    Critics: $10 billion border bill unneeded

    TUCSON A $1 billion-a-year bill moving through Congress would add miles of roads and fences along the border and waive more than a dozen environmental laws within 100 miles of the border even though top immigration officials say that's not needed.

    The proposed bill requires the Department of Homeland Security to achieve operational control of the U.S.-Mexico border. That means that all illegal entries are stopped meaning all illegal entries are stopped, which top DHS officials have said is unrealistic.

    But Martha McSally, Southern Arizona's newly elected Republican U.S. Representative who co-sponsored the House bill, said setting an ambitious standard is the best way to achieve success.

    "We have to set a very high goal to understand how important it is to get this job done," McSally said. Arizona's U.S. senators, Republicans John McCain and Jeff Flake, co-sponsored the Senate version of the bill.

    The House bills author, U.S. Rep. Michael McCaul of Texas, calls it the toughest border security bill ever set before Congress, but neither the Border Patrol union nor local environmentalists think it's needed.

    We dont address the underlying issues, said Roger McManus, a biologist who is president of Friends of the Sonoran Desert. People keep coming here for jobs, and drugs keep coming over the border because there's a demand for them, he said.

    Groups on both sides of the immigration debate also have spoken out against the bill either because they say it doesnt do enough to stop illegal immigration or because it won't lead to comprehensive immigration reform.

    Perhaps the strongest rebuke of all came Friday from Secretary of Homeland Security Jeh Johnson, who issued a statement saying the bill "is extreme to the point of being unworkable; if enacted, it would actually leave the border less secure. The bill sets mandatory and highly prescriptive standards that the Border Patrol itself regards as impossible to achieve, undermines the Department of Homeland Securitys capacity to adapt to emerging threats, and politicizes tactical decisions."

    Among other things, the Republican bill would:

    add 48 miles of new double-layer pedestrian fencing;

    FOLLY BEACH Construction is underway on nearly 5 miles of fencing designed to capture wind-blown sand and help build new dunes on the erosion-scarred island.

    The work is the final phase of the $30 million renourishment project that pumped 1.5 million cubic yards of offshore sand onto the beach.

    The sand-trapping system includes about 800 V-shaped structures made of wooden slats anchored by three posts. The open end of the V faces the beach. The design has proven very effective at growing a sand dune, officials said, and new dunes up to 2 feet tall can be seen in about a month. The west end of the island where the Charleston County park is located is an example of where fencing has built new dunes. Its really tremendous how quickly it works, said David Warren, project manager for the Army Corps of Engineers.

    More than 100,000 sea oats and bitter panicum will be planted behind the fencing to help stabilize dune growth.

    The sand catchers are built just in front of the existing dune line.

    Mayor Tim Goodwin said new dunes may grow 2 to 3 feet above the height of a sand fence. By this summer, the benefits will be apparent. Thats the plan, if nature cooperates, he said.

    Some 26,000 linear feet of sand fences will be constructed from 10th Street East to the islands west end at the county park. Completion is expected by the end of March. The same system was used in 2005 when Folly was last renourished, Goodwin said.

    Sand fencing has proved its worth in Myrtle Beach, too, Warren said.

    Raleigh cracks down on sewer lines, forcing some residents to move fences, pools

    Raleigh, N.C. Some Raleigh residents say a sudden shift in city policy regarding access to sewer lines is creating a mess in their backyards. Homeowners have been forced to move fences, retaining walls and even pools and pay for the cost out of their own pocket.

    In 30 years of living at her home on Evers Drive, Shirley Hicks says she was stunned to learn a sewer pipe runs right through her backyard. The city has easement rights, meaning it has the right to access it without any obstructions, such as Hicks fence, trees and the doghouse she just built.

    Its very frustrating, Hicks said. Theyve never had to (get to the sewer line) in the past.

    For years, the city has overlooked easement violations, allowing residents to build fences, sheds and even pools over sewer lines. The city only weeded them out on a case-by-case basis when there has been a blockage.

    But a 2008 audit by the Environmental Protection Agency uncovered a big problem an unusually high number of sewage overflows and cited the City of Raleigh. Now, public works crews are clearing the trouble zones one by one.

    Raleigh Assistant Public Utilities Director T.J. Lynch said he understands why many residents aren't happy about the more aggressive policy.

    For about the past four years, weve been hot and heavy on easement clearing and pipe cleaning, he said. Since we cleared them, we had access to them. Our inspectors can readily get back there open manholes and see what's happening inside the pipes on a routine basis, things they couldn't do before.

    Lynch says the number of overflows has dropped by half.

    Hicks says she is coming to terms with the changing landscape, grudgingly.

    I have no choice. They're going to do what they're going to do, she said.

    CBI fails to get custody of Dayanidhi Maran's aide, two others

    CHENNAI: A special court in Chennai on Tuesday declined to remand three persons, including an aide of former Union telecom minister Dayanidhi Maran, in police custody saying the CBI had not clearly stated the reasons for their custody.

    The CBI arrested the former Union minister's additional private secretary V Gowthaman, chief technical officer of Sun TV Network S Kannan and TV group's electrician K S Ravi on January 21. The charge against them was that they aided and abetted the laying of BSNL telephone lines to the minister's residence here and helped in its misuse by Sun TV Network.

    The other accused in the case are Maran and two former chief general managers of BSNL.

    On Friday, the agency sought their custody for five days. On Tuesday, special judge for CBI cases J Krishnamoorthy rejected the agency's plea saying it had not given proper reason for their custody.

    Pointing out that the three had appeared before the CBI for several sessions of inquiry, the judge said their further custody could not be ordered.

    Earlier, counsel for the accused argued for their bail, saying their arrests were unjustified since they had been cooperating with investigation officers all these years.

    Electrician Ravi's counsel R C Paul Kanagaraj set the ball rolling by saying the case pertained to the alleged illegality between 2004 and 2007, and that the complaint surfaced in 2008.

    Noting that since then all concerned had been summoned several times and inquiries held, Kanagaraj said the central agency had started arresting people on specious ground that they failed to cooperate with the agency.

    He said that due to aggressive telecom policy, the mobile penetration had increased in India, while call rates had plummeted. Arresting people belonging to a private organization, that too when the main suspect himself had no case against him, was not proper, he added.

    The judge said he would pass orders on the bail pleas of the trio on Wednesday.
