    Westerville Contractor Accused Of Violating Ohio Consumer Laws

    COLUMBUS, Ohio - Ohio Attorney General Mike DeWine announced a lawsuit against a Westerville home improvement contractor accused of failing to deliver on services promised to consumers.

    The lawsuit charges Michael Evilsizer, of Westerville, and his business, Buckeye Exteriors.

    The two men allegedly violated Ohios consumer laws, according to DeWine.

    Consumers gave these contractors thousands of dollars for work that was not performed as promised, said DeWine. We try to resolve the issues out of court, but when months go by with no resolution for consumers, we must move forward.

    Buckeye Exteriors specializes in home window replacement, vinyl siding, and roofing. DeWines office is currently aware of six unresolved complaints from consumers against the business. Consumers stated paying between $950 and $10,000 for construction work that was not delivered as promised.

    The lawsuit has been filed in the Franklin County Common Pleas Court, charging the business and Evilsizer with failure to deliver, performing shoddy work, and violating the repairs and services rule.

    Temps affect roofing at Goldwin Smith; Klarman dig on track

    Digging for Klarman Hall starts Feb. 3.

    The whipping wind and negative temps have slowed the pace of roof replacement for Goldwin Smith Hall, but digging work at the Klarman Hall site, the future home of the College of Arts and Sciences new humanities building, is set to begin on schedule Feb. 3.

    Workers have been bundled in all sorts of special gear to face the winter chills, but theres no way to get around the need for certain minimum temperatures to complete part of the roof project.

    The adhesive used on the underlayment of the roof (the ice and water shields and plywood or copper that go under the slate tiles) cant be applied unless its at least 25 degrees, said Alex Chevallard, associate manager of projects for Cornell, who manages the construction of the roof replacement project at Goldwin Smith.

    And workers are under pressure each day when they work on a section because they need to take off tiles and old underlayment, fix any problems they find and add new underlayment, all in the same day. They cant leave a portion of roof uncovered, for obvious reasons.

    Along with replacing the entire slate roof on the building which Chevallard said is one of the largest contiguous roofs on campus workers from LeChase Construction are also adding two dormers on the east side for office space.

    Despite the weather woes, Dave Tallie, construction superintendent for LeChase, says theyll finish the roof on schedule. LeChase is managing the Klarman site enabling work and roof reconstruction.

    Once the weather gets better, we [add crew] to make up for any lost time in winter, he said. Slate roofs can last for about 100 years, Tallie said. Portions of the current roof are 109 years old; others were replaced in the 1970s, according to Gary Wilhelm, project director at Cornell Planning, Design and Construction.

    Work has focused so far on the east side of the building, Chevallard said, so that workers can be out of the way for construction on Klarman Hall to begin next week.

    Storm-Ravaged N.J. Inn Named One of Nation's Best

    Talk about a comeback story.

    A New Jersey bed and breakfast ravaged by Superstorm Sandy has won a prestigious travel industry award.

    The Sea Spray Inn in Ocean Grove, N.J., had five feet of water on the ground floor, which destroyed the inn's mechanicals. A porch was destroyed, as were several windows and guest rooms.

    But now the inn is one of the top B&Bs in the nation, according to the latest TripAdvisor Travelers Choice Awards.

    "It's a really big deal, especially when you think about all the damage Sandy caused then factor in that we had to shut down for five months. We really persevered and came back and straight to the top," said Eric Tellefsen, who co-owns the inn with his wife Mary Ellen.

    Bringing the inn back to award-winning status was no easy task. Windows needed to be replaced, as did a porch. The furnace, hot water heater and air conditioning had to be replaced too. The innkeepers had to lift the house a few inches and install a masonry wall because of structural issues caused by the storm surge.

    They even had to replace the front sidewalk.

    "This award is such a huge recognition of all our hard work. It means that our guests recognize and appreciate their experience," said Mary Ellen Tellefsen.

    Today, the inn is almost complete. All that's left to do is finish the basement, but they have no funds left to do so. This recognition by the world's largest travel site could change that.

    3 candidates for Republic grant

    Three groups in Fountain Hills are asking residents to support them as they vie for $10,000 in grant funding from Republic Services.

    The Republic Community Grant program was established in response to the towns request that citizens be allowed to support non-profit groups through the trash haulers Recycling Rewards program.

    A citizens committee selected three projects from the five grant applications that were received this year. Town Facilities/Environmental Supervisor Raymond Rees said two of the applications were incomplete so narrowing the field was a simple process for the first effort.

    The Fountain Hills Theater is asking for $5,000 to install shade screening over the patio area between two buildings at the theater.

    The Fountain Hills Cultural and Civic Association is seeking $10,000 for the Greening of the Downtown initiative for planting of additional shade trees in Fountain Park.

    The L. Alan Cruikshank River of Time Museum is asking for $5,000 for creation of an interactive exhibit emphasizing the value of water in Arizona.

    Rees said $10,000 is the amount that is available for the grant this year. That being the case, he said if the FHCCA is eventually awarded the grant there will be no money for either of the other projects. However, if either of the other two is leads the tally of supporters the second place request will also receive $5,000.

    Citizens can participate by going to the Republic website and entering under their access codes. They can then use any points they have collected for recycling and designate them for one of the projects.

    People who would like to participate in selecting the grant recipient can go to the Republic website or the Town of Fountain Hills website and register for the Republic Rewards program.

    People may go to the website and assign their rewards points to one of the projects as often as they like during the voting period, which lasts until May 31. The winner of the grant will be announced at the Town Council meeting in early June.

    Sand, sunscreen and flip flops keep ACC busy

    Rusty nails piercing jandals, allergic reactions to sunscreen, sand in the eyes, slips on spilled ice creams, collapsing deck chairs, burns from the barbie, and pulled muscles from playing backyard cricket.

    These are just some of the 'seasonal' mishaps that led to ACC injury claims last summer.

    A total of 439,878 claims were received between 1 December 2012 and 28 February 2013.

    That put summer slightly ahead of winter (435,125 claims) and spring (420,690 claims) but trailing autumn (468,648 claims) as the most 'injurious' season last year.

    ACC Injury Prevention Programme Manager, Megan Nagel, says there are always small numbers of claims each year that have a distinctively seasonal flavour.

    "Beach-related injuries tend to be more frequent in summer, as you'd expect, while injuries caused by heaters are more common in winter."

    However, other types of injuries occur constantly throughout the year.

    "Falls in the home are the number one cause of injuries in New Zealand, regardless of what time of year it is."

    Ms Nagel's advice to Kiwis wanting to see out the rest of this summer safely therefore includes a mix of seasonal and 'year round' injury prevention tips.

    "Summer can be a popular time for socialising and outside DIY, so we remind people to be responsible hosts if serving alcohol, and pay attention to safety when using things like power tools and ladders."
