A special Palmetto Bay Village Council meeting on June 23 called to act upon two items deferred from previous meetings regarding the divisive issue of stadium lighting ended with both items failing to win enough votes for approval.
First on the agenda was Resolution 4 A, sponsored by Mayor Shelley Stanczyk and deferred from the regular council meeting of June 2, which would have placed on the ballot in November a proposed amendment to the village charter putting limits on outdoor lighting for a number of private non-governmental facilities.
The resolution seemed to be in response to an ordinance change concerning outdoor lighting sponsored by Councilmember Tim Schaffer and deferred from the regular council meetings of May 5 and June 2. Schaffers proposed ordinance sought to give churches, schools and other private facilities the same access to outdoor lighting permits that public parks have.
Only about 40 people attended the June 23 meeting, perhaps due to bad weather, despite the previous expressions of strong viewpoints on both sides of the issue. During public comments, both opposition to and support for the proposed charter change were voiced.
First to speak was James McGhee of the Alexander Montessori School. He thought the charter amendment banning recreational field lighting would be unfair and would hurt his school.
We know this will apply primarily to private schools, McGhee said. It raises the question, why was the proposal made as an outright ban and not an election? That is to say, why should residents throughout the village be able to vote on a situation that will principally affect only the surrounding neighbors?
Next was David Singer, a local CPA and activist often speaking in favor of Palmer Trinity Schools expansion plans and against litigation costs caused by previous village zoning rulings placing limits on the school.
A number of churches have filed lawsuits, and won, against municipalities for discrimination, much like what is occurring in Palmetto Bay, began Singer, who also stated that no other cities in Miami-Dade County have lighting code requirements in their charter.
Singer displayed an aerial photo of the Palmer Trinity property and neighboring residences, and indicated Councilmember Joan Lindsays house.
Her house is approximately 100 feet away from Palmer Trinitys property line, Singer said. The village has spent over a million dollars in legal fees fighting Joan Lindsays and the CCOCIs war against Palmer Trinity and they want to continue. This charter will bring more litigation to the village and they just dont care.

Like any MRF they must be updated with the latest ability to differentiate all the recyclables sent through the line. Typical MRF's have optical scanners, eddy current, magnetic head pulleys, blowers, shaker decks, to separate the different materials. While a facility undergoes upgrades, materials are baled and shipped. Currently some of the material from Poquoson and York goes to a facility operated by Bay Disposal and Recycling, and the rest goes to the County Waste facility."

Former President George W. Bush and First Lady Laura Bush have opened up their famous Crawford, Texas, ranch to Architectural Digest and the images are dazzling.
The eco-friendly, 1,600-acre property once dubbed the Western White House has hosted world leaders, including Russian President Vladimir Putin and Saudi King Abdullah bin Abdulaziz. It was also the scene of Jenna Bush Hager's 2008 wedding and the spot where then-president Bush famously cleared brush during his two terms in office.
Then as now, the natural setting makes Prairie Chapel Ranch a peaceful retreat for the couple, who tried to stay true to the landscape when they completed the home in 2001.
"We wanted to see and enjoy the beauty as much as possible," the former president tells the magazine for its August cover story.

A controversial winery project near Yountville won narrow approval from county planners on July 2 after a contentious hearing and some public wavering by a key planning commission member.
The hearing on the 100,000-gallon winery project proposed to be built on Yountville Hill unfolded much like a heavyweight boxing match opponents trading arguments with the developers, but neither side scoring a decisive knockout.
That initially left the commissioners split at the end of a marathon five-hour meeting before an overflow crowd, with Commissioners Matt Pope and Terry Scott saying they opposed the project because its production was too great and its marketing plan too aggressive for a 10.9-acre parcel off Highway 29 and south of Yount Mill Road.
Commissioners Bob Fiddaman and Mike Basayne said they were in favor, and Commissioner Heather Phillips recused herself due to a conflict of interest, leaving a 2-2 deadlock and spelling defeat for the winery. Before the commission could vote formally, however, Eric Sklar, developer of the proposed Yountville Hill Winery, asked for a two-week delay to possibly revise the project and win over votes.
After a brief recess to discuss the delay, the commissioners returned and Pope said he would change his vote. By a 3-1 margin, with Scott opposed, the commission voted to approve the projects use permit to the stunned silence of the roughly 50 people left in attendance, almost all of them opposing the winery.
Pope prefaced his initial comments opposing Yountville Hill by saying he was deeply torn about the project, believing some of the vintners who wrote letters opposing it were saying I got mine, now too bad for you. He also believed that by making it difficult and prohibitively expensive for winery developers, the county was narrowing the pool of new winery owners to large corporations with the deep pockets to navigate the process.
Still, he said he was swayed by the arguments that Yountville Hill could be a precedent-setting decision for Napa Valley, in essence allowing developers to pursue large-production projects that need lots of tasting room customers, nestled into narrow parcels in the hillsides.
Pope said comments from commission Chairman Bob Fiddaman ultimately changed his mind, as Fiddaman argued that the commissioners were bound by the countys existing interpretations of the laws and, therefore, had to approve the winery.
This was the most ambivalent Ive ever been, Pope said shortly before changing his vote. I am in support of this project, and that is my decision.
Tod Mostero, who had helped organize neighborhood opposition to Yountville Hill, said he was disappointed in the decision, and opponents were strongly considering appealing to the Napa County Board of Supervisors. Lester Hardy, an attorney working with Sklar on the project, said he expects one to be filed.

Takeo Provincial Court yesterday handed out suspended sentences of three years in prison and 1 million riel ($250) fines to four Khmer Krom men charged with occupying and clearing state land and destroying a protected area in Kampong Krasaing commune.
According to the Minority Rights Organization (MIRO), the men have lived and farmed the land since 2004, and the verdict is aimed at expelling them while also deterring other poor villagers from cultivating state land.
Un Thanann, provincial coordinator for rights group Adhoc, said Vy Chan, 55; Vy May, 45; San Roum, 34; and Sao Moeun, 40, received guilty verdicts in front of more than 70 Khmer Krom families who had gathered at the court to hear the verdict.
I have been found guilty, but I am happy that I at least do not have to go to prison, Vy Chan said.
MIRO said the Khmer Krom community of 74 families has been asking for more land from the state since the 1990s to no avail.
In 2004, they occupied 215 hectares of state land, but in 2007, the authorities stated the area would be declared a protected wildlife sanctuary.
Villagers claim that the Fisheries Administration ordered the destruction of 91 houses in the area last year.
I admitted that I occupied land that is now a sanctuary, but what about the Fisheries Administration that has destroyed the villagers houses? Who will take responsibility for us? Chan said.
Sao Kosal, deputy director of the provincial fisheries department, denied that the Fisheries Administration had anything to do with the destroyed houses.
He added that the authorities had called for a stiffer penalty for the four men.

All land-clearing and recreational burning in Clark County will be restricted starting July 15, the county Fire Marshal's Office announced Monday.
The partial ban comes as Clark, Cowlitz and Skamania counties jointly implement a policy to limit outdoor burning between July 15 through Sept. 30 each year. But the ban can begin sooner or end later if fire hazard conditions are extreme, officials said. Clark County's ban this year will remain in effect "until further notice," according to the fire marshal's office.
Clark County is rescinding all burning permits issued prior to the ban. Permits can be re-issued or extended when the ban is lifted, according to the county.
The restrictions do not apply on federally managed lands.
Recreational campfires on forest lands will be allowed only in fire pits at designated campgrounds, including local, county and state parks. Recreational fires on private land will be permitted, but only within certain limitations, according to the county.
