NORFOLK, Va. (WAVY) - The City of Norfolk filed a lawsuit against former Norfolk plumber Andy Zoby.

Zoby's about to serve 15 months for giving bribes to Norfolk plumbing supervisors.

In an unrelated matter, the City made a mistake and overpaid Zoby for work on the Town Point Park Water Fountain Project, before it came to light that the bribery scandal was ongoing at Norfolk City Hall. The invoice requesting repayment is dated May 16, 2012. The City made the mistake, but Zoby has refused to give back the money and that's why the city is taking him to court.

The City is fighting to get back the $4,000 overpayment. The case will be heard in September.

It will be interesting to see how the case plays out because in September Zoby should be in the custody of federal authorities serving time for offering bribes.
