    Demolition continues at Richmond Hill - November 30, 2012 by Mr HomeBuilder

    INDIANAPOLIS -

    The demolition and clean-up continues in the Richmond Hill subdivision after the Nov. 10th explosion.

    Work began on Fieldfare Way, the epicenter of the blast that rocked the neighborhood and caused so much devastation.

    The Indianapolis Department of Code Enforcement says plans are moving ahead to tear down six houses this week. Three homes came down Tuesday and crews were completing the demolition process for those homes Wednesday.

    One of the demolished homes belonged to Abby Jackson, who came back Wednesday to claim a brick from the home she loved.

    "I just wanted to take a couple of things that my kids could maybe sign and then that'll be it," she said.

    Jackson says she has nine years of wonderful memories inside the home. Watching it being torn down has been both painful and therapeutic.

    "It's been hard. It's been closure but it's still hard. But every day, just moving on," she said.

    Jackson was home the night of the explosion but was able to get herself and her four children out safely. For that, she feels blessed.

    "I am more than thankful. I was protected by Jesus Christ that night," said Jackson.

    Judge dismisses case to stop demolition of City Hall - November 30, 2012 by Mr HomeBuilder

    A federal judge dismissed petitioner's case to prevent the demolition of City Hall to make way for a Triple-A baseball stadium, according to court records.

    Judge David Guaderrama ruled the case as dismissed with prejudice. Thecity of El Paso isworking on a response to the ruling.

    Former El Paso Mayor Ray Salazar, who was one of the plaintiffs in the case, has yet to be reached for comment.

    Salazar and two other plaintiffs were suing the city in an attempt to thwart the demolishingof City Hall and bring the decision to the voters.

    As KFOX14 previously reported, Guaderramaheard testimony Friday that lasted more than four and a half hours.

    Salazar and his lawyer want the demolition of City Hall to be stopped so that voters can determine the building's fate in May.

    Salazar and his team argued that the voters' rights are being ignored if a temporary stop to the demolition of City Hall is dismissed.

    The defendants, the city and Mountain Star Sports Group, had said they could not put a hold on demolishing City Hall.

    The city and Mountain Star officials said all the contracts have been signed and the city and Mountain Star stand to lose close to a half-million dollars in a year if the 2014 season is not held.

    City Hall is scheduled to be demolished in March.

    Demolition for park begins at Horton Plaza - November 30, 2012 by Mr HomeBuilder

    SAN DIEGO Work crews Thursday began demolishing the old Robinsons- May/Planet Hollywood building at Westfield Horton Plaza in downtown San Diego to make room for a new public park.

    Officials behind the $14 million project hope to create a 37,000-square- foot civic gathering space that will hold more than 200 events per year.

    The park will be bordered by Broadway to the north and the shopping center to the south, Broadway Circle to the west and Fourth Avenue to the east.

    This is going to be for our citizens, this is going to be for our tourists, this is going to be for all of us, Mayor-elect Bob Filner told several hundred people on hand for a special event to mark the beginning of demolition.

    Gary Smith, an advocate for downtown residents, said the areas population has ballooned from 7,000 a couple of decades ago to around 40,000 now, and they need activities.

    According to Westfield, which will manage the park and book the events, potential events include concerts, summer movie series, block parties, cultural festivals and holiday celebrations.

    The area had been looked upon as a kind of dead zone in the downtown area, used more by the homeless than shoppers. One downtown resident told the City Council last year that the area was an embarrassment.

    It has been apparent for quite some time that Horton Plaza Park needed a makeover, said Councilman Kevin Faulconer, who represents the area until council districts shift boundaries on Monday.

    The square must be restored to meet the needs of downtowns growing population and reclaim its historic role as a regional destination for San Diegans and future generations, he said.

    Outgoing Mayor Jerry Sanders said the park should provide an economic boost for the whole area.

    Swampscott demolition company ordered to pay $100,000 in civil penalties after improper asbestos removal - November 30, 2012 by Mr HomeBuilder

    A demolition company from Swampscott has been ordered to pay the Commonwealth $100,000 in civil penalties for the alleged improper removal and disposal of asbestos-containing waste at locations throughout eastern Massachusetts, including the Hook Lobster Company building on the Boston waterfront, Attorney General Martha Coakley announced today.

    According to the complaint, Total Dismantling and Carting Services, Inc., and its successor, The Total Group, Inc., both of Swampscott, violated the states Clean Air Act by repeatedly removing and disposing of asbestos-containing material without notifying the Department of Environmental Protection (MassDEP) that the work was going to occur. The Clean Air Act requires notifications to MassDEP to ensure that demolition and renovation companies are properly handling and disposing of asbestos.

    Companies are not permitted to risk public health, safety, or the environment by failing to properly handle asbestos or by failing to disclose when they are working at demolition sites that involve asbestos, AG Coakley said. It is especially important to take the proper precautions in a heavily traveled area like the Boston waterfront.

    MassDEP works to ensure that asbestos-containing materials are identified and properly removed, handled, packaged and stored in accordance with the regulations, said MassDEP Commissioner Kenneth Kimmell. Failure to follow the right procedures is an extremely serious oversight that potentially exposes workers and the general public to a known carcinogen and inevitably results in significant penalty exposure for the violator.

    The complaint also alleges that Total Dismantling and Carting Services and Removal Specialists demolished the former Hook Lobster Building in 2008 after it burned in a fire without removing all of the asbestos-containing material first and without notifying MassDEP that it was going to perform the work.

    Additionally, the company allegedly failed to use the proper containment procedures at the Hook Lobster demolition site and during transport to an unpermitted storage site in Revere.

    The consent judgment, approved in Suffolk Superior Court today, requires Total Dismantling and Carting Services Inc., and the Total Group to pay a civil penalty of $100,000 for their share of the violations involving the Hook site as well as violations at three other demolition sites in Saugus, Malden and Swampscott. Half of that amount in the settlement is suspended provided the companies comply with the judgment and commit no further violations during a 5-year probationary period.

    Assistant Attorney General Louis Dundin, of the AGs Environmental Protection Division, is representing the Commonwealth in the litigation.Attorney Colleen McConnell is handling the case for MassDEP, along with environmental analysts John MacAuley and Karen Golden-Smith of MassDEPs Northeast Regional Office.
