    Unless something else is written in your lease, one of five new laws might change your rights.

    On 4/16/18, Governor Walker signed AB771 into law. It was published today (4/17/18) as 2017 Wis. Act 317 and goes into effect tomorrow (4/18/18). We are in the process of getting the links to the new laws and updating our website this week. Please be patient with us as we make the needed revisions.     More information on law changes is available here. Have your lease available when calling the Tenant Resource Center so we can help you know what your rights and remedies are, including whether you can request double damages, court costs and reasonable attorney fees when you sue your landlord.

    According to the Department of Agriculture, Trade and Consumer Protection, landlords CANNOT charge for routine carpet cleaning - during the lease or from a security deposit-no matter what your lease says. Your landlord cannot legally deduct from your security deposit, even if:

    Requiring a tenant to pay for carpet cleaning in advance of moving also will not work, any payments in excess of rent are considered security deposits (ATCP 134.02) and so withholding that money would also be considered a withholding from a security deposit, and therefore illegal absent "unusual damage".

    A landlord may only withhold from a tenant's security deposit for painting or carpet cleaning where there is "unusual damage" caused by "tenant abuse". ATCP 134.06(3)(c)

    The Attorney General's opinion may be found here. The Attorney General was asked two questions which were answered as follows:

    Answer: No. "Landlord's statuatory duty to keep premises in a "reasonable state of repair" does not encompass routine carpet cleaning.

    Answer: No. Because routine carpet cleaning is not a statutorily-imposed obligation of a landlord, assigning this responsibility to a tenant through a contractual provision does not render a rental agreement void.

    So, even though a rental provision regarding routine cleaning would not make the lease void and unenforceable under Wis. Stat. 704.44(8), it is still illegal to withhold money for carpet cleaning from the security deposit. The opinion notes:

    Finally, I note thatthe permissibility of provisions requiring tenants to arrange or pay for carpet cleaning at the termination of their tenancy does not mean that landlords can deduct carpet cleaning charges from the security deposit of a tenant who has failed to comply with such a provision. Under your agency's present rule, ATCP 134.06(3)(c), landlords are expressly prohibited from withholding security deposits "for normal wear and tear, or for other damages or losses for which the tenant cannot reasonably be held responsible under applicable law." The accompanying note cites carpet cleaning as an example of an impermissible basis for withholding a portion of a security deposit. My conclusion that carpet cleaning provisions are valid does not affect the prohibition against deducting carpet cleaning expenses from a tenant's security deposit as a means of enforcing such provisions.

    As of 11/1/15: A new note in ATCP 134.06(3)(c) makes it clear that even though a landlord is allowed to write a lease saying the tenant has to pay for routine carpet cleaning, they may not take this out of the security deposit. Any carpet cleaning charges they collect in advance must be treated as part of a security deposit, which must be subject to a refund. Deductions cannot include "normal wear and tear." Essentially, a landlord would have to sue a tenant as a separate matter if they did not pay for routine carpet cleaning required by the lease.CR 14-038, Sec. 10,Eff. 11/1/15.

    The script is real. A RELATABLE story with phenomenal acting.

    Some people here write that "they used the N word too much, and it made [them] uncomfortable". Deal with it. That IS the way the characters were built, it IS the way many folks at the time, and actually, even now, speak. Walk a mile in someone else's shoes... I don't love the use of the word either, but I can certainly respect people who feel otherwise, and I most definitely will not let something as trivial as *that* make me give a well written and executed film a bad rating.

    Some people say "there's too much dialogue." Yeah. That's what happens when a story is good, when the script is actually good enough that you don't need cars racing, buildings exploding, or a basic copy/paste of every lame, dumbed down story Hollywood has been writing since the 1990s. Read a book! Try something that requires you to pay attention for more than 15 seconds. LISTEN ATTENTIVELY TO WORDS! It's a good life skill. At worst, committing to appreciating a movie like this will expand and improve your appreciation of (actual) art.

    Denzel is magical. Viola, although having a secondary role, shines as ever. The conflicts are presented in a way that makes the viewer understand, and not demonize the characters amidst their flaws. At times you may get angry with them, but you ultimately understand the human condition from their perspective. THAT is what a good writer does with a character. THAT is what a good actor does with a role: evoking empathy is a must. And all of this was executed brilliantly. Some people may feel the story doesn't uplift them. Good writing is not measured by the way a story makes you feel uplifted. You may get the feeling that you're stuck. THE CHARACTERS *are* stuck themselves! But the way the story thrives is precisely in the characters' ability to "put one foot in front of the other," like one of the characters in the movie says. There is a remaining DIGNITY amidst their struggles and flaws.

