WILMINGTON >> Construction and other development-related activities have the Hermitage Club in hot water.
According to a lawsuit filed by the Vermont Attorney General's Office, the group allegedly performed construction activities without land use permits; failed to comply with existing permit conditions; performed construction activities without a stormwater permit; discharged into state waters without a permit; constructed a building without a wastewater and potable water supply permit; altered a dam without authorization; and disturbed a significant wetland without approval.
The group owns and operates a private ski resort at Haystack Mountain as well as a nearby golf course and inn.
"Defendants engaged in extensive construction and development activities at the property without necessary state approvals," the document stated.
The state claimed Hermitage Club was told a stormwater construction permit was needed in 2011 when seven single family homes were being constructed and snowmobile paths were being relocated and created. Bridges to cross streams were also constructed while trees were cut and clear.
"Hermitage Inn obtained the Low Risk permits after-the-fact for these," the lawsuit stated. "In the fall of 2012, Hermitage Inn removed additional trees and vegetation. The tree cutting ... took place within a Class 2 forested wetland and buffer zone of an unnamed tributary to Cold Brook."
Between 2011 and 2014, the state claimed portions of construction projects connected with the ski resort were done without state permits which address environmental and other concerns. The state said a permit regarding a wind turbine's construction and electrical work in October 2012 was obtained in September 2013. Other "unauthorized work" involved excavating for a beginner slope, construction of a summit building, construction of a snowmaking line and construction of a ski lift.
During a November 2012 site visit, District Environmental Commission Stormwater Analyst Kevin Burke said he observed unauthorized soil and earth disturbance associated with construction near the beginner slope and ski lifts. He also noted a failure to mark construction limits and set up required fencing.

AUSTIN Lawyers for Rick Perry asked a state court again Monday to end the prosecution of the former governor, saying that the indictment on charges of abuse of power is faulty and that Perrys actions in issuing a veto are allowed by law.
Perrys team and the prosecution have been going back and forth for several months, with the court siding with special prosecutor Michael McCrum on most of the issues. Perrys lawyers have appealed the rulings, hoping a higher court will toss the indictment and end the prosecution.
At issue was the June 2013 veto of $7.5 million that lawmakers had approved for the anti-corruption unit of the Travis County district attorneys office. Perry said he would withhold that funding unless District Attorney Rosemary Lehmberg resigned.
He cited her recent drunken driving conviction and misbehavior during the arrest, saying she should not oversee a unit enforcing public integrity.
On Monday, Perrys team attacked amendments that McCrum had added to the indictment recently. The court had found that the initial indictment lacked enough specificity about the facts behind the allegations of coercion and misuse of public office.
The defense team argued that the facts listed were not found by the grand jury. The lawyers also asserted that Perrys actions fall under an exception for coercion.
The law allows the governor to go back and forth, debate and in effect horse trade with legislators over bills. His lawyers are trying to argue that because his alleged criminal action involved a veto of legislative funds, he is protected by that exception.
The prosecution is arguing that the person he supposedly coerced is not a legislator and Perry was illegally using his power because the person he was trying to control was an office beyond his scope and not connected to the Legislature.
McCrum alleges that Perry had become frustrated with investigations of state agencies by Lehmbergs office and wanted her out. The prosecution alleges the governor, who left office in January at the end of his term, illegally tried to coerce her into leaving by threatening to withhold money until and unless she stepped down.
Perry would have appointed her replacement.

Beginning Wednesday, the Lincoln Parks and Recreation Department will cut down 25 trees on the north side of Capitol Parkway from Randolph to 27th Street to prepare for renovation of the Billy Wolff Trail this spring.
Twenty-nine trees planted along the trail last year will not be affected, and new trees will be planted when construction is complete.
The section of trail to be renovated was part of the first one developed in Lincoln in 1979. It is one of the last sections of the Billy Wolff Trail that is 8 feet wide, and the project will widen it to10.
Right now, the trail has many cracks and areas where the concrete has separated in the middle and created a gap. The existing trees have caused some sections of the trail to heave. The ramp on the west side of 27th Street leading up from the underpass will be replaced to meet ADA standards, and that work will require replacement of the retaining wall on the south side of the ramp.
The project is being funded with a recreational trail program grant, City Capital Improvement Program funds and a donation from the Great Plains Trails Network.
