    Lumber Liquidators 'Stands by Every Plank.' Should You? - March 3, 2015 by Mr HomeBuilder

    Allegedly tainted flooring has left Lumber Liquidators customers feeling as if the rug has been pulled out from under them.

    A CBS '60 Minutes' report Sunday said some of the company's Chinese-made laminate floorboards contained unsafe levels of formaldehyde, a known carcinogen. Lumber Liquidators said Monday that it "stands by every plank" of its flooring and that '60 Minutes' used an improper testing method.

    Caught in the middle are potentially thousands of consumers, who can't decide whether their flooring is safe, or they should have it ripped out and replaced, a costly proposition.

    Many consumers took to the company's Facebook and Twitter accounts with questions and concerns. "Formaldehyde is present in certain LL products and for those products, the levels are safe," Lumber Liquidators said in response to a customer's query on Twitter.

    "Testing cited by 60 Minutes is not right," it said in response to another.

    When asked for additional detail, a spokesman referred to an earlier statement that said, "Some of the testing cited by 60 Minutes was conducted based on sample preparation methods that have not been independently verified by an accredited standards organization and do not reflect the manner in which the product will be used in the home."

    Some of the data cited by CBS came from Global Community Monitor, an environmental nonprofit that filed suit against Lumber Liquidators over its formaldehyde levels. Its suit said that all of the Chinese-manufactured samples it had tested exceeded formaldehyde limits, and that tests were conducted "using a variety of different methodologies, and different samples with different sample preparations and surfaces covered to understand exposures both during and after installation."

    CBS said the testing it had performed on behalf of '60 Minutes' followed the protocol set by the state of California. That state's formaldehyde regulations, known as CARB 2, are the strictest in the country and will be mirrored by nationwide regulations expected to go into place this year. CBS also had the labs administer the California Department of Public Health test, which measures the concentration of formaldehyde off-gassing from the laminates.

    To test the floorboards for CARB compliance, the outer layer or layers of material such as veneer are removed to expose the core, which is where formaldehyde-containing glue would be used.

    MORRISON, Colo. (CBS4) An investigation by 60 Minutes found the countrys largest seller of hardwood flooring may be using products that dont meet health and safety standards. Some of Lumber Liquidators cheaper laminate flooring contains high levels of formaldehyde, a known cancer-causing chemical.

    Dr. Philip Landrigan, of NYsMt. Sinai Hospital explained,Its not a safe level. Its a level that the US EPAcalls polluted indoor conditions.

    Those laminate floor pieces were being installed into Gerry Smiths home in Morrison, but now her contractor has stopped the job before its finished due to health and liability concerns.

    Were re-doing all the carpet that was in the home, said contractor John Guinn, and theres about 1100 square feet of this laminate flooring. Its a project that would ordinarily take three weeks to finish.

    Smith bought the flooring from lumber liquidators, cost wise, it was perfect. I got it on sale.

    But two weeks in, things are at a standstill because the laminate flooring pieces may be highly toxic.

    My first concern is liability with the homeowner. My liability issue. What am I liable for? said Guinn.

    Using hidden cameras, 60 Minutes investigators went to three Chinese mills that make laminate flooring for Lumber Liquidators.

    Employees openly admitted their laminates are not compliant with health and safety standards.Employees also admitted they falsely label boxes, like those now sitting in Smiths living room.

    UNL leaders closing in on architecture, fine arts merger - March 3, 2015 by Mr HomeBuilder

    The University of Nebraska-Lincoln is engaging Lincoln architects and preparing for a merger between the College of Architecture and the Hixon-Lied College of Fine and Performing Arts.

    Chancellor Harvey Perlman met with three dozen Lincoln architects last week to lay out UNLs vision for the proposed merger, which would result in the Hixson-Lied College of the Arts and Architecture.

    The meeting comes more than a year after Perlman first proposed merging the two colleges into one academic unit led by Charles OConnor, the current dean of the fine arts college.

    Perlman said the merger would combine two of UNLs smallest colleges to create a larger and more diverse college teaching industrial, environmental, architectural, visual and interactive design. The College of Architecture enrolled 490 students last fall; the College of Fine and Performing Arts had 807 students.

    Regent Tim Clare of Lincoln said he's undecided on the merger at this time, but praised UNL for creating a forum with Lincoln architects to discuss the proposal.

    We want to do whats best for the students, and to do that first we have to clear up any misunderstandings, Clare said. I think it was good foresight by (Perlman) to get out and address these issues, and for the architecture firms to hear straight from the horses mouth what the universitys plan is.

    Clare said Lincolns architects -- nearly 40 attended the meeting last week along with NU Provost Susan Fritz and a few students -- will likely have another opportunity to meet with UNL leaders before the proposal goes before the full Board of Regents.

    The regents Academic Affairs Committee has discussed the proposal, and two UNL groups have given the merger their support.

    The Academic Planning Committee and the Association of Students of the University of Nebraska both approved the proposal, UNL spokesman Steve Smith said.

    The Board of Regents will likely consider the merger at its April 10 meeting, but UNL is moving ahead with personnel decisions.

    CHICAGORetail development has hit its highest level since 2010. To meet the increased demand for retail project management JLL has just expanded its retail team by adding Bill Moston, a 30-year veteran, as senior vice president, national retail development. In his new role, the Chicago-based Moston will advise JLLs clients and execute ground-up retail projects, redevelopments and renovations across the US, as well as manage anchor store negotiations and tenant coordination.

