    City zoning board approves River Gate building variance

    The Athens Board of Zoning Appeals voted unanimously last week to approve a single variance a developer had requested for student housing it plans to build near Ohio University's South Green.

    Construction on the proposed $15 million, 232-bed apartment building, called "River Gate," is slated to start sometime this year, provided the developers receive approval through the Title 41 site plan review process with the Athens Planning Commission this Thursday.

    The Board of Zoning Appeals granted the developer's request for lot coverage for the 2.59-acre property of 77.5 percent, whereas the normal limit in city zoning code is 60 percent. The term "lot coverage" refers to the "footprint" a building makes on is property site.

    The proposed 3.5-story apartment building will replace the building that now contains the New Life Assembly of God church, located at 10 S. Green Drive.

    The building would join the ranks of the nearby River Park and River's Edge student apartment complexes. Columbus-based student housing company Homestead U, LLC, is developer/owner of the three existing or proposed apartment complexes.

    A firm that was started by the company specifically to buy the land, Delaware-based Athens River Gate, LCL, bought the two lots occupied by New Life Assembly of God for $1.7 million in late August.

    Local attorney Ken Ryan voiced some concerns about the proposed project during the Board of Zoning Appeals meeting. Ryan, speaking for a group of commercial real-estate owners in Athens, said that granting the variance could pave the way for other developers to find a way around the lot coverage requirement in city code.

    "I would also submit that it would grant special privilege to them that would not necessarily be afforded others," Ryan said. "These are not the only developers who seek to develop in the city of Athens."

    Dave Fisher, lawyer for Homestead U., said during the meeting that the request for the variance on lot coverage is justified in some way because of the usage of trees and pervious pavement (which allows water to drain through) and grass in the space. Those are all factors in the city's rationale for lot coverage requirements, as the specific coverage of a building on a property affects green space and storm-water management issues.

    Fisher said Homestead U had included provisions in its plans for 4-inch trunks on trees used on the property, compared to the city-mandated 1.5-inch width of tree trunks. Grass pavers also will be used in 6.3 percent of the site's area for parking, on top of permeable surfaces used in the parking spaces contained in an underground parking lot below the proposed housing. According to design plans for the project provided by Dave Anderson, president of Homestead U, about 40.9 percent of the site would consist of pervious surfaces.

    8 Areas Your Home Inspector Won't Inspect — That You Must!

    I think inspection day is exciting. It's an opportunity to spend an extended period of time in your new prospective house , exploring every nook, cranny, closet, and attic. You get to turn on all the faucets, and run each of the showers. You get to test all the appliances, and even peel back a corner of the wall-to-wall carpet to see if there is hardwood underneath.

    What should be inspected? Everything . It's important to examine all areas of the home, including the exterior, interior, attic, basement, electric, plumbing, and heating and air systems. Faulty construction, improper electrical wiring, inefficient insulation, old heating, building permit violations, and other unseen problems can lead to expensive home repairs -- large and small. You and your inspector need to examine every square inch of the house -- from the electric garage door to the built-in microwave.

    However, don't assume that if you hire a home inspector , he or she will be able to tell you absolutely everything you need to know about the house. They will cover almost everything, but you might have to fill in a few blanks. Home inspectors are very careful not to take on liability for issues that are outside their area of expertise, so there are certain areas that home inspectors will be hesitant to "sign off"on.

    These are the areas that you will need to follow up on by hiring an additional inspector, whose expertise will give you the full picture:

    Roof Ask your inspector if he or she is certified to inspect the roof. Some inspectors are not, and you will need to call in a roof specialist to climb up there. Keep in mind that if you are doing an inspection in snowy weather, it may be very difficult to access and examine the roof. It may be possible to have a special provision that allows you to extend the inspection contingency specifically to accommodate the roof, in the hopes that the weather improves.

    Chimney inspection Your regular inspector may not do this, but if there is any question about stability or hints of structural damage, have a chimney specialist do a "chimney cam" and run a small video camera down the chimney to see it from the inside.

    Geological inspection Another specialized inspection, especially for hillside and cliffside properties, or in flood areas , a geological inspection can unearth a severe drainage or ground-shifting problem-and save you thousands from further damage.

    Sewer inspection Your inspector may tell whether or not things are " flowing." However, a sewer expert can use a "sewer cam" to discover cracks or breaks in the sewer line from the house to the street -- especially on properties that are heavily landscaped, where root growth can crack and clog the pipeline. This can be a serious expense, so find out now. Trust me, this inspection is worth its weight in gold. A sewer line replacement can be an enormous expense.

    Termite inspection This is usually done by the seller, because most mortgage companies and banks will need it prior to allowing a loan on the house. But whoever does it, make sure you review the finished report and all the recommended work is taken care of.

    State capitol fix-up project continues to grow in size and scope

    PIERRE | Ever start a remodeling project that just kept getting bigger and bigger? Thats what is under way in the Legislatures chambers on the third and fourth floors of the South Dakota Capitol.

    The work was triggered by the stained-glass rehabilitation in the rotunda, over the grand staircase and in the ceilings above the Senate and House of Representatives.

    The rebuilt frames carrying freshly cleaned glass began going back in place in the past week and will be finished by Nov. 1 for the one hundred and twenty-fifth anniversary of statehood.

    The two stories of scaffolding necessary to reach the glass in the legislative chambers required moving the 35 desks in the Senate and the 70 desks in the House.

    With the desks moved, the Legislatures Executive Board decided to proceed with installation of new communication cabling to each desks spot. That work begins Monday, Sept. 15, and is scheduled to finish Sept. 26.

    The new system features snap-link connections so desks can be moved as needed in the future without severing the cables.

    The vendor, International Roll Call, will send technicians back to put in audio equipment starting Oct. 6 and with completion set for Oct. 17.

    While the desks were moved, the state Bureau of Administration cleaned the House chambers carpet earlier this month. Cleaning is planned for the Senate carpet Sept. 24-25.

    State officials didnt know whether the carpets needed to be replaced and wanted to see how they looked after cleaning.

    It has been decided it is not acceptable, Lou Adamson, a member of the Legislative Research Council, told lawmakers on the Executive Board at their meeting Sept. 9.