    I can't (yet) say the Academy Award for Best Actor was stolen from Denzel Washington, because (and this is my effort to remain objective), I haven't seen Manchester By The Sea; but I honestly doubt Casey Affleck's job could surpass Washington's. This role showcases Washington's broad abilities very well.

    A person or business must have a Home Improvement Contractor license if engaged in the construction, repair, remodeling, or addition to any land or building used as a residence. This includes, but is not limited to, the construction, replacement, or improvement of basements, driveways, fences, garages, landscaping, patios, porches, sidewalks, swimming pools, terraces, and other improvements to structures or upon land that is next to a home or apartment building.

    This description is only a general explanation of who must have a Home Improvement Contractor license.Refer to the Licensing Law/Rules handout.

    You must obtain the following required documents before filing your application. Although DCA does not require submission of these documents in order to process your application in person or online, DCA reserves the right to request and examine the documents under section 20.104 of the New York City Administrative Code.

    Below are requirements when filing your license application:

    How to Build a Pond – Allan Block

    Enhance your flower garden with a beautiful pond using the AB Courtyard Collection. With this flexible system you can build a pond in a weekend without any special tools and without splitting blocks.

    In this example we are building a 6 ft (1.8 m) diameter pond with a pre-formed liner (found at your local pond supply store) on soil. If you are constructing your pond on an exisiting concrete surface, skip to Step 4.

    Place a stake in the center of where you would like to build your pond. Measure the diameter of the pond liner, then mark on the string one half of the diameter. Tie the string to the stake and rotate it marking the ground for the liner. Temporarily place 30 AB York blocks along the outside of the circle marked on the ground. The amount of blocks needed is based on the pre fabricated liner that was used. Verify the liner size and adjust blocks as needed to fit the design. Use a shovel to cut around the blocks and mark where the sod and soil will be removed to construct the base.

    Remove the blocks used to layout the pond location. Then remove the sod and 3 in. (76 mm) of soil in the entire area. If your plans includes a decorative center sculpture or fountain it is recommended to remove additional soil in the center to construct a stronger base. If electricity is required please follow local electrical codes.

    Next prepare the foundation pad by placing 4 in. of well-graded base rock in the excavated area. Level the area making adjustments where needed. A straight 2x4 and a level make easy work of leveling the site. Compact the base rock with a hand tamper.

    Start building the pond using the string to position the blocks. Building two courses at a time will insure proper alignment. Check the blocks for level. Make adjustments to the circumference of the circle so that cutting is not required. Next add the third course of blocks.

    Place the pre-fabricated plastic liner in the ring of the blocks. Position the panel caps and glue them down with concrete adhesive. This will lock the blocks together and prevent unwanted disassembly.

    Place your choice of clean decorative rock in the bottom of the liner. Now you're ready to add water and other ornamental accessories to customize your design.

    Above Ground Pond

    This below ground pond will use 4 courses of AB York blocks, Wall Caps, a flexible pond liner, which can be found at a local pond supply store, and a fountain (optional).

    When completed the pond will be an outstanding element in your yard. The liner we are using will be placed on the outside of the blocks to allow the AB Courtyard blocks, decorative rock and fountain to be the main focal point.

    First, choose the location for your pond and place a stake in the center. Using a tape measure, mark 41 in. (1.04 m) on the string starting at the stake. Using paint and the string, mark a circle around the stake at the location of the pond.

    Temporarily place the AB York blocks along the inside of the circle marked on the ground. Each course of the pond will use 28 blocks to complete the circle. Adjust blocks as needed, making sure the blocks are tight together. Use a shovel to cut around the blocks and mark where the sod and soil will be removed.

    Remove the blocks used to mark the pond location. Next clear any existing landscaping in the entire area and dig a hole a minimum of 12 in. (300 mm) deep to accommodate the pond. Later, we will be using some of the removed material as backfill to add a gradual slope up to the ponds edge.

    In the bottom of the hole, dig a leveling trench 8 in. wide (200 mm) by 3 in. deep (75 mm) around the outside of the pond where the blocks will be placed.

    If there will be a statue or fountain in the pond, dig a leveling trench for its location as well. Fill the leveling trench(s) with 3 in. (75 mm) of course sand. Compact the bottom of the pond and the sand leveling pad with a hand tamper.

    Use a level and a straight 2x4 to level the entire pond area from side to side. A level base will make it easy to install the rest of the pond. If electricity is required for a fountain, please follow local electrical codes.

    Temporarily place the first two courses of AB York blocks on the sand leveling pad. Building the first two courses at the same time ensures proper alignment. Level and adjust each block from side to side and front to back. Once the first two courses are in place. Use a level and a straight 2x4 to level the blocks from side to side across the pond.

