    Comcast-Time Warner Cable Gets Murky With Stalled FCC Decision - March 26, 2015 by Mr HomeBuilder

    SAN DIEGO ( TheStreet) -- Just when it seemed the decks might get cleared for a decision on Comcast's (CMCSA - Get Report) ambitious plans to merge with Time Warner Cable (TWC), a delay in the regulatory process has thrown doubt on the $45 billiondeal that would combine the largest and second-largest U.S. pay-TV operators.

    Comcast, in a blog postsigned by top executiveDavid Cohen, said it doesn't expect the Federal Communications Commission to make a decision on the merger proposal until mid-year. The announcement appeared to point to an increasingtug-of-war between the agency and the companies. The delay comesafter many industry observers concluded that regulators were more likely to acceptthe deal after the FCC approved rules mandating net neutrality, which had the high-profile backing ofPresident Obama.

    But with each passing day, the outlook becomes less. For Comcast and Time Warner Cable, the elongated process, which began in February 2014, that the FCC will demandmore concessions from the company, particularlyto prevent Comcast, which owns NBC/Universal other pay-TV channels, from favoring their content over competitor networks.

    Matthew Harrigan, media analyst at Wunderlich Securities, who expects that the FCC will eventually approve the deal, acknowledged that "intense consumer/political resistance" has become a darkening cloud over a deal that seemed to have gained strength a month ago following the net neutrality order.

    Complicating matters, the FCC appears to have heightened scrutiny on how these two pay-TV providersdo business with the networks they carry. The commission is currently waiting for a US Federal Appeals Court decision on whether third-parties can review video-programming contracts between content providers. One case in particular has stood, said Yong, citing Comcast's contracts with Viacom VIAB and Discovery DISCA.

    The delay in the deal approval may also play into Discovery's hands, Yong said in an investor note, explaining that its carriage deal with Comcast comes up for renewal at the end of June. "If the merger closes, this could give [Discovery] management more leverage to negotiate better terms," Yong said.

    Questions about how the deal will conclude have raised the profile of Charter Communications, which attempted to secure a deal with Time Warner Cable but was outmaneuvered by Comcast. That could make Time Warner Cable more attractive to investors if it goes back in play as a takeover candidate. Charter has financing at the ready to make another bid for the company if the deal with Comcast falls through, Antlitz said.

    Despite the drawn-out review process, senior analyst Marci Ryvicker with Wells Fargo Securities in a research report said she remained confident of the merger deal and reiterated the outperform ratings for Comcast, Time Warner Cable and even Charter.

    What may come next is that the FCC requires Comcast to more readily make contentavailable from NBC-Universal forover-the-top platforms such as DISH's (DISH) Sling TV. DISH, for its part, has actively opposed the merger. Talks between Comcast and Apple, which is expected to unveilits own streaming video service in the fall, reportedly failed to come to an agreement on using NBC-Universal content.

    Jennifer Rose and Tony Powell feel Stephenville town council is being unreasonable in not granting them a permit to build on family land.

    A young Stephenville couple believes the towns council is being unreasonable in not approving a permit to build a home on their family land.

    Jennifer Rose and Tony Powell worked out of province, but decided to move home to work and live. But despite their best efforts and 14 months of trying, their latest attempt to get a permit was rejected.

    Mayor Tom OBrien said said the reasoning for not granting the permit is simple: There is no municipal water and sewer services to the property, and town regulations state those services are required. OBrien said there will be no development until a comprehensive plan is put into place, including the installation of water and sewer thats connected to the towns system.

    Rose said there are currently five homes on her familys property in the Hillier Avenue area. She said her family has three generations of farming and forestry on the property.

    It is completely unfair that council is refusing to let us build a home on our family land, she said.

    Rose said council insists they install municipal water and sewer, even for their single home. She said this is despite the fact all the existing homes are serviced by approved septic and wells, including one home owned by a town councillor.

    She said municipal water and sewer installation would cost more than $2 million out of their pockets something the couple cant afford.

    Rose said wells and septic systems on unserviced land must conform to provincial requirements, and the couple has the necessary government service centre inspection and approval.

    Norton Council discussing future pump station site - March 26, 2015 by Mr HomeBuilder

    Norton City Council is deliberating two possible sites for the future construction of a sanitary sewer pump station as the Nash Heights sanitary sewer project continues to unfold.

    However, members of Council are leaning toward having the pump station constructed at Shellhart Road as opposed to the other option, Golf Course Drive, both in the Nash Heights area. Council discussed the issue during the March 23 meeting.

    While Council members are delaying any action on the decision, they indicated a site selection of Golf Course Drive would be an added expense to the city (approximately $300,000) due to logistical issues with building the pump station there.

    If the pump station were built at the Shellhart Drive location, the city would still be able to extend lines and will face less financial issues, Council members said.

    Despite not approving the Shellhart location, Council did approve a $5,000 expenditure for soil boring to be taken in the area. That work will be done by Environmental Design Group and will determine water table data in the area.

    The project to install sewers in several areas of the city came in response to an Ohio Environmental Protection Agency (EPA) mandate to abate pollution and correct unsanitary conditions, particularly in the Nash Heights neighborhood.

    City Administrator Valerie Wax Carr said Council will pick a location within the next 30 days as the city tries to meet the specifications of the EPA mandate.

    Council President Rick Rodgers (Ward 1) also noted the city will work with the EPA to see if there is any relief for Nash Heights homeowners who have installed new septic systems on their properties in recent years.

    While Rodgers could not commit to saying that residents who have installed new systems would be exempt from tying into the public sewer system, he pledged Council will discuss the issue and get answers back to the community as soon as possible.

    Neighborhood concerns become an obstacle to Nye's redevelopment - March 26, 2015 by Mr HomeBuilder

    Neighborhood support for a plan to build a high-rise on the Nyes Polonaise restaurant site has stalled amid growing concerns over its impact on nearby buildings.

    Minneapolis-based developer Schafer Richardson, in partnership with Nyes owners Rob and Tony Jacobs, in December announced they would redevelop the popular restaurant and piano bar just north of downtown.

    They quickly won support from the neighborhood association for its 30-story glassy residential and retail tower, including a spendy effort to salvage two of the Nyes structures. But some neighbors, including members of a landmark church, thought the group acted too quickly.

    The pause button has essentially been hit, Barry Clegg, vice president of the Nicollet Island-East Bank Neighborhood Association, said Thursday.

    About 85 neighborhood residents appeared at the associations board meeting Wednesday night to discuss two grievances filed against the organization.

    Opponents have also petitioned the City of Minneapolis to conduct an environmental review of the site before the project moves forward. The association agreed to table its approval until that review is conducted, which could last four to five months.

    Maureen Michalski, senior project manager for Schafer Richardson, said the company has a reputation of engaging with communities to work through challenges.

    Its a complex project and we want to carefully consider the stakeholder interest, she said. There are so many different groups that are involved that have opinions that we really have to work through that process to come to some consensus.

    The grievances were filed in tandem with efforts by Our Lady of Lourdes Catholic Church, which is next door to Nyes, to slow down the process and conduct more due diligence.
