    Council: Retaining wall is a "structure"

    When the proposed relocation of the Canyons Resort ski maintenance building was denied last month, one of the reasons the county shot the site plan down was because a rock retaining wall as high as 18 feet was to be right on the boundary of a wetland. The controversy surrounds the fact that the retaining wall is a "structure" and thus had to be at least 40 feet from the wetland. Developers challenged that definition of "structure."

    As per the Snyderville Basin Development Code, a "structure" is defined as:

    That which is built or constructed, a building or edifice of any kind, installed on, above or below the surface of land or water.

    Shawn Ferrin, external legal counsel for TCFC PropCo, the developer proposing the maintenance building, presented the case for why the retaining wall should not have been considered a "structure." Ferrin was joined by TCFC VP of Development Spencer White. Defending the interpretation of a structure were Community Development Director Pat Putt and Douglas Clyde, a witness of Putt's.

    "Putt is interpreting the [Development Code] language very broadly," Ferrin said. "He interprets it to mean 'anything that is built or constructed.' TCFC believes 'an edifice or building of any kind' is the important part of the ordinance."

    Ferrin added TCFC cannot be treated "arbitrarily" by the county and have to conform to a different interpretation of "structure" than that which has been historically applied. He pointed to numerous examples around Summit County where "structures" are within wetland setbacks, such as a home under construction on Old Ranch Road which is less than 40 feet from a stream.

    Clyde responded by asserting that "structures" and "buildings" are not the same thing and that TCFC wants to define structures as buildings only.

    "If you can't define the difference between a structure and a building, you can't do your job," Clyde said. "For flood control and watershed management, you have an interest in determining whether this is a structure."

    Summit County Civil Attorney Dave Thomas said Putt can go against how the definition of "structure" has been historically applied, but if he wishes to clarify that the requested retaining wall is a structure he must do so without "animus" toward the developer and must apply that interpretation consistently in all instances thereafter.

    County Council member Roger Armstrong said no one knows whether the examples of "structures" currently existing within wetland setbacks were properly permitted, and that such examples would not give sufficient reason for allowing the retaining wall next to a wetland.

    Willis Tower ledge reopens after coating cracks

    The observation decks on the 103rd floor of the Willis Tower in Chicago that appeared to crack beneath a family reopened Friday after it was inspected and fixed by the building.

    Bill Utter, a building spokesman, told MyFoxChicago.com that the cracks reported Wednesday night were actually on a scratch-resistant coating of the glass structure, and never jeopardized the structural integrity of the box.

    "The public was never at risk," Buildings Commissioner Felicia Davis told the station. "The integrity of the structure was never compromised. There is this additional layer on top that is intended to take the scrapes and scratches from routine use by the public. That coating on the glass cracked."

    The issue surfaced after relatives visiting from California reported hearing the glass floor begin to crack.

    Alejandro Garibay, who was visiting the tower with his family, said: "When I put my hand down to push myself and stand up, I hear it and I feel the glass just crack. I felt on my palm all these little pieces of glass."

    After alerting an observation deck worker, the family took out their cellphones to take pictures of the cracks.

    "I remember heavily breathing, then I hugged my cousin Tony like, 'Oh my God, we're alive," said David Cazares.

    The tower features four glass enclosures collectively called The Ledge, which opened in 2009 and give tourists the feeling of standing suspended in midair 1,353 feet above the ground and 4 feet away from the building. They're actually more like boxes than balconies, with transparent walls, floor and ceiling.

    Visitors are treated to unobstructed views of Chicago from the building's west side and a heart-stopping vista of the street and Chicago River below for those brave enough to look straight down.

    Mold keeps firehouse quiet

    Mt. Pleasant firefighters will likely spend six more months in a temporary location while city leaders seek options for funding an estimated $100,000 mold remediation project at the towns fire hall.

    The Mt. Pleasant Fire Department, formerly at 1158 N. Main St., was vacated in November after invasive mold was found throughout the building. Operations were relocated to a facility at 1540 Trilogy Lane, about three miles north of the former location.

    Mt. Pleasant Fire Chief Tim Smith estimated it could take between 6-8 months before firefighters return to the Main Street building.

    When we first started talking about this, we knew it would be approximately a year, Smith said. Right now, everything is kind of moving at a snails pace, but it is moving forward.

    USDA Rural Development Area Director Faye McEwen said Mt. Pleasant is preparing to submit applications for two separate programs that would fund the fire hall mold remediation.

    Rural Development has a Community Facilities program that would provide grant money for the project, McEwen said. Health care, education and public safety projects including fire halls are given priority in those grant processes, according to the USDA website.

    Depending on how much money is awarded through the grant, the city will then apply for a Rural Economic Development Loan and Grant program to fund the remaining balance, McEwen said. If the application is approved, Rural Development may award up to $350,000 to a municipal utility company, like the Mt. Pleasant Power System, which can then administer the funds to the city.

    If Mt. Pleasant pays that (money) back, then that would set up a revolving loan fund that Mt. Pleasant Power would have available, she said.

    The city could access that pool of money for future economic development projects, including in the private sector, McEwen said.

    The South Central Tennessee Development District is assisting the city in applying for the loans and grants. Applications must be submitted by the end of June, McEwen said.

    Magazine salesman imposter steals packages from porches

    MEMPHIS, TN -

    (WMC) - A suspect was going door to door posing as a magazine sales person, but when no one answered, he would snatch packages from the doorsteps. It was all caught on camera.

    Tracey Wiswall's surveillance cameras and his electronic neighborhood watch site helped solve the reoccurring crime.

    It started a week ago when he got confirmation about a package delivery.

    "I got here; the package was gone. So I looked at the video and there he was. He came from my neighbors', took it and left," said Wiswall.

    The video captures the thief grabbing the package and taking off. A camera on his roof captured a clear image of the suspect. Wiswall posted it on Nextdoor.com.

    Everyone was on the lookout and a week later, Mike Armstrong spotted the man and called police.

    "It's awesome knowing that everybody joined together to make it happen," 'said Armstrong.

    On Thursday, the suspect was arrested all because of this virtual neighborhood watch, giving everyone a voice and an extra set of eyes.

    'It's all about levels of security, you have alarms, a dog, a security company, but if you have a neighborhood network of people who are looking out for each other, all that is what makes your neighborhood safer, "said Wiswall.
