You just bought a used car and the engine blew up on the drive home from the dealership. What can you do? The answer depends primarily on one question: Did you buy it "as-is"? Judging by the phone calls I get at my office where I deal with automobile warranty law ("Lemon Law") the answer is usually, "Yes." Followed by, "What does 'as-is' mean?" If you're asking the question now while the car with the blown engine drips its last ounce of oil in your driveway it is too late. So, follow along as I explain what all of this means so you can protect yourself in the future.
The notion of what a "warranty" is, in general, would take far too much space to explain here so we'll jump ahead to the one which is important in this context: the Implied Warranty of Merchantability. Most states have adopted the Uniform Commercial Code where all of this is laid out. It says that if you buy goods from a merchant who deals with goods of that kind, you can expect that they will perform as one might expect without the merchant having to actually say it for it to be enforceable. (It says the goods will be "fit for the ordinary purposes for which such goods are used.") A refrigerator you buy from an appliance store will keep your food cold. A lawn mower from the Toro dealer will cut your grass. The car battery from the auto parts store will provide and store electricity for your car. You can expect these things to happen even if the salesperson was silent on what the products will do. It is implied by operation of law.
So, we start from the point that an automobile will provide safe and reliable transportation if you are buying it from a merchant who sells goods of the kind (a car dealer).
Note that this does not apply to a private sale. A private seller is not a merchant so the implied warranty never comes into existence. This protects you if you are a private seller but it means you must be more careful when buying from a private seller.
But, there is a loophole that swallows the rule: Most states allow sellers to disclaim the implied warranty of merchantability entirely, so long as they do it conspicuously. Once they do that, it is no longer implied and does not exist. And, in the states where it is allowed, most used car dealers disclaim the Implied Warranty of Merchantability. A while back, there was so much confusion in this area, the Federal Trade Commission came up with the Buyer's Guide. It is a single sheet of paper which specifies "WARRANTIES FOR THIS VEHICLE." It give two options: AS-IS NO WARRANTY and WARRANTY. There are boxes in front of those two choices and the dealer is told to check one. Federal law requires the sticker to be visible to a car shopper who is looking at the vehicle. Hence, it is often in one of the windows.
A great majority of used cars sold in America are sold with the "As-Is" box checked. (There are several states that do not allow the disclaimer and for them, there is a modified Buyers Guide.)
And "as-is" means with all faults. Repairs are the responsibility of the buyer. There are no guarantees. That car is yours. It could explode as you drive it off the lot. The smoldering remains are still yours. It even says so: "YOU WILL PAY ALL COSTS FOR ANY REPAIRS. I do wish the Feds would cool it with that cap-lock though.

GILBERT, AZ (CBS5) -
A Gilbert woman says her home security company told her to leave equipment she owned behind when she movedand then wanted to charge her for equipment in the new home.
In many home security contracts, you own the equipment and that means you have the right to take it with you if you move.
"I've been a very loyal customer, never missed a payment," Sharon Milite said.
Milite is angry with her home security company. She signed up with a company called Protection Source, but her contract was serviced by another company called Guardian Protection Services. She says after 34 months with Guardian, she called to tell them she was moving. She says Guardian gave her specific instructions regarding the old house.
"They said the equipment, or sensors are to be left at the home and when I move to the new house, contact them, and they would have a serviceman come," Milite said.
All she took was the control box and key fob. Milite says she had paid about $500 for her equipment. Since she left it behind at Guardian's request, she expected equipment at the new home to be free. But she says Guardian wanted over $350 for it.
"I've been paying on the previous sensors and equipment in the old house, you told me to leave it, why am I being charged again," Milite said.
Milite says Guardian offered her free equipment if she agreed to add a year onto her contract. Milite says the company didn't tell her the cost of new equipment up front and never gave her the option to use her old equipment.
"I would have definitely had someone come and professionally uninstall it, and bring it to the new house, knowing what I know now," Milite said.

Violent Plum Home Invasion Caught On Security Camera
Keeping an eye on your home when youre not there comes with trade-offs. Connected security cameras can be costly and difficult to install. They usually require constant power, and the ones that dont run off batteries that need to be recharged. Ive tested a few of these cameras and found that, at least for me, the annoyances generally outweigh the benefits of being able to peek in on my living room from my desk at work.

