Gwinnett Countys top prosecutor felt a bit more confident Wednesday about prosecuting men who he said swindled scores of homeowners in metro Atlanta in a roofing scam despite concerns the state had botched the case.
I am hopeful as of today we may be able to move forward with the case, District Attorney Danny Porter told The Atlanta Journal-Constitution. There are still issues but I am hopeful today.
On Tuesday, Porter had blasted the Governors Office of Consumer Protection for taking five years to bring him the case in an interview with Channel 2 Action News. Homeowners began complaining about the company in question, Pinnacle Roofing, in 2009.
Porter noted the clock was ticking on the legal deadline for bringing indictments in the case. The statute of limitations on prosecution is Oct. 1, he said. On Wednesday, Porter said the consumer protection office had told him he would have a complete report on the investigation Thursday to enable him to prepare to bring the case to a grand jury.
The state officials are accusing the Alpharetta company of defrauding metro Atlanta residents of more than $366,000 in scams in which they were to replace or repair roofs damaged by hail, wind or other storm damage.
They are accused of targeting homeowners across Gwinnett, Cobb, Fulton, Clayton, Henry and Forsyth counties, but the bulk of those claims landed in Porters jurisdiction.
On Tuesday, officials arrested Scott Richard Knoll, of Michigan, who they said was the companys chief financial officer, and William Sisson, the operations manager.
Knoll participated in the scheme to defraud and deceive victims, said the affidavit for the arrest warrant. Knoll further assisted in the scheme by delaying customer refunds, lying about the purpose or reason for why a roof installation or refund could not occur.
The affidavit also named Terry Eugene Kiefer, 53, as a co-defendant. Kiefers company National Storm Management owns Pinnacle Roofing, the affidavit said. Tax liens show addresses for Kiefer and his companies ranging in states across the country from Florida to Arizona, according to a Nexis background check.
The Governors Office of Consumer Protection said in a statement to Channel 2 that it was a complicated case.

The death of an eastern Iowa child has turned into a reminder of how quickly accidents can happen.
Carter McOmber, 3, of Cedar Falls accidentally fell 20 feet out of his bedroom window.
The Executive Director of the National Association for Child Window Safety Jim Graham said it's not uncommon.
In fact, he said about 5,000 kids die every year after falling from a window.
That's why Graham reached out to Lansing Housing Products to come up with a solution.
Together, along with other experts in the field, they designed a window screen with the purpose of not only keeping insects out of the home, but preventing children from falling out.
Brian Houlihan, president of Lansing Housing Products, helped create the Tough Tek Metal Screen, designed to withstand 25 pounds of force.
"The common homeowner has no idea this product exists," said Houlihan.
Houlihan has talked with families who have lost a child from a window fall.

The new unit is being installed by Magic Touch Mechanical, Inc., a Mesa, AZ based company that provides HVAC and Energy Efficiency Audit services to homeowners.
We are one of the companies taking part in Project Cool Aid a program started by the Arizona Chapter of the Air Conditioning Contractors of America ten years ago, said Magic Touch owner Rich Morgan.
We are donating the labor, the cost of the crane and supplying some of the materials needed, and there are a few other companies participating as well, says Morgan.
Goodman/Daikin, an AC manufacturer, is donating the equipment and The Metal Shop of Mesa, AZ donated the sheet metal needed. Other donors including RE Michel a cooling and heating materials supplier chipped in other materials needed for Magic Touch to complete the install for Mrs. Simpson.
Phoenix Mayor, Greg Stanton who recommended Mrs. Simpson be considered for the Project Cool Aid Program, will be on-site for the installation and praises all those involved for giving back to their community and especially to those who need it most.
Its a great feeling when you can help someone like Mrs. Simpson. She is such a sweet and grateful woman and Im glad we can help. It takes a lot of generous people to make this happen and Im proud to call them friends said Morgan.

When I talk about my kitchen remodel, which I've done endlessly this year, people confess they want a new kitchen, too, and ask how much mine cost.
The answer: about $22,000.
That's not even close to the $54,394 listed by Remodeling.com's 2014 Cost vs. Value report for a midrange kitchen remodel in Denver. An upscale kitchen? Figure $109,127.

My 18-by-9-foot kitchen, in a 35-year-old suburban house, required no major demolition or structural work. It features flat-pack Ikea cabinets that I assembled, closeout appliances, Formica countertops and laminate flooring.
And it's so pretty, so functional and so much better than what it replaced that I could sit right down in the middle of the fake acacia floor and weep.
Budget is the elephant in the remodel room, according to Kelly Morrisseau, a California master kitchen designer and author of "Kelly's Kitchen Sync" (Springline Media, 2011), a guide to the nuts and bolts of remodeling, and an e-book, "Kelly's Kitchen Savvy: Solutions for Partial Kitchen Remodels."
What drives designers nuts, she says, are clients who make their wish lists with no idea of how much things cost and then complain that her plan is too expensive.
There's no shame in scaled-back designs or a modest budget, Morrisseau says. "None of us will think badly because it wasn't what you wanted to spend; we all have the same choices to make ourselves. Our goal is to find something you like."
Design magazines and renovation TV shows don't help aspiring remodelers get a grip on reality, either.
