    In a ruling from the U.S. District Court or the Central District of California dated February 15th, 2012 the action was dismissed as to defendant, WestPark Capital, Inc. because the Court concluded that the plaintiffs failed to state a claim for which relief could be granted. CIL was listed on the NYSE Amex exchange in connection with an IPO in June of 2010.

    Century Theatres to Open 10-Screen Complex at The Dunes on Monterey Bay

    MARINA, Calif.--(BUSINESS WIRE)--

    Shea Properties and Cinemark Holdings, Inc., parent company of Century Theatres, announced today a deal that will bring a state-of-the-art, 10-screen, digital cinema to the Dunes on Monterey Bay Shopping center in the City of Marina at Highway 1 and Imjin Parkway. The theater will kick off phase two of The Dunes on Monterey Bay that will also include specialty retail space and restaurant pads for lease. The second phase, called 10th Street, will eventually become the heart of the master-planned community with a village square that connects to the beach, neighborhood parks, and surrounding homes and retail.

    Kahn updates Malvern on E. King progress

    While Eli Kahn talked, the demolition equipment was already at work on East King Street. Malvern is moving forward that rapidly.

    Kahn is a local developer with a plan to transform Malvern Boroughs tired post-industrial east side into a vibrant residential and retail swath that he calls a walkable environment [and] a better environment to work in. On Wednesday morning he told a packed borough hall all about it at a Malvern Business and Professional Association meeting.

    Kahn, who said he had gotten the idea 12 years ago, called East King the largest construction project ever in the borough, a five-year venture that in 18 months will produce 25,000 sq. feet of retail space with quality residential space planned above it along with expanded parking under and outside.

    Kahns announcement that the Whip Tavern, a traditional English pub located in Unionville, is planning to open its second location on East King seemed to draw the interest of the crowd as much as any other detail. Kahn said he was close with a few other spots, which he could not yet name, but that one would be a spectacular addition.

    I think the retail will fill in quite nicely, Kahn said.

    Demolition of buildings from the Malvern Design Center east to Rusticraft Fence Co., just into Willistown Township, should be complete by next Friday, Kahn said. With all construction contracts signed, storm-water management on the Willistown side will head the list of projects with excavation, foundation pours and the lower-level parking structure following shortly. Bozzuto Construction of Baltimore will do the work.

    The project will also include a 5,000 sq. foot office building.

    Kahn praised the newly refurbished Malvern train station area with its improved parking arrangement as spectacular, and said that it made Malvern accessible for businesses.

    In answer to a question, Kahn said that he will be creating a lot of parking on the north side of King, with 17 to 20 parallel parking spaces planned along with 10- to 20-foot-wide sidewalks. Answering another question, he said the faade will be varied in appearance and in the materials used -- brick, stucco, stone -- to give the long building front the feel of individual buildings.

    Historic lifeboat returned home

    A historic lifeboat which has been lying derelict in Conwy harbour is to return home to Norfolk for restoration.

    The Edward Birkbeck was built around 1896, and was the lifeboat at Winterton-on-Sea until 1925.

    Detective work by Conwy's harbourmaster has led to it heading home to East Anglia, where it was the village lifeboat until 1925, making 94 rescues.

    The vessel was being loaded onto a lorry to be transported overland on Thursday.

    The village church in Winterton-on-Sea has a plaque in the Fisherman's Corner recording the lifeboat's many live-saving successes.

    The old Norfolk family names of the original crews are still well known locally and a team of volunteers are ready to help restore the vessel.

    The Edward Birkbeck is set for eventual display as part of the village's maritime heritage.

    The vessel had faced being broken up for scrap after Conwy's acting harbourmaster Barry Tuson issued a notice in November 2011 that he considered it abandoned and causing an obstruction.

    But after learning of its former links to Winterton-on-Sea, he contacted the parish council there to let the village know of its existence.

    Buffalo Grove living room given a ‘vintage’ update

    When Jerry and Sarah Stempel remodeled the living room in their Buffalo Grove home, they aimed at what you might call a vintage look.

