The Montvale Borough Council introduced an ordinance at its Jan. 14 meeting to establish a tree preservation section in its borough code.
The purpose, according to the ordinance, is to control and regulate the excessive removal and destruction of trees in the borough.
"I think it's a tremendous benefit to this community to not have the possibility for any clear-cutting, which has happened in Montvale recently," said Councilwoman Leah LaMonica, the liaison to the borough's tree ordinance committee.
Robert Hanrahan, chairman of Montvale's Tree Ordinance Committee, presented a draft ordinance last month that would protect against clear-cutting in the borough.
The ordinance - unanimously introduced by the governing body Tuesday - will place restrictions on the number of trees residents are permitted to cut down per year. According to the ordinance, single-family residential zones R-10, R-15 and R-40 may apply for a $35 permit to remove three, four and five trees, respectively. For each tree removed thereafter, the resident will have the option of paying $500 per tree or replacing it. Monies collected will go towards costs associated with tree replacement and planting within Montvale, the ordinance states.
Exemptions include trees located within a nursery, removal of trees which endanger public safety, and the removal or trimming of trees in a public right-of-way. The ordinance will be enforced by the enforcement officer, and any person in violation of the ordinance will be charged at least $2,000 per tree that is improperly removed.

LAKEVILLE A School Committee member spoke as a parent last week in advocating improvements to the George R. Austin Intermediate School pool and the school district's swim program.
"I'm before you as a supporter of the pool and a parent who has two kids in swim programs tonight for this part of the meeting," David Davenport said to his peers on the School Committee last week from the podium usually used by guest speakers.
Mr. Davenport's concern, as he explained, was a short but considerable list of capital improvements to the district pool that he and other swim program supporters say are in dire need of being addressed.
"There's a number of things that we could talk about that range from small on up to larger things but there's three things that we've identified that we really want to make a big effort to get taken care of at this time," Mr. Davenport said. Using visual aids via a PowerPoint presentation, he pointed out an area of damaged tiling on the deck around the pool, cautioning that such damage could cause people to trip.
"In fact at the edge of the pool at the coping if you slipped your hand between the tile and the coping where the adhesive has come loose, you could tear that tiling up by sheets," said Mr. Davenport, later adding that the deck is still the original work from when the pool was built in 1974. According to the presentation, the tiling repairs are projected at a cost of $18,000 - $20,000.
The other two capital improvements covered in the presentation were updating the chemistry system which handles chlorine mixture into the water and repairing or perhaps replacing altogether the ventilation system for the air around the indoor pool which is located at George R. Austin Intermediate School.
"It's antiquated," said district swim coach and aquatics director Bret Pacheco of the chemistry or chlorine management system. "It's a system that was a great design when it started and now " it doesn't quite efficiently put the chlorine in the water the way it's supposed to and it doesn't manage it as well as it should."
Regarding the ventilation system around the pool, Mr. Pacheco explained that the high presence of chlorine in the air makes it difficult for swimmers to breathe and can often be observed coughing at practices and events. "There are days when you're in there to watch your kid swim or whatnot and the chlorine odor is so strong that you just want to run out of there because the air system just isn't handling it," Mr. Davenport said of his own experience.

My former comrade Conrad de Quiros pronounces himself aghast at the medical condition of former President Gloria Arroyo (Opinion, 1/15/14). Nonetheless, he still wants her to stay behind barsbecause it is a matter of justice, a matter of crime and punishment.
Rest easy, old friend. If youre worried about justice being compromised by mercy in her case, consider the following factsall of them verifiable from the recordwhich only reinforce the presumption of innocence on her part that every accused person is entitled to by law:
1. The alleged evidence against Arroyo, in the PCSO funds plunder case under which she is currently detained, consists solely of her marginal notation OK on the funds-release document. The Ombudsman itself admitted that this was not irregular per se.
2. There is no shred of evidence that Arroyo appropriated even a single cent of those funds for herself. When asked if the prosecution had anything else apart from the OK notation, the sole witness against her, PCSO director Aleta Tolentino, had to admit: That is all we have, sir!
3. Arroyo was not involved in subsequent actions taken by the PCSO board and management to disburse those funds. Moreover, those disbursements were duly audited by the Commission on Audit and found to be compliant.
These are just some of the facts showing that Arroyos degree of participation in the alleged offense does not justify her detention without bail. The other consideration, extenuating circumstances, is addressed by a medical certificate last November from Dr. Antonio Sison, a spine surgery specialist at the Veterans Memorial Medical Center, who said in part:
Arroyo is suffering from cervical and lumbar pain with further deterioration of her poor physical health, which may cause serious impairment to her health and danger to her life, unless attended to promptly.
I know it grieves De Quiros to see Arroyos plight, which he says he would not wish to befall anyone, even her. But if he insists on rushing to judgment despite the facts mentioned above, then the tears that hes figuratively shedding for her will turn out to be nothing but: crocodile tears.

Created entirely out of sculpted ice and snow, the Frozen Suite is modeled after the two sister's bedrooms from the hit Disney animated film. The stay will also include time in a Frozen Activity Cave.
Frozen mania has taken hold for those wanting to delve deeper into the Disney story based on Hans Christian Andersens winter myth The Snow Queen.
Last month, Adventures by Disney announced a new Norway itinerary inspired by the film. CHICO -- After 18 months of construction, all systems are go to open B Street Oyster Co.
Downtown's newest restaurant has passed its fire inspection, light fixtures dangle over booth seats and chalkboards hang waiting for daily menus to be scribbled across their surfaces.
The last remaining step is final inspection for permit of occupancy. After a long battle with the city last year over the restaurant's liquor license, owner Will Brady was hoping for smooth sailing.
Instead, city officials notified him last week the fire escape option in building plans they approved last May and the design he built to was inadequate as planned. Left with no other options and significant investment in the new, nearly finished site, the only foreseeable option was to evict B Street Oyster's tenant, neighboring restaurant Thai Basil, to make way for a fire escape.
"We did not want to build our restaurant on the bones of another," Brady said. "A restaurant can't kill another restaurant to be a restaurant. That's just bad karma."
He filed an appeal of the city's ruling, and after a meeting at city hall on Wednesday afternoon, he was happy to report that a resolution took just one discussion instead of many.
He credited Building Official Nelson George and Community Development Director Mark Wolfe for working to find an agreeable option.
At issue was a secondary fire escape, which is required for restaurants of its size. The building code says the dispersal area for patrons and staff must be on the same lot as the business, which wasn't physically possible.