See, Blink is a home security camera and a demonstration of Immedias technology. End users like you and me who order the Blink cameras on Kickstarter are customers, but Immedia also sources its semiconductors to OEMs (original equipment manufacturers) across several technology markets, including home monitoring. Immedia cofounder Don Shulsinger explained to me that by crowdfunding Blink on Kickstarter, Immedia can not only sell a finished product directly to consumers, but also prove to its OEM partners that they should adopt Immedias chips for their own products. With the Kickstarter campaign a runaway success, the company has already shown that there's demand for Blink's unique set of features.
Blink can be wall-mounted, corner-mounted, or sit on a shelf.
Each Blink camera has a motion sensor and a temperature sensor, and connects to your home Wi-Fi network. But you don't have to set up multiple cameras one by one. Instead, the Blink system also comes with a sync module that plugs into the wall. When you fire up the smartphone app (for Android or iOS), youre communicating with the sync module, which then in turn sets up the network of camerasShulsinger told me that Immedia has tested one sync module with 10 cameras, and suspects itll work with up to 16. Then you can put the wireless, battery-operated cameras anywhere, up to 100 feet away from the sync module, as long as theyre within range of your Wi-Fi network.
To minimize the chore of keeping that many Blink cameras charged, the system keeps the cameras at zero power when they arent being used. Recordings are triggered by motion sensors, so Blink also has to start up quickly to be able to actually record whatever the sensor detectedif the hardware takes a few seconds to boot up, the burglar who tripped the motion sensor could be in the kitchen making a sandwich by the time the camera by the front door captures any video. Shulsinger says the Blink cameras can wake up and start recording in a fraction of a second.
Blink can start recording in under a second, then send the data to the cloud in a single burst. Push notifications arrive to your iOS and Android phone.
The system defaults to 5-second recordings in response to the motion sensor or the onboard temperature sensor, but you can tweak that duration in the app, as well as check in on the cameras manually, of course. And the cameras dont stream the video up to the cloud; they compress it and send it up over Wi-Fi in one short burst. Because Immedia controls both the hardware and the software in Blink, Shulsinger told me that the system can squeeze up to a year of battery life out of each Blink camera. Thats something I cant wait to test, but even if that estimate turns out to be high, it would have to be off by a lot to approach the battery life of a competitor named Butterfleye, which I saw in prototype form in May.
Like Blink, Butterfleye is a wireless, rechargeable, sensor-equipped security camera. Unlike Blink, it's totally self-contained, so it works without a sync module or other base station. But it also only goes about two weeks between charges, and costs significantly more$199 to preorder, versus a current price of $69 to preorder the Blink. Along with a motion detector, Butterfleye uses iBeacon and Wi-Fi geofencing, plus thermal sensors, to decide when to record and when to stay asleep, while Blink focuses on power consumption by staying asleep most of the time and then blinking awake in a flash.

VALDOSTA, Ga. Contractors for the Georgia Department of Transportation will shift travel lanes within the U.S. 84/State Route 38/West Hill Avenue project Wednesday to allow for construction on the frontage roads adjacent to and underneath the new railroad overpass.
Contractors will begin removing the at-grade railroad crossings, paving the frontage road tie-ins and completing the curb and gutter. This will require closing the frontage roads to traffic. In order to continue to provide local access to the area, traffic will be routed onto the overpass. Through traffic will continue to be detoured and only traffic accessing local businesses and residences should use the overpass.
Two lanes of the bridge will be accessible, but the bridge is not open. In order to complete the project weve got to put traffic on the bridge, District Construction Engineer Scott Chambers said.
The only other option would have been to close the route for the duration of the frontage road work. Georgia DOT did not want to do that because it would have been a major inconvenience to local businesses and residents.
Temporary road striping must be completed before traffic can be put on the bridge. Weather permitting, traffic should be shifted by noon, Chambers said. Construction on the frontage roads is expected to take six weeks to two months.
All city streets within the project area will be closed at the intersection of West Hill Avenue. All through traffic not accessing local businesses must continue to use the mandatory detours already in place.
When completed, the bridge will consist of four lanes and will include 6-foot wide sidewalks with fencing on each side. Installation of the fencing is expected to be finished Wednesday. The frontage roads will also have sidewalks.
The $9.3 million project is on track to finish a couple of months ahead of the scheduled Dec. 31 completion date, Chambers said. The new 300-foot concrete bridge over the railroad crossing is expected to improve traffic flow and relieve drivers of delays caused by the numerous trains that cross the track daily. The construction contractor is Reames and Son Construction Co. Inc. of Valdosta.

More than a week after music fans rocked out at Lollapalooza, two mud-slopped fields in Grant Park remained closed to the public for the repair work that is set to begin Wednesday. The price tag for the post-fest repairs is estimated at $266,000, the Chicago Park District announced Tuesday.
Thanks to rain during the fest, concertgoers left the turf fields torn up, particularly at the southern end of Grant Park where about 30 acres of the park was blocked off Tuesday.
The three-day music festival, which was held Aug. 1-3, is hosted on 115 acres of Grant Park. The entire park is 325 acres including the high-traffic areas of Millennium Park and Buckingham Fountain.
On Tuesday, chain-link fences surrounded the swampy Lower Hutchinson Field from Balbo Avenue to 11th Street where headliners Eminem, Outkast and Kings of Leon performed on the Samsung Galaxy stage. Also closed off was mushy Upper Hutchinson Field from Balbo Avenue to roughly 8th Street where Iggy Azalea and Chance The Rapper graced what's known as Perry's stage.
The rest of Grant Park was open to the public, including Buckingham Fountain, the gardens and Butler Field where puddles, mud pockets and dozens of geese were spotted at the park's north end.
"For all intents and purposesI was at Grant Park yesterdayit's basically open other than the one area down at the south," said Bob O'Neill, president of Grant Park Conservancy. "People are using it as if nothing happened there," he said of the rest of Grant Park.
A day after the fest, Lollapalooza promoter C3 Presents said it saw more damage to parts of Grant Park compared to 2013 due to heavy rains Aug. 3. Last year, the Chicago Park District estimated the repairs to cost $210,000 to $220,000.
But it wasn't as bad as 2011, when it cost roughly $800,000 to repair Grant Park after three inches of rain soaked festgoers, O'Neill said.
Representatives from C3 and the park district as well as an independent third-party contractor assessed the condition of Grant Park before and after the festival.
Under the terms of the concert agreement, C3 is responsible for picking up the repair tab.
