PITTSBURG -- City Council members gave tentative approval Monday to a development agreement for a long-delayed plan to transform an empty five-acre lot next to Pittsburg's civic center into a three-story commercial office building.
The project calls for Concord-based developer Garaventa Enterprises to erect a building between 65,000 and 75,000 square feet in size, a bicycle path, parking lot and a stand-alone full-service restaurant. The project is located next to a proposed eBART station at Highway 4 and Railroad Avenue.
Approval of the development agreement between the city and the developer clears the way for the office project to go through a formal approval process before construction begins. The agreement was approved by a 4-0 vote; Mayor Sal Evola recused himself because he is employed by Garaventa Enterprises.
The agreement calls for the project to be completed by September 2017, the same year that BART expects to finish the 10-mile eBART extension from the Pittsburg-Bay Point station to Hillcrest Avenue in Antioch.
"There is an increased interest in the office tower with several possible tenants, including but not limited to the Pittsburg Unified School District and other tenants that are becoming more aware of the hopefully coming eBART station" in Pittsburg, Assistant City Manager Garrett Evans said.
Ballots will be mailed in May to commercial property owners within a half-mile radius of the proposed eBART station in Pittsburg asking whether they would be willing to pay a one-time tax to help build the station, which does not have BART funding. The tax would be levied only when commercial property owners filed a building permit for new construction. The Civic Tower project would be among the properties subject to the tax if it is approved by a two-thirds majority.
The office project would bring revenue to the city and "also creates the opportunity for new jobs in the city and local community. ... We see this as a really positive move for the city," said Robert Hammons, project manager for Garaventa Enterprises.
Whether a restaurant will be included in the final project is undecided at this time, given that many new restaurants have opened in the city's nearby Old Town on Railroad Avenue in the past few years.
Monday's vote followed a recommendation by the Planning Commission to approve the development agreement. The matter will come back for formal approval at the May 5 council meeting.
Five years ago, council members, acting as the city's redevelopment agency, approved a similar agreement for a three-story building that involved giving the city-owned land to Garaventa Enterprises in exchange for developing it under the terms of the agreement.

Repairs and other improvements estimated to cost $3.6 million will be made to Oswego School District buildings and facilities later this year.
School district board members authorized school administrators Monday evening to seek bids for the work on 13 projects estimated to cost just over $3.6 million.
The 13 items were culled by Superintendent Dr. Matthew Wendt from a list of 17 items prepared by school officials earlier this month and presented to board members at their March 31 board meeting.
The original list was prioritized in March by members of the Citizens Advisory Facility and Planning Committee and presented to the board for discussion.
Wendt said he and other staff members reviewed the committee recommendations and made some changes so they could lower the cost and have the most needed repairs done.
The original list included repairs, upgrades and replacements in schools, buildings, and other areas in the district estimated at $7.8 million by Mike Barr, director of facility construction and development; Bill Baumann, director of operations; and Pat Dacy, assistant director of facility construction and development. They conducted an evaluation of all property in the district, which was submitted to the committee for review and recommendation.
The three toured each building and met with the administrators and building engineers at each school, to survey their conditions.
They also received assistance from engineers, architects, and contractors in preparing a list of major needs and concerns for each building.
The 13 projects left on the final list that the district will seek bids for include replacing the chiller at The Wheatlands Elementary School, 2290 Barrington Drive West, Aurora. This unit provides chilled water to the HVAC systems throughout the building and is a backup to the existing boiler chiller. The cost is estimated to be $625,000, and would take 10 weeks to complete.
The chiller at Fox Chase Elementary School at 260 Fox Chase Drive North, Oswego, will be replaced with a high efficiency oil-free centrifugal chiller at a cost of $450,000. It will take 10 weeks to complete.

Businesses cutting trees in Dorchester County will now have the option to pay for the county to replace them rather than doing it themselves.
Dorchester County Council unanimously approved a "Fee in Lieu of Planting Trees Requirement for Mitigation" ordinance at its meeting Monday.
The fee will allow businesses an alternative method for mitigating tree removal during the construction process. And it will give the county some leeway in where to replant trees.
Previously, if a property developer cut down a protected tree during construction he was required to replant a tree on the property as mitigation.
The motion to adopt the fee was one of three changes in the county's tree protection policy.
At the April 7 council meeting, the Planning, Development and Building Committee voted to amend the current Zoning and Land Development Standards section under the Tree and Canopy Protection Standards, to loosen restrictions on single family residences and tighten restrictions on developers.
As a part of changing developers' restrictions, the updated ordinance implements a new "tree bank" system as part of its Tree Planting Plan.
According to the plan, when a developer cuts down a protected tree and does not replant as mitigation, the developer will be charged a fee. The fees will be deposited into the tree bank account to be used only for replacing trees in public county spaces.
Protected trees are 15 inches or greater in diameter at breast height.
