Exposed wire in garage ceiling should be covered - October 12, 2014 by Mr HomeBuilder

    ........................................................................................................................................................................................

DEAR BARRY: In some of your articles, you advise people to hire home inspectors who have errors and omissions insurance (E&O).

Ive been a home inspector for 15 years and have avoided E&O insurance for four important reasons: 1) Insurance does not prove that a home inspector is qualified; 2) Insurance covers the inspector if he is sued, but it does not insure the homebuyer against financial loss for an undisclosed defect; 3) If a home inspector does his job well, he doesnt need insurance; 4) Having insurance attracts frivolous lawsuits. What do you think about these objections? Jeff

Dear Jeff: Regarding errors and omissions insurance, there are two schools of thought among home inspectors, and both have some merit. In response to your four arguments against E&O, here are some points and counterpoints:

On two of your points, we can agree: E&O insurance is not essential to every home inspection company, and E&O coverage does not indicate whether a home inspector is truly qualified.

In fact, some of the best home inspectors work without insurance for one of the very points that you made: namely, that insurance can be a magnet for baseless lawsuits.

As most people know, we live in a litigious business climate in which attorneys name as many defendants as possible in order to get as many settlements as possible. The deep pockets provided by an insurance company can definitely attract that kind of trouble.

On the other hand, frivolous lawsuits can be filed against a home inspector, even when there is no E&O insurance. Case in point: There was an ongoing lawsuit against a termite inspector for failure to disclose damaged wood in a home.

The plaintiffs attorney decided to name the home inspector in the suit. The home inspector, by law, was not required to disclose termites, so there was no basis for the complaint against him.

Nevertheless, he had to hire an attorney and eventually settled for thousands of dollars. With E&O insurance, he would have paid the deductible and walked away from the problem.

Home Security Camera Video Shows Deadly Police-Involved Shooting - October 12, 2014 by Mr HomeBuilder

By Glenn McEntyre Saturday October 11, 2014 11:00 PM UPDATED: Saturday October 11, 2014 11:33 PM

Home security camera video captured the confrontation between Columbus police and robbery suspects that left two people dead.

The video emerged Saturday as police released new information on the deadly confrontation.

Police said the incident started with an armed robbery Friday night at the Dollar General store on Alum Creek Drive. Police confronted and killed two of the suspects as they were trying to get away.

They are withholding the names of the two people killed by officers while they notify their families. Officers have identified the two suspects in custody as 20 year old Aarin Clinkscale and 17 year old Savon Dearmond.

Security camera video obtained by 10tv shows the suspect vehicle parking on Greenery Drive, one block away from the Dollar General store. Two figures get out of the car, and walk away. The car then pulls forward, turns around, and re-parks across the street. Approximately five minutes later, the video shows two figures returning to the car. They walk just past it, then turn around and appear to get in the back seat. Before the car door is pulled closed, police move in from behind and in front, penning in the suspects' vehicle. Officers emerge from their vehicles, the back door of the suspects' vehicle opens, and a suspect runs toward the rear of the car. He suddenly drops to the ground, presumably the moment he was shot by police.

The shooting happened just outside Sharon Prilaman's home. She and her 9 year old son were in their living room when she said they first heard intense yelling. "My son went to go to the window. I said, 'Bobby get away from the window! Something could be going on.' And by the time I go to get up, I hear buh-boom buh-boom boom-boom. I immediately grab my son, pull him to the floor. I got over top of him. We crawled to the bathroom." said Prilaman.

She called 911, and the operator told her police were on the scene.

That's because they had staked out the store after a series of hold-ups at Dollar Generals. They were already in place when they said the suspects held employees and customers at gunpoint. And when the suspects tried to escape, they were surrounded.

Prilaman saw one of the bodies lying in the street covered with a sheet. "It's just heartbreaking and it's sad and you wonder, what made them do this? What made them go this way? Why?" Prilaman asked.

Handyman installing a wood stove - October 12, 2014 by Mr HomeBuilder

    Q. We bought a small wood-burning stove and had it installed in our family room with pipes coming out the top and running up to the roof. This was more than 10 years ago. About five years ago, my husband thought the stove was not big enough and bought a larger one to replace it that had its own pipes. The old stove and the pipes have been sitting in our basement ever since. The other day, my son mentioned that maybe he could take the old stove and install it in his fireplace. Is this something that can be done by a DIYer? What does he have to do to prepare?

    A. There are two important rules concerning wood-burning stoves, whether they are freestanding or in a fireplace: 1. They need stainless-steel chimneys, or when inside a fireplace, a stainless-steel flue liner. 2. When a chimney or flue liner goes through a ceiling into the attic, out through the roof, it must be fully insulated against fire.

Also, a freestanding stove should be at least 3 feet away from a standard exterior or interior wall. If the stove is closer, it must have an asbestos or other heat-proof barrier between it and the wall.

Your son can install such a stove in the house, but I suggest he consult a heating expert.

According to the state Department of Fire Services: A building permit must be obtained prior to the installation of fireplaces, wood, or coal burning stoves. They must be inspected by the local building inspector prior to their initial use as required by the Massachusetts State Building Code.

GROWING GREEN: Beware of garden thugs - October 12, 2014 by Mr HomeBuilder

Ive never met a gardener who hasnt planted something that at first sight looked innocent and pretty and later lived to regret it. It neednt have been something big like giant hog weed or a Norway maple, either. Many plants become invasive by root runners or self-seeding. They choke out the plants we want and can take over entire swatches of a garden. Some, like garlic mustard and purple loosestrife, endanger our woods and wetlands. In my garden, I have a tiny ground hugging sedum that blooms yellow in late spring. It was here when we bought the house and served its purpose in a newly planted garden around our pond. It has insinuated itself into the creeping thyme, ajuga and iris as well as every other nook and cranny it can find. There are other culprits to avoid, many of them ground covers: English ivy, houttuynia, periwinkle, ribbon grass, goutweed to name a few. Plant wild strawberry, wild ginger, wintergreen, mayapple or foamflower (tiarella cordifolia) instead. Grasses are all the rage now. But buyer beware as some such as miscanthus sinensis are invasive, spreading by seed and rhizomes. Ive found oat grass, as lovely as it is when its seed heads are swaying in the autumn breeze, has worked its way into places it shouldnt be and is a pain to dig out. There are many great alternatives out there, so do your research. When plant shopping, always read the plant labels carefully. Lastly, beware of gardeners bearing gifts of plants that they have an abundance of! Growing Green is a regular feature prepared by the Mount Hamilton Horticultural Society (gardenontario.org/site.php/mhhs). Helen MacPherson, vice-president of the society, wrote this report.