    Adding Bill to our development team will allow JLL to better advise its clients seeking to update or create new retail space, says Larry Jensen, senior director of retail development at JLL. His experience counseling and partnering with owners and investors on how to best align projects with market demand and retailer requirements will provide a huge advantage to JLLs clients.

    According to JLL research, nearly 50 million square feet of retail spaces were delivered in 2014 with general retail space, including the construction of urban storefronts, driving the market. Mall construction has also grown significantly, with total US deliveries in 2014 rising nearly 43% year-over-year.

    Shopping center owners and investors held off updating their centers during the downturn, but now were finally seeing these assets getting capital allocated for renovations or expansions, says Moston. I am thrilled to join JLL and look forward to growing the retail development business, and partnering with owners on their development and construction needs during this exciting time for the retail industry.

    Moston started his career in retail at the Homart Development Co., and then led regional development and redevelopment teams for General Growth Properties for more than 10 years. In 2006, Moston jumped to the investment side of the business, and spent time at the Archon Group, a Goldman Sachs Co., where he sourced and developed retail investment opportunities.     MASON CITY | The City Council will hear a presentation Tuesday night on a proposed downtown redevelopment project that includes a hotel,an ice arena/multi-purpose center that would occupy the space in Southbridge Mall being vacated by JC Penney, aperforming arts pavilion, parking ramp, apartments and retail space.

    The city is expected to file a pre-application for money funded through the Iowa Reinvestment Act.

    Here are answers to some frequently asked questions about the project.

    Q: What is the total cost of the project and who is paying for what?

    A:The total cost is estimated at $30.65 million. Here is how it is divided:

    Marriott hotel: Private investment of $10 million by G8 Development, San Diego.

    Parking ramp: $4.5 million. It would be owned and operated by the city with spaces for 200 to 250 vehicles. Of these, 110 would be leased to the hotel for use by employees and hotel guests. The remainder would be available to the public. Construction would be primarily funded through the tax increment financing district.

    Apartments/retail building: $2.5 million. Private investment (G8).

    Performing Arts Pavilion: $1.65 million. A citizens committee has raised $191,000. Additional private funding is being sought.

    Ice arena/multi-purpose center: $12 million. The Mason City Youth Hockey Association has pledged up to $2 million in cash and equipment. Other funding sources include Reinvestment District revenues, $4.8 million; Local Option Sales Tax revenues, $1.2 million; tax increment financing, $3.5 million; and Cerro Gordo County, $500,000.

    Caribou Coffee, Einstein Bros Bagel hybrid to open in Mason City - March 3, 2015 by Mr HomeBuilder

    MASON CITY | A co-branded Caribou Coffee will likely open by the end of this year as a part of the Hampton Inn & Suites project in Mason City.

    Kinseth Hospitality said on Monday Caribou Coffee is a confirmed tenant in the retail portion of the project. It will be co-branded with Einstein Bros. Bagels, whose menu include a variety of bagels, sandwiches, salads and soups.

    "We think that's an exciting thing," said Gary Kinseth, vice president of the North Liberty company.

    Kinseth Hospitality, which owns 70 hotels in the upper Midwest, announced last year that it would be tearing down the Clarion Inn and replacing it with a Hampton Inn & Suites, retail space and a housing project.

    Outside demolition of the Clarion Inn is expected to begin on Tuesday or Wednesday with construction of the new hotel and retail space to begin as soon as the weather permits this spring, Kinseth said.

    The retail space, featuring two tenants, will be built along the frontage road with the hotel behind it.

    Les Kinseth, president, said the company continues to search for a tenant for the other part of the retail space, which will include a fast-casual restaurant.

    The company expects the retail building to be completed around September and said Caribou Coffee hopes to open in December.

    The 83-room Hampton Inn & Suites is expected to be completed by spring 2016, with the housing development built within four years, according to a development agreement with the city of Mason City.

    Labor Secretary Tom Perez was the name bouncing around Latino political circles as a candidate who could replace Sen. Barbara Mikulski, D-Md.

    Mikulski said Monday she would not run for re-election to the seat she has held since she was elected to it in 1986. Her current term runs through January 2017 and she plans to serve out the term.

    It's early and would mean departing his Cabinet job, but Perez was the first name that came to mind for a few Latino political leaders asked about Latinos who could run for her seat. Others said a bid for the Maryland governor's office in 2018 was a greater possibility for him.

    "Secretary Perez has an exceptional record of serving the people of Maryland, as a member of the Montgomery County Council and as (Maryland) Secretary of Labor," said Arturo Vargas, executive director of National Association of Latino and Elected Officials. "He has continued that service to the American people at the federal level, at the U.S. Department of Justice and now as (U.S.) Secretary of Labor."

    Perez also taught law at University of Maryland and lives in the state.

    Perez's office praised Mikulski in a statement but was not ready to talk about his interest in the seat.

    Sen. Barbara Boxer, D-Calif., also recently announced her retirement, leading Latino groups to push for a Latino candidate to be considered by Democratic party officials for her seat. But the leading potential candidate Antonio Villaraigosa, former Los Angeles mayor, has said he won't run.