    Enter their two-story house tucked away on a cul-de-sac in the Old Farm Village subdivision and you will likely be greeted by the couples two dogs, Bailey and Cooper. You will also be struck by the distinctive look of the living room.

    Amid the comfortable furnishings, which include a couch, a piano and a big-screen television, are walls lined with shelves, each filled with dozens of bottles of wine tipped on their sides.

    The handsome makeover is the work of interior designer Lori Abrams, who fulfilled the need expressed by the Stempels to not only have a central location to display their wine collection, but also one where their family which includes three children as well as the two dogs could entertain.

    They love wine. They love to entertain and really wanted to showcase their wine, Abrams said.

    Before Abrams was brought in to lead the remodeling project, the couples wine was stored everywhere in the four-bedroom, 2,200-square-foot home.

    Wine bottles were in any kind of cabinets they could find, all over the house, Abrams said.

    What she devised was a system that would allow people the most room to use the space, as well as attractively showcase the collection. For the project, which also involved rebuilding an adjacent staircase, Abrams and the Stempels utilized salvaged wood on beams and countertops.

    Sarah Stempel said Abrams found a great craftsman, cabinetmaker Craig Stancy, who really took all of our suggestions and worked with us.

    The wood used for the majority of the room, including the shelving and cabinetry, is knotty alder. The countertops are made of rustic pine timbers, and the room is wrapped in knotty alder wainscoting.

    Criss turns down X Factor stint?

    Darren Criss was reportedly offered the chance to host the US X Factor - but turned it down.

    E! News claims that the Glee actor, best known for playing Blaine, was given the opportunity to step into Steve Jones' shoes for the show's forthcoming second series, but "politely declined the gig".

    "They were after him. But there's no way he could have done it with everything he has going on," a source said.

    Darren - who made his debut on Broadway by taking over from Daniel Radcliffe in the Broadway production of award-winning musical How To Succeed In Business Without Really Trying for three weeks - is rumoured to have decided to pass on the role because of his busy schedule, although his spokesperson nor US TV network Fox have not commented on the story.

    As well as his continuing role on Glee, Darren is set to make his big-screen debut in Imogene alongside Kristen Wiig and Annette Bening.

    Welshman Steve was axed from the US X Factor alongside judges Paula Abdul and Nicole Scherzinger, but TV mogul Simon Cowell has not yet revealed who the new additions will be.

    Astor Pl. ‘trophy office building’ angling for early ’13 completion

    BY LINCOLN ANDERSON | With the last remnants of The Cooper Unions old Engineering Building finally demolished, construction is moving ahead on its far glitzier replacement.

    Edward J. Minskoff Equities Inc. is developing a 400,000-square-foot office building at 51 Astor Place on a design by Fumihiko Maki.

    Influenced by the sites triangular shape, the new edifice will feature a geometric design, sporting a sharply angled glass facade.

    In January, Minskoff closed on a $165 million construction loan.

    Jones Lang LaSalle will market and lease the 12-story structure, which a Minskoff press release touted as a trophy office building.

    According to the release, not only will 51 Astor Place have advanced technology and infrastructure, but will also provide tenants with above-standard electricalpower and generator capacity.

    Located at Astor Place and Third Ave., 51 Astor Place is expected to be completed by early next year.

    The building will be constructed to achieve LEED (Leadership in Energy and Environmental Design) Gold certification.

    Amenities at 51 Astor Place will include a tenant-accessible green roof on the fifth floor, a penthouse and aThomas Basely-designed urban plaza at Astor Place.

