State lawyers argued Tuesday that a foe of a new Minnesota Senate office building should be on the hook for $18.6 million if his lawsuit doesn't succeed on appeal and construction is delayed.
Former Rep. Jim Knoblach's lawsuit is the final obstacle to the office tower, and his attorney told the Associated Press that a court ruling requiring a bond would effectively end the case.
"We wouldn't be able to forward the surety bond," said attorney Erick Kaardal. "It's too much money."
The Minnesota attorney general's office filed the request with the Court of Appeals, which is considering Knoblach's appeal of an earlier legal defeat. Knoblach, of St. Cloud, has argued that the process for approving the building was flawed and the courts should block it.
The building and related parking ramp adjacent to the Capitol are projected to cost $90 million. Taxpayers would cover all but $13 million.
In the motion, Assistant Attorney General Nathan Hartshorn says the state expects to start incurring delay costs in mid-May, with those rising if ground isn't broken by July 1. The state is holding off on selling bonds until the case is resolved.
Hartshorn writes that Knoblach's "continued pursuit of meritless legal claims threatens significant injury to the public treasury."
"From our standpoint we're trying to save the taxpayer $77 million and we feel we have a reasonable case and the court should hear the case expeditiously," Knoblach said in a telephone interview Tuesday.
The planned office building is intertwined with the state Capitol renovation. Senators with Capitol offices are being displaced and the Senate plans to use space in its new building as a temporary chamber for the 2016 session. The timeline is tight and Department of Administration officials say they may need to make alternative plans if the project stalls.

Lend Lease Group, Australias biggest listed property developer, will start building the third office tower at its A$6 billion ($5.6 billion) Sydney harbor-front development after signing PricewaterhouseCoopers LLP and HSBC Holdings Plc as tenants.
PwCs Australian unit agreed to occupy 26,500 square meters (285,243 square feet) over 12 floors in the 49-story building at Lend Leases Barangaroo project, and HSBCs local business has signed a pact to take 8,000 square meters, the Sydney-based company said in a regulatory filing. The developer also sold a 10 percent stake in the sites first two office towers to Netherlandss APG Algemene Pensioen Groep NV, reducing its own interest to A$300 million, or 15 percent, from A$500 million earlier, it said.
Lend Lease began work on the development in late 2011, creating a new financial hub in Australias most populous city. The agreement announced today will allow the company to begin construction on the last office building on the site, which it will fund entirely with existing capital sources, the company said today, without providing further details.
Prior to todays announcement, we were already ahead of where we expected to be at this stage of the evolution of the Barangaroo South precinct, Lend Lease Chief Executive Officer Steve McCann said in the statement. We are confident that International Towers Sydney will continue to attract quality tenants.
The company will add other investors at an appropriate time in the future, according to the statement.
Lend Lease shares were down 0.1 percent at A$12.825 at 10:52 a.m. in Sydney, paring gains this year to 15 percent. The benchmark S&P/ASX 200 (AS51) index has advanced 2.4 percent this year.

Stop picking on robotic vacuums. If their brains were any bigger than a computer chip, maybe they'd be parking your car instead of cleaning your floors.
The Deebot D77, the vacuuming robot from Ecovacs, is so dumb that it can't stop cleaning until its battery runs low. It cleans until it drops. But the obsessive-compulsive Deebot empties its dustbin automatically, which would leave the better-known Roomba, from iRobot, awe-struck. It's also savvy enough to coerce resident humans to join the cleanup the Deebot arrives with a canister vacuum that attaches to its docking station.
Ecovacs christened the Deebot a "3D Vacuuming Robot" for that reason: The D77 handles two-dimensional flooring, leaving the above-floor third dimension, often known as curtains and cushions, to humans.
In the robot world, that certifies the D77 as smarter than the "RoboCop" remake.
After having the Deebot as a houseguest, and quasi domestic servant, the past several weeks, I wouldn't give up my brainless vacuum a made-in-the-USA Metropolitan canister with HEPA filter. I would, however, welcome the D77 as chairman of the Routine Housecleaning Committee if I could stomach its $699.99 cost.
In a smaller home or apartment, the Deebot might be the only vacuum necessary. The Deebot costs as much as iRobot's Roomba 880 but includes the hand-held vacuum that's also the dust repository.
Ecovacs, makers of the window-cleaning Winbot robot and Famibot household assistant, designed D77's charging dock so the hand-held rests on top, like a space shuttle attached to NASA's Shuttle Carrier Aircraft. In that position, the D77 will offload its full dustbin into the hand-held.
Once charged it takes three hours for the 2500mAh battery the D77 is on full alert. It has a control panel with LCD screen, four cleaning modes, a programmable feature for scheduling cleanings and a hand-held remote.
I most often deployed the D77 in automatic cleaning mode so that it moved in a straight line until it struck something, redirecting its patch. The Deebot also has an intensive-cleaning mode, a spot-cleaning mode and an edge-cleaning setting. The D77 does not have boundary tracking, however, like the Roomba or Neato's robotic vacuums, that acts like an invisible fence. If you want it to clean a specific room, block the doorway or close the door. Then the D77 will clean the room until it's exhausted. Even my old Roomba knows when to quit after cleaning.
Compare that to the Neato Robotics vacuum, which scans a room and maps information on location of walls, furniture and other obstacles. It knows where it's going and knows when to quit.
