    QBE finally starts paying out to home warranty insurance to Sublime victims

    Al Locus and Emma Snowden and their extended family continue to live in cramped conditions.

    QBE has begun paying out Home Warranty Insurance claims for victims of the Sublime Constructions and Development collapse 10 months after the building company went into liquidation.

    The company said the news a related entity, Sublime Builders, had gone into voluntary liquidation "has triggered the cover under Home Warranty Insurance in accordance with the statute".

    QBE has long maintained that because the HWI certificates had been obtained in the name of Sublime Builders, not Sublime Constructions and Development, it did not have to pay out an estimated $1.2 million to victims of the $4.5 million building company collapse.

    Many owners had been left $100,000 or more out of pocket with partly completed houses they have since had to self fund.

    The refusal raised concerns that up to 13 homes in the ACT did not have statutory home warranty insurance cover.

    While the QBE payments are capped by law at $84,500 and do not cover all of the losses many individuals have experienced, they are being welcomed.

    "It is better late than never," Tanya Nguyen, one of the first victims contacted by QBE after Fairfax asked the company what it was doing in response to the Sublime Builders liquidation on Wednesday.

    Some Sublime collapse victims finally get a payout

    The news some victims of the Sublime Constructions and Development collapse have already received Home Warranty Insurance payouts following QBE's belated decision to honour its policy certificates last Wednesday is as welcome as it is overdue.

    That said, it does not mark the end to a saga that raised serious questions about the integrity of the ACT's statutory home warranty insurance and highlighted an apparent reluctance by government agencies to back consumers when their pursuit of the Australian dream goes sour.

    The collapse of Sublime, and its drawn out aftermath, has also focused attention on the unfortunate practice by some builders of using contractors as "lines of credit" who can be strung out indefinitely, and the domino effect company collapses have on other businesses.

    Issues have also emerged over the ability of building companies to trade while insolvent for long periods and an apparent disconnect between what the public expects of bodies such as the Environment and Planning Directorate and what the staff believe they should do.

    A common refrain, voiced by almost every individual caught out by one of the many building company collapses in the territory in the last four years is that when they turned to the EPD, Fair Trading or the police for assistance they were shunted from pillar to post.

    That was certainly the experience of the up to 13 Sublime clients left high and dry when the firm failed with debts estimated at about $4.5 million in February.

    When one Sublime client went to the Environment and Planning Directorate for assistance she was told "(your) problem is commercial in nature" and "not within the remit of (EPD's) construction occupations registrar".

    On being referred to Fair Trading she was told it was a construction matter and she had to go back to the EPD.

    Then, on referring the matter to the police, she was told the complaint would be difficult and time consuming to investigate and was advised to consider private legal action she could ill afford.

    Dangerous 'Misfortune Cookie' flaw discovered in 12 million home routers

    Researchers at Check Point have discovered a serious security vulnerability affecting at least 12 million leading-brand home and SME routers that appears to have gone unnoticed for over a decade.

    Dubbed the Misfortune Cookie flaw, the firm plans to give a detailed account of the issue at a forthcoming security conference but in the meantime its important to stress that no real-world attacks using it have yet been detected.

    That said, an attacker exploiting the flaw would be able to monitor all data travelling through a gateway such as files, emails and logins and have the power to infect connected devices with malware. Man-in-the-middle attacks would also be possible, according to Check Point.

    The precise source of the issue is not known - a chipset software development kit (SDK) is suspected - but Check Point warned that up to 200 unpatched models using the RomPager embedded web server software (which uses a remote service called TR-069) prior to version 4.34 were probably vulnerable.

    As to which products are affected, this is where it gets a little complicated. Check Point estimates that at least 12 million devices are affected across the world but suggested this could be an underestimate.

    Given the popularity of RomPager and the list of affected brands - D-Link, Edimax, Huawei, TP-Link, ZTE, and ZyXEL sold mainly to home users - such pessimism is realistic.

    D-Link's DSL-2600U router is one of many affected models.

    The issue dates back to 2002 but should have been fixed by an update three years later. However, as Check Point notes:

    The patch propagation cycle, however, is incredibly slow (sometimes non-existent) with these types of devices. We can confirm many devices today still ship with the vulnerable version in place, said its research note.

    The vulnerability had been designated CVE-2014-9222, but Check Point said that identifying affected devices might not be easy for many users. Some vendors had patched the issue but that fact might not have changed the version number in RomPager software to one later than 4.34.

    Its important to understand that a heating and cooling system is much more than a noise-making, expensive box that attempts to make you comfortable while sucking up your hard earned money. While manufacturers have made unbelievable strides in creating more efficient equipment, they have failed to educate the installing contractors that the equipment is only as efficient as their knowledge.

    Homeowners expect heating and air conditioning contractors to have the training and knowledge to deliver the Energy Efficiency rating of the heating and cooling system they spent their hard-earned money on.     Consumer Protection Division states: Most homeowners are simply not getting the efficiency from high efficiency equipment.

    A recent study clearly shows that homeowners in the Reno/Sparks area are receiving just 43% of the heating and cooling rated BTUs because the Box Swappers fail to invest in specialized tools, instruments and stay on top of the industry by advancing their knowledge on BTU delivery.

    Of the 85,000 heating and air conditioning contractors across the USA, Nevada Home Energy Experts represents less than 5% who have invested in the most advanced state-of-the-art, electronic instruments, and spent hundreds of hours in both classroom and field training to gain the necessary knowledge and certificates (see sidebar) to understand the science of BTU delivery.