    County to pursue idea of consolidated office building

    County leaders voted Tuesday to move forward with a non-binding agreement that will allow them to pursue construction of a new consolidated office building in Bishop. The agreement the Board of Supervisors signed with Joseph Enterprises Tuesday is a term sheet that outlines all necessary steps and a time line that must be completed before the county can build a new, 4,200 square-foot consolidated office facility. The term sheet is non-binding, which means the county has the right and ability to stop negotiations up until the lease agreement for the new building is signed. With the term sheet in place, Inyo County and Joseph Enterprises can begin working on a site plan and design for the property, located just north of Bishop on U.S. 6, and work on preliminary specifications and costs for the project. County staff will also conduct a thorough space needs analysis and develop a final concept plan that will determine what departments will be located in the new facility. Until the final cost and site plans are approved, and the lease is executed, Inyo County reserves the right to back out of the agreement. Before signing the term sheet this week, the Board of Supervisors reviewed an analysis of potential savings, to see if there is any chance that the new consolidated office would save the taxpayers money. Allan Kotin, of ADK&A, which conducted the cost savings analysis, said the county is currently paying $330,000 per year in leases for several office buildings in Bishop. Due to increasing rent prices and tenant improvements, Kotin said over the next 20-50 years, the amount of money the county spends on its leases will skyrocket. Though the consolidated office building comes with a heavy price tag, an estimated $14 million, Kotin said in the long-run, a new building will be cost effective. The benefits of this are substantial, Kotin said. Why do this now? For one, for construction and financing, its a good time. And secondly, government is the ultimate long-term investment, its almost immortal and this will get you out from under inflation. Kotin also said that, because the county will own the property and eventually the building, it will not be paying taxes on its office space. County Administrative Officer Kevin Carunchio said the goal is to have a long-term, 20-year lease with the option of buying the building for $1 when it expires. Under the preliminary agreement, Joseph Enterprises will be responsible for designing the building and construction. In exchange, the county will trade 5.69 acres it owns south of Bishop on U.S. 395 for the three-acre parcel owned by Joseph Enterprises. Under the preliminary agreement, the county will invest $2 million in initial rent, pay $600,000 a year for rent, with three additional payments of $250,000. We havent spent a long time fine-tuning these numbers, Kotin said, pointing out that final numbers will be established once the county knows exactly how large the building will be and what departments will be housed there. While four board members have committed to continue looking in to the construction of a new office building, Fifth District Supervisor Richard Cervantes and some residents have voiced their objections, saying the county should not put itself into debt. The defining issue of America today is massive amounts of public debt, Cervantes said. From the White House to the State House, we are drowning in a sea of red ink. Cervantes also said the county has not adequately explored alternative locations and costs for the proposed project. My constituents in Lone Pine, Keeler, Cartago, Olancha, Pearsonville, Darwin, Stovepipe Wells, Homewood Canyon, Death Valley, Tecopa, Shoshone, Charleston View and Sandy Valley will be forced to pay for something they will never use, he said. This county does not have the money and we are facing declining revenues. No time is a good time to go into debt, and to add to the taxpayers burden under these conditions, I believe, would be fiscally irresponsible. Russ Aldridge, local business owner, board member of the Owens Valley Contractor and Vendors Association and candidate for District 2 Supervisor, said he would like to see the county consolidate its offices, but is not convinced that now is the time to take on the debt. If the county cant afford it, whats going to happen? Aldridge asked. Talk to the people. Find out what the people want. None of us want higher taxes. Carunchio said he does not see the county raising taxes to cover the cost of the new building and believes that, through unfilled positions within local departments, Inyo could save enough money to keep business going as usual and make the necessary payments on the building, if the county chooses to continue its agreement with Joseph Enterprises. Dan Stone, president of the OVCVA, said he supports the project. Im all about business and putting people back to work, but go conservatively, Stone said. Id like to see this building go in. Id like to see solar go in to help reduce utility costs. The time is certainly right, right now, Second District Supervisor Susan Cash said. We can have control over our own destiny, and we can very carefully walk down this road before we have to write a check. Cash said that the project may be feasible because Joseph Enterprises has agreed to handle site planning and other preliminary work that would generally cost the county money. If the plans dont turn out the way county leaders envision them, they can always back out and continue paying the leases the county currently holds.