    Before adding the liner, carefully remove all the AB York blocks. The blocks must be leveled before the liner is installed to prevent damage to the liner later. When installing the flexible liner, be sure to press the sides of the liner into the outside edges of the pond. Be careful not to step or stand on the sand leveling pad.

    With the liner in place, carefully replace the first 2 courses of blocks in the location of the leveling pad. To avoid damaging the liner later, make only minor adjustments if possible to re-level the blocks. With the first 2 courses complete and leveled, install the 3rd course.

    Modify block to make room for the power cord

    With the 3 courses installed, fold the liner up over the top of the blocks. Using onsite soils, backfill around the outer edge of the liner up to the top of the blocks. Gently compact this soil to prevent settling of the soil later. Using a utility knife, trim the excess liner at the outer edge of the top of this 3rd course of blocks. Remember that the high water mark can not exceed the top of the cut of the liner. For deeper water levels, you must bury more courses.

    Install the last course of blocks. If the pond needs electricity, chip off the bottom edge of one block using a hammer and chisel to make room for the power cord. Follow individual manufacturers instructions on proper installation of any accessory you will be adding to the pond.

    Finish the pond with Wall Caps. Then secure in place with concrete adhesive.

    Its time to add the water, decorative rock, a sculpture/fountain or plantings. When using rock, we recommend rinsing the rock before placing in the pond for best results. Finish the landscaping around the pond with mulch and plantings and enjoy.

    What is a Retaining Wall?

    A retaining wall is a structure that holds or retains soil behind it. There are many types of materials that can be used to create retaining walls like concrete blocks, poured concrete, treated timbers, rocks or boulders. Some are easy to use, others have a shorter life span, but all can retain soil.

    Several questions must be considered in order to build the proper type of retaining wall. For example, is the soil sand, clay, or something in between? What is above the wall: a driveway or something heavier like a pool? Will the ground above or below the wall be level or sloped? What is the height of the wall? All of these factors will determine whether you will need a Gravity Retaining Wall or a Geogrid Reinforced Retaining Wall.

    Gravity retaining walls are walls that depend on their own weight and setback to retain the soil and are typically shorter in height. Allan Block retaining walls are ideal for this type of wall, because as they are stacked together they lock into place to form a setback. This setback helps the wall support the pressure from the soils behind it.

    Reinforced retaining walls are walls that use some type of reinforcement to give more strength to the retaining wall structure, thus improving its ability to retain the soils behind it. For SRWs (Segmental Retaining Walls), we refer to this reinforcement as geogrid or grid. Geogrid is placed between courses of blocks in the wall and rolled back into the slope or hillside during installation to create a stronger and more stable soil mass. In laymans terms, the blocks, the geogrid and the reinforced soil mass work together to make one large, heavy retaining wall structure. Sometimes grid is not a usable solution on a project due to space or other site conditions, so alternative reinforcement materials need to be used such as no-fines concrete, soil nails or earth anchors. These types of reinforcement typically require a local engineer for the design and a certified contractor for the installation

    Retaining Wall

    Over the years many different retaining wall materials have helped to alter the landscape in which we live. Common retaining wall products include railroad ties or treated timbers as well as wall stones, natural stones, bricks and concrete block.

    While wood is often an inexpensive and simple choice for a retaining wall, its short lifespan makes it a relatively poor choice. As the wood decomposes, so does your retaining wall and the integrity of your usable space. Stones, rocks or boulders can create beautiful retaining walls, but the installation of these materials can be expensive and labor intensive. Furthermore, maintenance of stone walls can be difficult, because over time or they may erode or become home to rodents and weeds.

    Cast-in place or mortared retaining walls are another option. These walls can be installed with a variety of veneers, bricks, flagstones, etc. which add texture and style. However, these structures are rigid and do not move and flex with climate changes, earthquakes and other natural forces, and can be very expensive to build.

    SRWs (Segmental Retaining Walls) like the Allan Block products, offer concrete masonry blocks that are modular and interlocking for ease of use. Simply stack the mortarless blocks together using our installation information, and create a maintenance-free retaining wall that will add usable land, fix a grading or slope issue, and solve many other site problems. These SRWs use similar construction techniques as found in the mortarless construction of the Great Wall of China and the Pyramids of Egypt and will stand the test of time. SRWs come in a variety of sizes, shapes and colors as well as different facing textures. Some of the more common textures offer a hard-split or soft-split look, a tumbled look, or more recently a stamped face. Concrete blocks made out of recycled materials are also available. Once you build a wall with an SRW you can be sure it is built to last.
