DECATUR, GA -- When Elizabeth Layburn gazes up from the lawn of her stepson's hundred year old home in Decatur -- she sees the graceful tree canopy that tree lovers across metro Atlanta want to preserve.
But she also sees individual trees that are less idyllic. "There's two huge oaks in the front. And this one here," Layburn said, gesturing upward, "is threatening to fall on the house."
Decatur has few restrictions now on homeowners who want to remove trees. The new ordinance, if approved, would require them to:
But some residents say it's an overreaction, fueled by what Frank Wynne calls "tree party politics."
"Additional layers of bureaucracy won't help me manage my property," said Wynne, a Decatur resident and real estate agent. "And I think we have an awfully impressive tree canopy as we speak."
Officials at Decatur City Hall conducted an online, unscientific poll about the tree ordinance. And those voting overwhelmingly voted against it.

The takedown of Conways 54-foot, artificial Christmas tree has begun.
In its first year in Rogers Plaza in downtown Conway, the tree was the center of controversy from its approval by city council to the variables surrounding its removal.
Get Lit, LLC, the trees manufacturer, informed city officials last week there would be no charge to take down the mammoth decoration after previously alerting officials, via a teleconference, that Conway would be responsible for its workers lodging, meals and labor. Further negotiations ironed out the details, and Conway was not required to pay any costs for the takedown.
This is Get Lit coming to Conway on its own dime, with its own staff to take [the tree] down, Chief Operations Officer Summer Hull said, who also pointed out the original contract did not call for Get Lit to remove the tree.
Upon removal, the $130,000 tree which featured non-working lights most of the holiday season will be sent back to Springdale for repairs, again at no cost to Conway.
Get Lit officials have blamed water and vandals for problems with the trees lights.
Although we believe that any electrical issues with the tree itself and the electrical supply to Rogers Plaza have been resolved, Get Lit will be bringing the tree back to its facility in Springdale for a thorough inspection and any necessary warranty repairs, Get Lit said in a Jan. 16 statement.
The company also said it would give Conway officials an opportunity to view the tree, in operation, before it is returned.
Get Lit will also be available to consult with the city on measures that can be taken in the future to prevent vandalism to the tree, the companys statement said.

DISCOVERY: An artist's impression of newly found seabird fossil Australornis lovei, believed to be one of the oldest flying seabirds in the world.
Canterbury was home to one of the oldest flying seabirds, as discovered by fossil hunters from Canterbury Museum.
Dr Paul Scofield, from the Canterbury Museum, and Dr Gerald Mayr, from the Senckenberg Research Institute and Natural History Museum in Frankfurt, published their findings this week in the Journal of the Royal Society of New Zealand.
Bones of the previously unknown species were found in 2009 in Waipara by Leigh Love, an amateur fossil collector from the region.
He heads out most weekends to look for fossils, and anything he cannot identify he turns over to museum staff.
Though Scofield had the fossil early on, it sat unexamined for several years while work was disrupted by earthquakes.
Once he had a chance to come back to it, Scofield said it was obvious the fossil was something extraordinary.
The new species,Australornis lovei, was named in recognition of Love's role in its discovery.
Scofield said the bird was estimated to have lived between 60.5 and 61.6 million years ago, based on the age of the surrounding deposits.

The Cowlitz County Health Department is revoking the septic pumping license of All-Out Sewer & Drain owner Ray Caldwell, who was convicted last month of 33 federal felonies.
According to a Jan. 16 letter the health department sent Caldwell, the Longview businessman no longer will be allowed to operate or participate in any business involved with pumping sewage or performing inspections or maintenance of septic systems within Cowlitz County.
The Health Department considers this to be a permanent revocation, states the letter, signed by County Health Officer Jennifer Vines and County Health Administrator Carlos Carreon. This determination has been made subsequent to the finding of guilty in United States District Court.
The evidence presented in the federal case demonstrate intentional and/or willful malfeasance of, and serious repeated violations of county OSS (on-site sewage) pumper regulations, the letter states.
If Caldwell doesnt file an appeal within 30 days, his license will be revoked Feb. 15. Caldwell, reached at his business Tuesday, declined to comment.
Although he may lose his ability to pump septage in Cowlitz County, Caldwell does have customers in other counties, according to his courtroom testimony.
Last month, Longview Public Works Director Jeff Cameron declined to comment regarding All-Outs city general business license, which expires in May.
In mid-November, the county revoked the license of Caldwells business partner, Randy Dingus, who pleaded guilty to one felony count of violating the federal Clean Water Act. Dingus held a license as an operations and maintenance provider of septic systems, Bischoff said. He will be sentenced Jan. 27 for participating in the illegal dumping scheme.
On Dec. 16, U.S. District Court Judge Benjamin Settle found Caldwell guilty of all 33 counts he faced: 25 felony counts of violating the federal Clean Water Act, six counts of mail fraud and two counts of making false statements. He will be sentenced March 10.
Caldwell was accused of pumping septic waste from his collection trucks into the city sewer system on 25 different dates last year to avoid disposal fees of 10 to 25 cents per gallon. He also is accused of underreporting by hundreds of thousands of gallons the amount of septage he collected from customers.
