honoring.

    The AG's office last fall filed a civil lawsuit against Andre Shatyko and Alexander Kurdyukov, claiming they used Internet companies Groupon and Living Social and direct-mailer ValPak to offer air-duct cleaning by Seabreeze Air, Quality Air or Fresh Air for as little as $34.95. But when the men arrived at the homes of customers some of whom had prepaid via Groupon or Living Social they would jack up the prices.

    Last fall Suthers also said Shatyko and Kurdyukov performed shoddy work using inadequate tools that left dust and debris in consumers' ductwork and sometimes damaged their homes. According to the AG's office, 220 people filed complaints about the companies with the Consumer Protection Section.

    In a settlement, Shatyko and Kurdyukov were ordered to pay the state $916,000 for charging more than they advertised and performing services that were often of little or no value. However the terms of the deal forgive $766,000 if the defendants pay $150,000 off over the next 147 months.

    AG's spokeswoman Carolyn Tyler said the $150,000, if it is collected, is sufficient to compensate the people who filed complaints.

    The lawsuit is the result of the Attorney General's ongoing efforts to combat air duct cleaning companies that misrepresent their prices and perform incomplete, unprofessional work that has the potential to cause damage to homes and incur health issues for residents.

    "Consumers let us know there was a problem with this Seabreeze and after we investigated, it was clear that this company lied about its rates and capabilities," Suthers said. "Air-duct cleaning must be done correctly or dust and debris can be left or stirred up that can create a health hazard for homeowners."

    With the change in seasons, the Colorado Attorney General's Office warns the public to be wary of air-duct cleaning companies whose promises seem too good to be true. If a scam is suspected, the public is encouraged to file complaints with the Office's Consumer Protection Section by calling 800-222-4444 or clicking: http://www.coloradoattorneygeneral.gov/complaint.

    DENVER The Colorado Attorney General's office has permanently barred an Aurora air-duct cleaning company from doing business in the state in a scam similar to one exposed by a 9Wants to Know investigation.

    Seabreeze Air, LLC, (also knon as Seabreeze Air, Quality Air, Quality Air LLC, and Fresh Air) are banned from performing air-duct cleaning services or advertising in Colorado as part of a settlement with the Attorney General's Office. The owners of the company, Andre Shatyko and Alexander Kurdyukov, are also banned from doing business in Colorado.

    According to investigators, the company would offer extremely low-cost air-duct cleaning services in advertisements with Groupon, LivingSocial and ValPak with "no intention of honoring the advertised rate." The Consumer Protection Section of the AG's office filed a civil lawsuit against the company last November.

    "Consumers let us know there was a problem with this Seabreeze nd after we investigated, it was clear that this company lied about its rates and capabilities," said Attorney General John Suthers in a release.

    9Wants to Know investigators looked into Seabreeze and other air-duct companies after learning of similar complaints from customers in 2013. Seabreeze had an "F" rating with the Better Business Bureau at the time but was so busy had no time to schedule an appointment.

    9Wants to Know went undercover with a different company, The Finest Duct Cleaning, after seeing an ad for air-duct cleaning for $40.

    When the company arrived, an employee told us we had more lines than the offer allowed.

    Here's a quiz. Which of these things is not like the others?

    A. A few years ago, we added a concrete parking slab and a retaining wall next to our garage. We got a few quotes first, and every concrete guy who came to the house brought a book of photos and testimonials. We got to flip though the book, and when we saw a retaining wall style we liked, we said, "We like that one. Do that for us, please."

    B. This year, I'm teaching 10th grade English. I haven't taught that class in the better part of a decade and not at all at the school where I teach now. But Shakespeare's "Julius Caesar" is on the calendar now just as it was the last time I taught it. When the other teachers and I were planning this semester's final exam last week, I dug up the questions I wrote about that play for a final exam I gave years ago at my previous school. We're going to put some of those questions on the final this year.

    C. In the 1990s, the economy of Japan was awful. They call it Japan's "lost decade." The country's response was a policy of austerity, pulling back on government spending in the hopes that the private sector would step into the breach and get the Japanese economy back on a solid footing. When the economy of Europe collapsed in the 2000s, places like Greece and Italy following Japan's lead also pursued austerity, attempting a specific and common policy solution to a common problem (FYI, austerity didn't work. Japan's economy is booming right now because of a strong stimulus, while Greece is simply hoping that maybe, just maybe, they'll finish the year with barely positive growth for the first time in years).

    D. When we got married, my wife and I hired a band we really loved to play the reception. They put on a hell of a show, playing a lot of our favorite songs of theirs, in fact. And we were very glad that they played all the right notes and sang all the right words in the right order. That's why we hired them!

    E. Did I mention I'm a teacher? My class syllabus clearly says, "If you can Google it, I can Google it." Yet every year I have multiple uncomfortable conversations with students who insist that the site I show them online must have copied from them, not the other way around.

    So what was your answer? Did you pick E? You should have. Answer choice E is the only one that describes an actual instance of plagiarism, something that, as a teacher and an English teacher at that! I have very strong feelings about.

    The other answer choices are not plagiarism, or even close to it.

    By now, you have probably figured out what party I am coming to, even though I am very late to it (real life got in the way of my writing a column last week when this might have been more relevant). And that party is the Mary Burke plagiarism "scandal."
